The Department's philosophy is to promote a free verbal communication between employees and supervisors. This policy is a synopsis of the City of Des Plaines grievance procedure. For the complete city policy, refer to the City Personnel Manual, Chapter 22, Disciplinary and Grievance Procedures. 1002.1.1 GRIEVANCE DEFINED A grievance is a complaint, dispute, or request regarding the administration and/or interpretation of the terms or conditions of employment or the interpretation of any of the following documents by the persons affected: A collective bargaining agreement. Specifically outside the category of grievance are complaints related to allegations of discrimination or harassment subject to the Discriminatory Harassment Policy. Also outside the category of grievances are personnel complaints consisting of any allegation of misconduct or improper job performance against any department employee that, if true, would constitute a violation of department policy, federal, state, or local law as set forth in the Personnel Complaints Policy. 1002.2 PROCEDURE If an employee believes that he/she has a grievance as defined above, then that employee shall follow the procedures outlined in the Des Plaines Personnel Policy Manual, Chapter 22, Disciplinary and Grievance Procedures, Section 22.9, Steps in the Grievance Process. 1002.3 EMPLOYEE REPRESENTATION Employees are entitled to have representation during the grievance process. The representative may be selected by the employee from the appropriate employee bargaining group. In matters concerning the employee’s collective bargaining agreement, the exclusive representative will be notified to attend any conference or settlement even if not requested by the employee (5 ILCS 315/6(b)).
