Article 9 Overview

Compliance and Applicability
- Article 9 must be adhered to by HCBS providers, day program providers, and group home providers.
- Therapists funded by DDD, developmental home providers, and intermediate care facilities also have to comply.
- Police, schools, doctors, and unpaid family members are not bound by Article 9.
Individual Rights Under Article 9
- Individuals have rights to protection against abuse and access to educational, employment, and property rights.
- Rights include the ability to own property, marry, petition, and receive humane living conditions.
- Right to a personalized support plan and to be free from unnecessary medications and excessive restrictions.
Positive Behavior Support
- Focus on compassion and understanding of the reasons behind difficult behaviors.
- Aims to facilitate behavioral changes through supportive methods rather than punitive actions.
Consent and Decision Making
- Individuals must be fully informed and give voluntary consent without coercion.
- Assistance for making informed choices is permissible from significant others, as long as it remains coercion-free.
Green Light Techniques
- Techniques designed to promote positive behaviors, with methods including:
- Active Listening: Communicative engagement methods ensuring understanding and acknowledgment.
- Differential Reinforcement: Ensuring positive behaviors are encouraged while discouraging negative ones.
- Chaining: Breaking tasks into smaller steps that cue subsequent actions.
- Modeling: Demonstrating desired behaviors for individuals to imitate.
- Shaping: Gradual reinforcement of behavior that approaches the desired target.
- Token Economies: Reward systems that allow individuals to earn symbols for good behavior, exchangeable for larger rewards.
Alternative Behavior Plans
