  • The Board shall maintain a list of the names, current mailing addresses, and office addresses of all persons who hold a license or permit issued by the Board.

  • The Board may establish guidelines for courses of study necessary for dental assistants, oral maxillofacial surgery assistants, and issue permits authorizing dental assistants to perform expanded duties.
  • The Board may establish continuing education requirements for dentists, dental hygienists, dental assistants, and oral maxillofacial surgery assistants.
  • The Board may recognize the parameters and standards of care established and approved by the American Dental Association.

Unlawful Practices

  • Unlawful practices for dental hygienists include:
    • Advertising or publishing, directly or indirectly, or circulating through the usual commercial channels.
    • Placing their name in any city, commercial or other directory.
    • Placing their name in the classified section of a telephone directory.
    • Offering free dental service or examination as an inducement to gain patronage.
    • Claiming the use of any secret or patented methods or treatments.
    • Employing or using solicitors to obtain patronage.
    • Paying or accepting commission in any form as compensation for referring patients.
    • Advertising as having ability to diagnose or prescribe for any treatment.
    • Publishing any schedule or comparative prices or fees for their services.
    • Claiming or inferring superiority over other dental hygienists.

Supervision

  • Direct supervision: The supervising dentist is in the dental office or treatment facility and personally examines the patient, diagnoses any conditions that need to be treated, and authorizes the procedures to be performed.
  • General supervision: The supervising dentist has diagnosed any conditions to be treated, personally authorized the procedures to be performed, and will evaluate the results of the dental treatment within a reasonable time.
  • Indirect supervision: The supervising dentist is in the dental office or treatment facility, has personally diagnosed any conditions to be treated, authorizes the procedures to be performed, and remains in the dental office or treatment facility while the procedures are being performed.

Treatment Facilities

  • A treatment facility includes:
    • A federal, tribal, state, or local public health facility.
    • A federal qualified health care facility (FQHC).
    • A private health facility.
    • A group home or residential care facility serving the elderly, handicapped, or juveniles.
    • A hospital or dental ambulatory center (DASC).
    • A nursing home.
    • A penal institution operated by or under contract with the federal or state government.
    • A public or private school.
    • A patient of record's private residence.
    • A mobile dental unit.
    • A dental college, dental program, dental hygiene program, or dental assisting program accredited by the Commission on Dental Accreditation.### Unlawful Practices of Dental Hygienists
  • Attempting to use any oral prophylaxis list, call list, records, reprints, or copies of same, or information gathered therefrom, or the names of patients whom they have formerly treated when serving as an employee in the office of a dentist.
  • Failing to keep prominently displayed in the office of the dentist for whom they are employed, their license and annual renewal certificate.

Power of the Board

  • The Board has the power to revoke or suspend the license, reprimand, or place on probation a dental hygienist for a violation of one or more of the following:
    • Pleading guilty or nolo contendere to, or being convicted of, a felony, a misdemeanor involving moral turpitude, or a violation of federal or state controlled dangerous substances laws.
    • Presenting a false diploma, license, or certificate, or one obtained by fraud or illegal means.
    • Being, by reason of persistent inebriety or addiction to drugs, incompetent to continue the practice of dental hygiene.
    • Being guilty of dishonorable or unprofessional conduct.
    • Failing to pay registration fees as provided by the State Dental Act.
    • Being a menace to the public health by reason of a communicable disease.
    • Being mentally incapacitated or having been admitted to a mental institution.
    • Being grossly immoral.
    • Being incompetent in the practice of dental hygiene.
    • Being guilty of willful negligence in the practice of dental hygiene.

Delegation of Duties

  • A dentist may delegate certain duties to a dental hygienist, including:
    • Health history assessment pertaining to dental hygiene.
    • Dental hygiene examination and the charting of the intra-oral and extra-oral conditions.
    • Dental hygiene planning and treatment.
    • Prophylaxis, which means the removal of calcareous deposits, stains, accretions, or concretions from the supragingival and subgingival surfaces of the teeth.
    • Periodontal scaling and root planing.
    • Dental hygiene maintenance and treatment.
    • Placement of subgingival prescription drugs for prevention and treatment of periodontal disease.
    • Soft tissue curettage.
    • Placement of temporary fillings.
    • Removal of overhanging margins.
    • Dental implant maintenance.
    • Removal of periodontal packs.
    • Polishing of amalgam restorations and other procedures authorized by the Board.

Supervision

  • A dentist may authorize procedures to be performed by a dental hygienist, without complying with the provisions of paragraph 3 of subsection B of this section if:
    • The dental hygienist has at least two years of experience in the practice of dental hygiene.
    • The authorization to perform the procedures is in writing and signed by the dentist.
    • The procedures are performed during an initial visit to a person in a treatment facility.
    • The person upon whom the procedures are performed must be referred to a dentist after completion of the procedures performed.

Independent Practice

  • A dental hygienist cannot own or operate an independent practice of dental hygiene.

Advanced Procedures

  • Two advanced procedures for dental hygienists are:
    1. Administration of local anesthesia.
    2. Administration of nitrous oxide analgesia.

Annual Renewal

  • The deadline for annual renewal for dentists, dental hygienists, dental assistants, oral maxillofacial surgery assistants, and other licensee or permit holders is on or before the first day of January of each year.
  • The annual renewal includes:
    • Renewal application with information as may be required by the Board.

Continuing Education

Failure to Pay Annual Renewal Fee

  • Upon failure of a dentist, dental hygienist, dental assistant, or oral maxillofacial surgery assistant to pay the annual renewal fee within three months after January 1, the Board shall notify the dentist, dental hygienist, dental assistant, or oral maxillofacial surgery assistant in writing by certified mail to the last-known mailing address as reflected in the record of the Board.### Digital Era and Social Change
