Purpose: The following Rules and Regulations are intended to provide direction to the members of Las Vegas Fire & Rescue for their personal conduct or for conducting the affairs of the Department. B. Scope: These Rules and Regulations supersede all previous Rules and Regulations, bulletins, and/or memorandums issued prior to this date. These rules and regulations are to be considered general in nature and are not all-inclusive. C. Author: The Fire Chief or designee will be responsible for the content, revision, and review of these rules and regulations, and will ensure that they are consistent with any valid and applicable bargaining agreements. RESPONSIBILITY Maintaining a safe working environment, conducting work in a safe manner, and protecting the safety of other employees, and the public are conditions of employment with the Las Vegas Fire Department. A. All Personnel: Are required to adhere to departmental safety regulations, including rules pertaining to the use of proper safety equipment, personal protective equipment, and machine guards. B. Supervisors: Are responsible for monitoring working conditions, instructing employees in the safe conduct of their work, and enforcing safety regulations. C. All personnel: 1. Will comply with the Safety and Health Standards and all rules, regulations, and orders applicable to personal actions and conduct. 2. Will refrain from removing, displacing, damaging, or destroying any safety device or safeguard furnished for conducting work or installed on City equipment or property. 130.02 Safety 3. D. E. Page 2 of 4 Will report unsafe conditions or possible violations of a safety standard to the attention of their supervisor for evaluation and correction if necessary. All Supervisors: 1. Will be familiar with the safety standards that pertain to work areas, equipment, operations, and processes. 2. Will comply with any applicable safety standards and maintain compliance through regular inspection and supervision of work operations, and submit the necessary work order or purchase requests to correct unsafe conditions. 3. Will establish any necessary safety measures specific to job functions of the work unit. 4. Will assure that safety rules are followed by properly notifying employees of safety regulations, instructing employees in safe work practices, maintaining full safety training records, and using good supervisory procedures. 5. Will provide employees with information regarding their protection and obligations. 6. Will maintain records on employees’ exposure to toxic materials and other environmental health hazards as instructed by the Department of Human Resources. 7. Will maintain records of tests, inspections, and modifications required by a standard applicable to specific equipment and operations. 8. Will maintain an information log of reported occupational injuries and illnesses. 9. Will be fully accountable for preventable injuries, accidents, and liabilities caused by the employee. 10. Will enforce work policies and provide accountability and/or recognition within the framework of the positive discipline and EDRS systems. Fire Prevention Division: 130.02 Safety III. Page 3 of 4 1. Will be responsible for conducting an annual inspection of all department facilities to determine compliance with applicable fire prevention or suppression codes. 2. Will be responsible for assuring that any facility modifications and new construction meet applicable fire prevention or suppression codes. 3. Will be responsible for establishing and evaluating emergency fire evacuation procedures for Department facilities and personnel. POLICY A. Prohibited Employee Activities 1. Narcotics and Controlled Substances – Employees shall not use narcotics or controlled substances unless so ordered by a physician for care of a medical condition. Any employee using narcotics or controlled substances under the care of a physician must so inform their supervisor so that any work limitations necessary due to use of the narcotic or controlled substances can be determined and enacted. 2. Alcohol – Employees shall not drink intoxicating beverages while on duty. Employees shall not report for a regular tour of duty or be on a regular tour of duty while under the influence of alcohol or while unfit for work because of the use of alcohol. The odor of alcohol on the breath will be considered presumptive evidence of violation of this rule. 3. Narcotics and Alcohol on the Premises – Employees shall not bring, receive, or keep any intoxicating beverage, narcotics or controlled substances (except as prescribed by a physician) on any fire department property or in any fire department vehicle. 4. Horseplay – Employees shall not engage in horseplay, including running or pushing, tripping others, throwing things directing compressed air at another person, or otherwise engaging in acts which startle or distract other employees. 5. Weapons – While on duty or on any fire department property, employees shall not bring, carry, or have in their possession any firearm or other lethal weapons. The only exception to this rule will be those employees who are required to carry authorized weapons as a part of their official job duties. 130.02 Safety B. Page 4 of 4 Violations of Safety Rules 1. An employee who willfully violates a safety standard, rule, law or statute, practice or procedure shall be subject to disciplinary action in accordance with the degree of willfulness and the gravity and seriousness of the violation. 2. An employee whose willful violation of a safety standard, rule, law or statute, practice or procedure of the City, State, or federal government results in death or permanent total or partial disability of another employee, such that the injured employee becomes incapable of performing his assigned job, shall be subject to disciplinary action in accordance with applicable disciplinary procedures. 3. An employee who knowingly causes an imminent dangerous situation through his actions or failure to perform necessary actions shall be subject to disciplinary action in accordance with applicable disciplinary procedures. 4. A supervisor who knowingly causes or allows a condition, practice, method, operation, or process that has substantial probability to result in death or serious physical harm shall be subject to disciplinary action in accordance with applicable disciplinary procedures, unless such practice, method, operation, or process can be justified due to an emergency. 5. A supervisor, who fails to cease operation or correct an imminent danger situation upon notification by a higher level of supervisor, shall be subject to disciplinary action in accordance with department policies and procedures.
