Criminal Charges and Convictions
- Spring Fire Department (SFD) employees and volunteers must report any criminal charges to Human Resources.
- Class C Misdemeanors (including traffic violations) must be reported within 96 hours of the occurrence.
- Employees or volunteers with three or more traffic violations within twelve months are subject to disciplinary action, including suspension, probation, driving privileges revocation, demotion, or termination.
- Class B Misdemeanors or greater must be reported to Human Resources immediately upon release from custody.
- If the charge involves possible bodily injury, immediate suspension without pay will result pending investigation and legal counsel review.
- If Human Resources and legal counsel determine the charge causes undue hardship on SFD, unpaid leave pending the outcome of the criminal trial will result.
- Conviction of Class B Misdemeanors or greater leads to termination for employees or volunteers.
- Volunteer members are subject to immediate termination upon receiving Class B Misdemeanor or greater charges, regardless of trial outcome.
- If a criminal charge is a result of ongoing civil matters, immediate notification to Human Resources and following their advice is required.
- After returning to shift pending trial, employees must keep Human Resources informed of trial dates and disposition.
- Conviction or accepted pretrial diversion leads to disciplinary action up to and including termination.
- Texas Department of State Health Services (TDSHS) requires notification of charges above Class C Misdemeanors through their Criminal History Documentation Guide and Criminal History Form immediately.
- TDSHS notification of conviction or pretrial diversion is required within thirty days of completion of disposition.
- The employee or volunteer is responsible for completing TDSHS forms and guidelines.
- The Texas Commission on Fire Protection (TCFP) requires notification of conviction using form TCFP-014 and updated finger print submission.
- The employee or volunteer is financially responsible for finger print submission.
- Human Resources is responsible for submitting conviction notification to TCFP within seven days of completion of disposition for any regulated employee or volunteer member remaining with SFD.
- Employees and volunteers must ensure all required documentation is submitted to Human Resources within seven days to comply with state regulations.
