LAS VEGAS METROPOLITAN POLICE DEPARTMENT POLICY AND PROCEDURE Policy: Volume: Chapter: Revised: 6.430, Extraditions 6 - Investigative Policies 4 - Submittals and Warrants of Arrest 2/2020, 7/2022 6.430 EXTRADITIONS 6.430.1 6.430.2 General Procedure It is the policy of this department to extradite fugitives and criminal suspects back to this jurisdiction for judicial processing in the safest, most expedient, and efficient manner. 6.430.1 General All department extradition activities will be coordinated through the investigative specialist assigned to the Extraditions Detail. The investigative unit that submitted for the warrant is responsible for verifying the identity of the suspect and answering other questions pertaining to the case. Generally, a private prisoner conveyance company contracted by the department will be used for extraditions. Only when special circumstances dictate, department personnel will conduct extradition activities (e.g., escape risks, medical issues, juveniles). In-state transports are not extraditions and are the responsibility of the investigative unit that submitted the warrant. 6.430.2 Procedure Investigator or investigative specialist assigned to the case will: 1. Determine the need for an extradition. a. In cases where a warrant has been issued, confirm within two working days if the District Attorney’s (DA) Office will extradite. b. In cases where a warrant has not been issued, submit a request for the issuance of a warrant within three working days. c. Contact the holding agency and provide needed information and paperwork. 2. Prepare appropriate paperwork. a. When a private prisoner conveyance company will complete the extradition, forward information concerning the extradition (e.g., holding agency, teletype, contact information, signed copy of the waiver of extradition and the name of the DA approving the extradition) to the investigative specialist assigned to extraditions. b. When requesting LVMPD personnel to complete the extradition, complete the Extradition/Travel Request form (LVMPD ISD 47). Note on the form the special circumstances that exist for department personnel to conduct the extradition. Such extradition exceptions generally will only be allowed for juvenile transports, furthering the investigation, or for medical reasons requiring the process to be expedited. Present the request to the bureau commander for authorization, then forward the request to the travel coordinator in LVMPD’s Office of Finance. 3. If LVMPD personnel will complete the extradition, notify the law enforcement agency holding the prisoner of the decision to extradite, via teletype. Complete the online order form for the private prisoner conveyance company under contract and ensure confirmation. a. If the department has contracted with more than one private prisoner conveyance company, determine which company to use based on geography, expense, and timeliness. 2. Advise the law enforcement agency holding the prisoner that the designated private prisoner conveyance company will act as an agent and pick up the prisoner. 3. Maintain records of extradition activities to ensure tasks are completed in a timely manner. 4. Upon receipt of invoice from the private prisoner conveyor regarding appropriate fees, forward the original invoice, the waiver of extradition document, and a copy of the warrant to the Accounting Section.
