General Principle 1

GP1 states that the roles, duties, obligations, and responsibilities of all contract participants must be consistent with the general conditions and suitable for the project's specific requirements.

This principle ensures that the roles, duties, obligations, and rights of all parties (Employer, Contractor, Engineer, Employer’s Representative, Dispute Avoidance/Adjudication Board, Subcontractors, etc.) are not significantly altered from how they are defined in the General Conditions (GCs).
Examples of GP1 Compliance
- The Employer must honor its payment obligations under the Contract regardless of its own financial situation.
- The Employer must provide the Contractor with reasonable evidence that sufficient financing arrangements are in place.
- If the Employer fails to adhere to its payment obligations, the Contractor must not be denied its rights under the GCs, such as receiving financial charges for late payments, and the right to suspension and termination.
Examples of Non-compliance with GP1

Requiring an Engineer in a Red Book or Yellow Book contract to gain the Employer’s approval before deciding on a Contractor's claim or granting an extension of time is non-compliant. The Engineer has the authority to fairly determine the Contractor’s entitlements in accordance with the Contract conditions, and this should be independent of the Employer's influence.

Transferring the risk of Unforeseeable physical conditions to the Contractor under a Yellow Book Contract is non-compliant. The Silver Book Contract form is more appropriate if the Employer is not willing to take on this risk.
General Principle 1 (GP1)
- GP1 defines the duties, rights, obligations, roles, and responsibilities of all Contract Participants.
- GP1 states that these roles and responsibilities should generally be as implied in the General Conditions.
- GP1 also states that these roles and responsibilities must be appropriate to the requirements of the project.
