You are responsible for the integrity and accuracy of these documents. As a designer you have errors and omissions insurance however, this does not mean you should rely on it. Your reputation is at stake, you also represent the profession. Mistakes will happen deal with it professionally. Mistakes can be very costly to both you, your client and the contactor, not just financially but legally also. The last thing you need is a lengthy court case. Every time you make a mistake, it has an impact on your reputation. You live in a social media kind of world. Even if it’s a small mistake it can have a significant impact. Understand what the general contractor has to do in order to build your designs, which will assist with reducing any issues that may have a financial impact. Today we are reviewing tenders of which there are many different kinds and continue to evolve. Prior to issuing a tender, clients will decide what kind of contract they choose to enter into with the contractor. Shifts all liabilities from client to contractor (general contractor) The general contractor builds a markup into the price for overhead and profit and to cover contingencies. This method is a fixed price and is the most commonly use. Typically awarded to the low bidder (lowest price). This price has to include any addenda’s issued. CCDC means the Canadian Construction Documents Committee Humber | Faculty of Media, Creative Arts, & Design | Bachelor of Interior Design 13 INTD 3502 – Site Studies Types of Construction Contracts Cost Plus a Fee Contract (CCDC3) Is an agreement to perform work and to be paid for the actual cost of the work, plus a % or a fixed fee. This is used when the scope of work and cost cannot be clearly defined. Similar to what is called a “time and materials” contract. For example – $700 is quoted for a door (supply and install) and if when all is said and done, you have 10 doors – unit price is applied to all 10 doors. Usually used for a repetitive type of material where quantities are subject to change. Subject to negotiations. They oversee planning, design, construction from start to finish. Works with the owner and consultants of which Interior Designer can be one of them. (CCDC5) Shop for best solutions Used for ‘fast track’ construction – time is of the essence. Contractor controls timeline, cost, quality. Quality is a priority over cost. Can get confusing as there are multiple contracts to be signed. Furniture can be part of construction management but does not have to be. The contractor who best suits the client intentions is selected. The contractor retains all consultants. Can be costly but timeline supersedes. Your involvement in the tender process will depend on your agreement with your Client – check your consultant contract. Includes bid forms to be filled out and signed. Agreement Between owner and contactor, which are the legal terms of reference. Mutual and individual responsibilities, start and completion, financial obligations. General Conditions Identifies all major and /or significant parties to the contract mutual or individual. It is the relationship, rights and responsibilities of the parties signing the contract and establishes how the contract is to be administered Also includes information related to: - Allowances - Payment - Changes in the work - Default notices - Dispute resolution - Protection of person and property - Indemnification (compensation for loss or damage, usually financial) Humber | Faculty of Media, Creative Arts, & Design | Bachelor of Interior Design 26 INTD 3502 – Site Studies Bid Documents – Contract 3. Supplementary Conditions Additional requirements to the general conditions which may or may not impact the contract. Administrative section – includes the non-legal procedural requirements directed to the contractor, site management, conditions, and activities, quality of material, material handling and storing. Submissions – due at a specific time and date Arbitration – process to resolve disputes which approaches a third party who is impartial and makes decisions. Mediation- a method of negotiating to try and resolve disputes, suggested solutions by a third party Addenda – additional information provided after invitation to bid, can also be drawings, and answer to questions from bidders. End of questions 5 days prior to closing Post tender addenda – comes in after submissions but before award Substantial completion – space is ready for use. There may still be deficiencies Insurance – everyone carries it, contractors, owners, designers Negligence – acts of carelessness that have negative consequences, then there are happy Humber | Faculty of Media, Creative Arts, mistakes & Design | Bachelor of Interior Design 27 INTD 3502 – Site Studies Bidding Process - Types of Bids Open – public tenders (MERX) government website Closed – private, by invitation only Bids can be based on anyone of the following three methods Low bid – focus is on price alone (ie. CCDC2 Stipulated Sum). Best value - is a combination of qualifications and price. Each submission is evaluated the top score then have the price added to the bids. Scoring methodology is included in the bid. Qualifications – based on qualifications, scoring methodology also included. Humber | Faculty of Media, Creative Arts, & Design | Bachelor of Interior Design 28 INTD 3502 – Site Studies Bidding Process - Bids and Pricing What you can also do as part of the pricing section is request: Separate prices - maybe budget is not final, you want to see how much something may cost before including it into the contract. Alternates – prices different material to compare costs. Cash allowances – reserves an amount of money, as client typically cannot provide enough detail for something and wants to create a level playing field. Once awarded the contractor has to provide his sub trade bids. Humber | Faculty of Media, Creative Arts, 29 & Design | Bachelor of Interior Design INTD 3502 – Site Studies Tender Process and Bonding Bonding – is an assurance that the costs, performance or labour and material will be covered in the event of default (by contractor). Bid bond – part of bidding process, guarantees that the successful bidder will complete the project. Performance bond – provided by an insurance company or bank to guarantee satisfactory completion of a project. Labour and material bond – more related to sub trades and the work they perform for general contractors. The subs have a contract with the general contractor. If they bid and their bid is well below another bidder, the owner can sit down with them and ask the contractor to confirm if stand behind their bid. Contractors respond – submit their bids. Owners review the bids. Designers may assist owners with the review of the bids. Owners choose the company that they want to work with. The detailed response may include bullet points. Add a title page Add a table of contents Cite references Use graphics – this should augment the report and assist with overall legibility Many reports will include an introduction, body of the report and conclusions If applicable add appendices and bibliography.
