Electronic Data Message Acknowledgment
- An acknowledgment of receipt of an electronic data message or electronic document may be given via any form of communication by the addressee, regardless of whether it's automated or not, as long as it clearly indicates the receipt to the originator.
- If the message's effect or significance is contingent upon the acknowledgment's receipt, the message is considered never sent until the acknowledgment is received.
- If no such conditional statement is made, and the recipient fails to acknowledge within a reasonable time frame, the originator can issue a notice demanding an acknowledgment within a specified time. If the acknowledgment is not received within the allotted time, the originator can regard the message as never sent.
Electronic Data Message Dispatch Time
- Unless the parties agree otherwise, an electronic data message or electronic document is deemed dispatched when it enters an information system outside the control of the sender.
Electronically Transmitted Documents in Government
- The DTI, Department of Budget and Management, and the Bangko Sentral ng Pilipinas are responsible for enforcing electronic transaction regulations.
