Purpose and Policy
- The purpose of this general order is to prohibit the manufacture, distribution, possession, or use of controlled substances by ECSO members on or off duty.
- The ECSO aims to employ a workforce free from illegal drug use on or off the job, and free from alcohol in the workplace.
- Members who violate this policy are subject to disciplinary action, up to and including dismissal, even for the first offense.
Procedure
General Guidelines
- Members found with illegal drugs in their system or in possession of drugs may be subject to disciplinary action up to and including dismissal.
- Members taking prescription drugs must notify their supervisor if the medication may affect their judgment, work performance, or safety.
- Abuse of prescription drugs is not tolerated.
- Members must comply with all federal and state drug laws.
Types of Testing
- Pre-employment drug testing is required for safety-sensitive and special risk positions.
- Types of testing include:
- Reasonable suspicion testing
- Post-event testing
- Random testing
- Follow-up testing
Reasonable Suspicion Testing
- Reasonable suspicion testing is conducted when there is evidence to believe a member is using or has used drugs in violation of ECSO policy.
- Circumstances that may indicate a drug problem include:
- Observed drug and/or alcohol use during work hours
- Observable physical signs
- Incoherent mental state
- Marked changes in personal behavior
- Deteriorating work performance
- Evidence of drug use on ECSO premises or while operating ECSO vehicles
Drug Testing Standards
- All testing is conducted by a certified laboratory.
- Positive test results are reviewed by a certified Medical Review Officer to ensure accuracy.
Confidentiality
- All information received regarding drug testing results is maintained in the member's medical confidential file.
