It’s a cross-cutting teaching unit. The objective of this teaching is to enable SNV students to acquire resources on deontology and ethics. University Deontology and Ethics. L2. 1- INTRODUCTION 1.1 Context of the Algerian University In less than fifty years after our country's independence, much has been achieved. The university must fulfill its missions of education and research in a socio-economic environment to reach international standards. a) Questioning ethics The issue of ethics in Algerian universities dates back to the 90s, a period marked by political and socio-cultural upheaval. In this context, a draft decree on the creation of a Council of Ethics and University Deontology, which was to be chaired by the Minister of Higher Education, initiated in 1993, came to nothing, unlike the decree on medical deontology promulgated in 1992. b) Report of the National Commission for the Reform of the Education System In 2001, the National Commission for the Reform of the Education System strongly emphasised the need to draw up and publish a charter of University deontology and Ethics. c) Development of the charter of deontology and ethics for the university profession - In 2004, creation (Executive Decree No. 04-180 of 23 June) of the Council of Ethics and Deontology of the university profession. - In April 2010, the Council for Ethics and Deontology of the university profession drew up and published the Charter of Ethics and deontology of the university profession. - 2023 Charter updates the 2010 Charter and applies to the university community, both public and private, and to all those involved : - *Teacher researcher - * Permanent researcher - * Associate and visiting professor - * Student - *Departmental or university administrative manager - * Administrative, technical and service staff 3  University of Science and Technology of Oran Mohamed BOUDIAF. L2. d) Purpose of the charter of University Deontology and Ethics 1- Empowering the university community in its functions, missions and roles 2- Act collegially in order to strengthen trust between teachers/students/administrative staff and, above all, the university institution and its environment 1.2 Universal consensus A universal consensus around the role, functions and the different tasks of the university institution, considers “three main activities attached to university activity, such as * Teaching, * Scientific research *Social services. These basic charges have been thoroughly explained in UNESCO universal declaration issued on October, 09th 1998 and validated in 2009. This universal declaration has immediately advised to higher education institutions and university community to: a- Submit their entire activities under the requirements of ethics as well as the scientific and intellectual rigor. b- are independently and responsibly authorized to communicate over ethical, cultural and social issues, exercising a sort of intellectual authority of which the company in need to think, comprehend and react; c- to benefit without restrictions from their academic freedom and autonomy as well as the entire rights and duties, once they exhibit responsible and accountable to society What does Ethics and Deontology mean? We will see their meaning in the following lesson (Concepts) 2- CONCEPTS The concepts of ethics and deontology are : Moral, Ethics, Deontology, the Right, Professional values, Learning and Teaching, Didactics and Pedagogy 4  University of Science and Technology of Oran Mohamed BOUDIAF. L2. 2-1 Moral The Moral (Latin: moralis) a) Set of rules of conduct considered good in an absolute sense, stemming from a certain conception of life (cultural, historical, traditional, educational, religious). b) Science of good and evil, theory of human behavior as governed by ethical principles. c) Lesson to be drawn from something, conduct that the event or narrative suggests: the moral of the story. 2-2 Ethics Ethics (Greek : ethikos, Latin: ethicus: moral) a) Branch of philosophy that considers the foundation of the moral. b) Set of moral principles that underlie someone's conduct. 2-3 Deontology Deontology (from the Greek deon: duty, and -logy: study) is the set of duties imposed on professionals in the exercise of their profession. The conduct of those who practice it, the relationships between them and their clients and the public. 2-4 The Right The Right (from Latin : directus: straight) is the set of rules that govern the members of the same community or society. Law is the science that studies these rules. 2-5 Professional Values Professional values are behaviors that individuals must adopt in their workplace. Professional values can be specific to each individual, naturally aligning with the person's character and manifesting in their workplace. These values enable individuals to thrive in their profession and communicate with their peers and company leaders. L2. 2-6 Learning and Teaching -Learning is a form of education or training aimed at initiating the learning of a profession. -Teaching is the transmission of knowledge, skills. 2-7 Didactics and Pedagogy -Didactics is the study of questions posed by teaching and the acquisition of knowledge in different school disciplines. -Pedagogy (Greek: pedagogia: education) is the art of teaching, teaching methods. 