Copyright Basics

• Copyright is a type of intellectual property that protects original works of authorship.

Original Works

• A work is original when it is independently created by a human author and has a minimal degree of creativity.
• Originality requires a "spark" and "modicum" of creativity.

Fixed Works

• A work is fixed when it is captured in a sufficiently permanent medium that the work can be perceived, reproduced, or communicated for more than a short time.

Copyright Ownership

• Everyone is a copyright owner as soon as they create an original work and fix it.

• U.S. copyright law provides copyright owners with the exclusive rights to:
  • Reproduce the work
  • Prepare derivative works

  • Display the work publicly
  • Perform the work publicly by means of a digital audio transmission

Copyright Duration

• The length of copyright protection depends on when a work was created.
• Works created on or after January 1978 have a copyright term of life of the author plus seventy years after the author's death.
