Pharmacy Law The Practice of the Profession of Pharmacist in the UAE References Unified healthcare professional qualification requirements * Pharmacist is under the category of Allied Health Federal Law No. (8) of 2019 on Medical Products, the Profession of Pharmacy and Pharmaceutical Facilities Pharmacist A person who holds a scientific qualification no less than bachelor of pharmacy or an equivalent degree from a higher institution, college or university recognized in the country. A pharmacist must be licensed to practice pharmacy within the country according to this Law and its executive decree. Pharmacist In-Charge A licensed pharmacist for a licensed pharmacy. The pharmacist shall be responsible of implementing the provisions of the law and its executive decree within the limits of assigned tasks. Article (37) Other Healthcare Professionals Licensed healthcare professionals other than pharmacists and technical pharmacists shall NOT directly or indirectly sell any medical product unless after obtaining an approval from MOHAP or the concerned Authority. The pharmacist must be graduates from National or International recognized college/University. For graduates from college of pharmacy inside the UAE, the program and university must be accredited by the Ministry of Education (MOE). Qualifications (outside the UAE) must be issued by institutions/colleges recognized in home country. Qualifications acquired through honorary nature, correspondence or distance learning are not counted towards the Healthcare Professionals Qualification requirements. Fresh Graduate – Training … 2 At the entry level (when admit to the college of pharmacy), minimum qualification requirement is high school certificate as per country specific education. You need to register in an approval practice setting (licensed Pharmacy facility) such as community pharmacy or hospital pharmacy. Not have been convicted due to a crime of misconduct or breach of trust, unless they have been rehabilitated or pardoned by the appropriate authorities. Fresh Graduate – Training … 3 Non-UAE national: Graduates from the UAE universities are required to complete six months internship post- graduation in an approved practice settings*. * For pharmacists: licensed community pharmacy or licensed hospital pharmacy UAE National allied healthcare professionals are exempted from the experience and internship requirements for the basic entry level. Note: Practice that are not considered as training for license: - Training during study period - Volunteer jobs - Observership - Non-registered training - Working in pharmaceutical company, industry, research and academia. Pharmacist – License (1) Allied Healthcare professionals applying for licensure must fulfill the following requirements: Required Bachelor degree must be a minimum of three (3)* years full time course duration. * Four year for pharmacist: academic transcript must be submitted for credentialing purpose in which determination of disciplines shall be applied. Pervious requirements for training (previous slides) Master*/PhD (in the area of specialty) will reduce one year from the required experience for licensing provided that the Master’s/ PhD degree is not mandatory to obtain the selected title. *Required Master’s degree must be a minimum of two years full time course duration. Pharmacist – License (2) All non-UAE national graduate allied healthcare professionals from UAE universities are required to successfully complete Six months internship post-graduation. UAE National allied healthcare professionals are exempted from the experience and internship requirements for the basic entry level. Applicants (graduated from outside the UAE) must hold a valid License/Registration to practice in their home country and/or country of last employment (Where applicable). Assessment … 1 Healthcare Professionals are required to pass the Authority’s assessment in order to obtain the professional license in the UAE. UAE nationals are exempted from the Authority examinations, conditions may apply in accordance to Authority standards. The mode of assessment for pharmacists include: written and oral (scientific pharmacy test and pharmacy Law exam). For Non-Arabic speaker, they should pass Arabic exam. Assessment … 2 While applying for the assessment, applicant needs to consider the following: - All assessments will be conducted in English language and no translator is allowed to attend the oral assessment. - Oral assessment consist of minimum five different scenarios/questions in areas related to the specialty or as deemed necessary by the examining panel. - The applicant is granted a total of three attempts to pass the assessment across the Authorities. After the third attempt the applicant is not allowed to apply for a lower or equivalent title. - The applicant is allowed to reapply if additional Recognized Certificate/qualification as per the published unified Professionals Qualification requirements stipulated herein is obtained. After pass the assessment - A pharmacist need a contract from an appropriate setting licensed by the health regulatory authority (e.g. community pharmacy, or hospital pharmacy). - Police clearance The license allows the pharmacist to work in one place only (the place stated on the contract). The license (if not activate) is valid for two years only. A pharmacist should re- sit for exam after the two years if he/she does not activate the license. Pharmacist – Good Standing Certificate (GSC) This certificate mainly for applicant who has a valid professional license to practice, from home country. It is very important for people who are working in the UAE, when leave or change their job. The applicant shall provide Good Standing Certificate (GSC) that meets the following requirements:  Valid and not older than six (6) months at the time of application for licensure.  Issued by the health regulatory authority in the country(s) of last employment.  The Authorities may request more evidence or conduct investigations if deemed necessary to prove the status of good conduct of the healthcare professional.  The applicant must declare that he/she has never been convicted with any legal cases, medical malpractice during his/her practice of the healthcare profession or he/she is currently under investigation. Pharmacist – Experience …1 The applicant’s experience must be relevant to the title applied for and must have been accomplished in an appropriate setting licensed* by the health regulatory authority in the country of practice. * Example: hospital pharmacy Excludes - Volunteer jobs, or Observership - Pharmacy and Pharmacy technician experience with pharmaceutical companies or sales representative is not accepted. Pharmacist – Experience …2 UAE nationals: are exempted from experience requirements for the basic entry level. Non UAE nationals: - Graduates from UAE universities: are exempted from experience post internship/training. - Graduates from non UAE universities: are required to fulfill experience as per relevant titles according to the Healthcare Professionals Qualification requirements. Qualification and Experience Requirements for pharmacy professional (non-UAE universities) Exam Equivalency Criteria Healthcare professionals who successfully completed certain international examinations and/or hold an active registration/license to practice with certain regulatory bodies will be exempted from the assessment required to obtain the professional license (Exam Equivalency Criteria).
