Community Payback Orders
- Definition: A community payback order is an alternative to imprisonment for convicted offenders.

- Serious offenses: Courts can impose orders with multiple requirements if the offense is deemed serious enough.
- Less serious offenses: Courts can impose orders with fewer requirements for those convicted of fines (whether punishable also by imprisonment or not), or in cases specified in subsection (4)(b). Justice of the peace courts have more limited order options
- Justice of the Peace Court Limitations: Justice of the peace courts can't impose all the types of requirements available to other courts.
- Ministerial Amendments: The Scottish Ministers can amend the types of requirements available to justice of the peace courts. Changes require the approval of the Scottish Parliament.
- Procedural Considerations:
- Seriousness Assessment: The court must believe the offence warrants a community payback order.
- Compatibility: If the offender is facing multiple requirements, the court must verify their compatibility.
- Required Report: The court needs a report from a local authority officer on the offender's situation.
