Brief Historical Background of EIA in Nigeria

  • Environmental consciousness and need for environmental protection in Nigeria arose with the 'Koko Toxic Dump' in Bendel State in 1987
  • Led to the creation of the Federal Environmental Protection Agency (FEPA) by decree 58 of 1988 (amended by Decree 59 of 1992)
  • FEPA created sectoral and procedural guidelines on how to carry out EIA in Nigeria
  • FEPA is now absorbed into the Federal Ministry of Environment since 2003
  • States were encouraged to establish their own (S)EPA under decree 59 of 1992

Nigeria's EIA Systems

  • EIA Decree 86 of 1992 made EIA a legal requirement for all developers of projects
  • Department of Petroleum Regulation's (DPR) Environmental Guidelines and Standards (EGAS) of 1991 provides guidelines and monitoring procedures for EIA in the petroleum industry
  • The Town and Country Planning Decree 88 of 1992 also made EIA a requirement for estate and property development
  • However, EIA implementation in these sectors has not evolved satisfactorily (Ogunba, 2004)

The National Policy of the Environment of 1989, revised in 1999 and 2016

  • Policy provides for a national mechanism for cooperation, coordination and regular consultation, and harmonious management of policy within various government tiers
  • Aim of the 2016 revision was to create a new holistic framework for managing the country's environment and natural resources for sustainable development

Objectives of the Policy

  • Aim is to achieve sustainable development in Nigeria, focusing on securing a quality environment for good health and wellbeing
  • Conserve the environment and natural resources for present and future generations
  • Raise public awareness and understanding of environmental links to resources, development and encourage participation

The Environmental Impact Assessment Act No. 86, 1992 (FMEnv) (now revised as: EIA Act CapE12 LFN 2004)

  • EIA Act made EIA a mandatory process for major development projects from the planning stage to ensure environmental issues are anticipated
  • All Agencies (public or private) except exempted must apply to the Federal Ministry of Environment, prior to embarking on projects, allowing for environmental assessment

Objectives of the Act

  • Decision making about activities that might affect the environment, by persons and bodies, must consider environmental effects
  • Implement policies that align with laws and decisions to realize the goals described in (a)
  • Encourage the procedure for information exchange consultation between organs regarding activities with significant environmental effects

Degree of Environmental Significance and Mandatory Activities

  • Environmental effects in assessments need to be detailed based on their likely significance
  • FMEnv categorizes activities into three categories (I, II, III), based on a list of projects in Schedule 1 of the law
  • Category I projects require a full EIA
  • Category II projects may only require a partial EIA, focusing on mitigation, unless near a sensitive area
  • Category III projects are considered to have 'essentially beneficial impacts' and may not require an EIA

Cases where environmental assessment is required

  • Environmental assessment for activities committed by Federal, State or Local government bodies that might significantly impact the environment

Restriction on Public or Private Projects without Environmental Considerations

  • No activities should be undertaken without early consideration of environmental effects.
  • Activities with significant effects on the environment must undergo assessments
  • All agencies/institutions must apply in writing to relevant agency for environmental assessments.

Exceptions to the EIA

  • Environmental assessment not required if an agency, with approval from President, the Commander-in-Chief of the armed forces or the Council determines that project will have minimal impact
  • Not required for emergencies where government has taken temporary measures or where the Agency deems the project critical for public health or safety

The Nigerian EIA Procedures

  • A flowchart outlines the steps involved using a systematic format of project proposal/feasibility study.

EIA Process Flowchart

  • Detailed flowchart shows steps for submission of project proposals/feasibility studies and the necessary processes through the Federal Ministry of Environment (FMEnv)
  • This includes steps for registration, screening, scoping, execution or EIA, review of draft and final reports, and proponent's responsibilities

Consultation with the Public

  • The Agency must allow public participation for environmental impact assessments through a process that involves agencies and members of the public, experts from relevant discipline and groups giving feedback
  • The Agency must advise the public on its course of action, mitigation plans, the extent of recommendations in a report, and follow-up programs

Disclosure of the Mandatory Report (EIA)

  • The Agency must make information related to mandatory study/impact reports available to the public, including the date the report is available, the location for obtaining copies, and the deadline for filing comments
  • The report must be released/made available by a mediator or a review panel

Transboundary Effects

  • Where a project, not requiring an EIA under a specific section, is likely to cause significant environmental effects outside Nigeria or its federal lands, a review panel may assess its international effects.

Penalties

  • Penalties for non-compliance with provisions range from N100,000 (US263)individualfines/imprisonmentuptoN1,000,000(US263) individual fines/imprisonment up to N1,000,000 (US263)individualfines/imprisonmentuptoN1,000,000(US2630).

The National Environmental Standards and Regulations Enforcement Agency Act 2007 (NESREA Act)

  • Aims to ensure cleaner, healthier environments in Nigeria, promote responsibility
  • NESREA's mandate includes the legislation for environmental protection and control
  • NESREA is charged with enforcing environmental laws & regulations to enhance the protection of Nigeria's resources

Sector Guidelines

  • NESREA has issued sector guidelines since 2009 covering various areas, such as wetlands, watersheds, noisy standards & pollution control; these documents detail requirements for each sector

The National Effluents Limitations Regulations of August 1991

  • This regulation makes it mandatory for industrial facilities to install anti-pollution equipment to treat effluent.
  • It provides maximum limits on discharge parameters for industries and penalties for non-compliance
  • It includes uniform effluent standards as well.

The Management of Solid and Hazardous Wastes Regulations (1991)

  • Objective of waste management is to identify solid, toxic, and extremely hazardous wastes, monitor them, dispose of them safely.
  • Also, establishing a proper record keeping and labeling system for hazardous waste,
  • Researching for methods of reuse and recycling.

The National Environmental (Air Quality Control) Regulation, S.I. No 64 of 2014

  • Aims to improve air quality, protect ecosystem resources from air quality deteriorations
  • Gives Agency power to enter premises and seal facilities that violate air quality regulations
  • Includes fines for individuals or corporations that violate regulation's provisions
