Family Descent
- Ambilineal descent allows individuals to choose their lineage, either through their father's or mother's family.
- Neolocal residency: Couples live independently from their families.
- Patrilocality: Couples move to the husband's family's community, often near his father.
- Matrilocality: Couples reside with or near the wife's family. Often practiced in horticultural societies.
- Bilocal (Ambilocal): The couple chooses which family to live near or with.
- Avunculocal: Couples live with or near the groom's mother's brother.
Marriage
- It’s an arrangement for procreation, caring for offspring, determining legitimate descent, and raising children.
- Westermark's definition of marriage: "...a relation of one or more men to one or more women which is recognized by customs or law and involves certain rights and duties both in the case of children born of it.”
- Marriage is central to kinship systems, creating alliances and "fictive kinship" between members of clans and tribes.
Philippine Family Code
- Article 1 outlines the legal definition of marriage.
- Article 38, Section 1 prohibits marriage between individuals with a consanguineal relationship.
- Article 2 stipulates the requirements for a valid marriage: Legal capacity of the contracting parties (male and female, 18 years old or older)
- Article 3 lists formal requisites: A solemnizing officer, a marriage license (except in specified cases), and a marriage ceremony with the couple’s appearance before the officer and declaration of intent in front of two witnesses.
- Article 8 details the ceremony requirements and location: Publicly, in the solemnizing officer's chambers, open court, church, chapel, temple, or consulate. It can also be done in remote locations according to Article 29 or in cases of marriage contracted on the verge of death.
- Article 15: Those between 21 and 25 years old are required to seek parental or guardian advice.
Family Relationships
- Marriage creates consanguineal ("blood") and affinal relationships.
- Consanguinity: Two people are related by blood through a common ancestor or one is a descendant of the other.
- Affinity: Relationship through marriage (e.g., husband and wife are related by affinity) or by blood to the other person's spouse.
- "Compadrazgo" - Ritual observances that create social relationships, like godparenthood. It creates alliances and "fictive kinship" between members of clans and tribes.
