Treatment and Transportation of Minors
- Informed parental consent is essential for the treatment and/or transportation of minors whenever possible.
- Certain circumstances may arise where obtaining parental consent is questionable or challenging.
Emergency Medical Care Without Parental Consent
- Implied consent allows for emergency procedures on injured minors without explicit consent if:
- Delay in treatment could jeopardize the minor’s health or well-being.
- Parental consent cannot be obtained due to inability to identify a responsible party or if they are unreachable.
- Parents or lawful guardians must be notified as soon as feasible after emergency care is administered.
- Documentation of the situation and reasons for not obtaining consent must be included in the ePCR (electronic Patient Care Report).
Individuals Authorized to Consent for Minors
- If the parent cannot be reached, consent may be given by the following individuals in order of priority:
- A person holding a power of attorney for medical consent.
- Stepparents, grandparents, adult siblings, aunts, or uncles.
- DCFS or Department of Juvenile Justice caseworkers if no objections to consent have been expressed.
Release of Care of a Minor
- If a minor is deemed not in need of further medical assistance, the Officer-in-Charge (OIC) must assess the minor’s surroundings and ability to function independently.
- Factors for consideration include the minor's emergency awareness, ability to contact a responsible adult, and maturity to care for themselves.
- A minor may be released to themselves if the OIC finds them capable.
- If not deemed capable, Law Enforcement should be notified.
- Reporting to Law Enforcement does not replace the requirement to report suspected abuse or neglect to the Florida Abuse Hotline.
- Minors who are ill or injured in school may be treated and released to school officials, provided those officials will wait for the parents when the situation stabilizes.
Refusal of Treatment or Transportation
- Parents or guardians have the legal right to refuse care, treatment, or transportation for a minor.
- In life-threatening situations, Law Enforcement will be called for assistance.
- For non-life-threatening cases, similar guidelines to adult refusals apply, including signing an ePCR refusal of treatment area by the parent or guardian.