3) CHARTER OF ETHICS AND UNIVERSITY PROFESSIONAL CONDUCTS The 2023 charter updates the one from 2010 published by the Ethics and Deontology Council of the Ministry of Higher Education and Scientific Research. The charter applies to the university community, both public and private, and to all its stakeholders. The different parts of the charter are : - Ethical foundations - Deontological rules - Faults and sanctions - Commitments a) Ethical foundation In accordance with the provisions of the constitutional amendment of 2020 and the corresponding legal system regarding the principles of transparency, prevention, and combating corruption, the university must engage in this approach. Through its multiple missions (teaching, research, community service, provision of services and expertise), it must identify and respect its fundamental moral values that the entire university community must implement and defend. Integrity and honesty 6. Mutual respect 7. Digital ethics b) Deontological rules The deontological rules concern: 1. Rights and duties of Teaching-Research Staff and permanent researchers of the Sectors 2. Rights and duties of administrative, technical, and service agents 3. Rights and Duties of the Student b1) Rights and Duties of the Student The student has the right of: - Information about the higher education institution to which he/she belongs, including its internal regulations.\ - Freedom of expression and opinion in accordance with the rules governing university institutions - Respect and dignity on the part of members of the university community. - The necessary security, hygiene, and health prevention both in universities and university campuses /residencies. - Quality teaching and supervision based on modern and adopted pedagogical methods. - The student has the right to a fair, equitable and impartial or unbiased evaluation. - He/she has the right to appeal if he/she feels aggrieved in the correction of a test. - Post- Graduation student has the right to research training through research and support measures. - The syllabus of the course and the related modules must be communicated to the student at the beginning of the year. L2. - It is imperative that the student receives the marks and bar of the test as well as the copy of the test - The student elects his/her representatives to the pedagogical committees without hindrance or pressure. - The student can establish scientific, artistic, cultural and cultural sports associations in accordance with the legislations in force. These associations must not interfere in the administrative management of the university institutions outside the framework set by current regulations. - The student, whether a national foreigner or refugee shall not be discriminated against on the basis of gender, religious beliefs, political opinions, ethnicity or minority, social origin, illness or disability. Likewise, they shall not be subjected to psychological, moral or sexual harassment. - Duties of Students The student is obliged to provide accurate and precise information at the time of registration and to fulfil his/her administrative obligations towards the institution. - The student must respect the schools internal regulations, the regulation in force and the code of conduct and ethics - The student shall respect the dignity of members of academic community and the rights of members of the academic community to freedom of expression and opinion. - The student must refrain from interfering in the smooth running of the establishment, particularly, by closing the access routes to the teaching and scientific research facilities - The student must, therefore, respect the right of all members of the university community to carry out their activities and functions. - The student must wear a dress worthy of his /her status as a student. - The student must show good citizenship inside and outside the university premises. - The student must respect results of the jury of deliberation which are sovereign. - The student is forbidden to resort to fraud and plagiarism. The sanctions he/she incurs, provided for by the regulations in force and the internal rules of the institution, are the responsibility of the disciplinary council and can go as far as definitive exclusion from the institution. c) Faults and sanctions 8  University of Science and Technology of Oran Mohamed BOUDIAF. The sanctions provided for in this charter relate more to the non-compliance with deontological rules than to the violation of ethical principles. Three (3) types of sanctions are possible : 1. Pedagogical 2. Administrative 3. penal 3.3.1 Concerning the students, the offences and sanctions as well as the disciplinary procedure are established by the order of the minister of education and scientific research N°371 of June 11, 2014, published in the official bulletin of the MESRS, year 2014, second quarter, concerning the creation, composition and functioning of the disciplinary council within the establishments of higher education. 3.3.2 With regard to doctoral students in particular the thesis charter annexed to the order of the minister of higher education and scientific research N° 961 of 2 December 2020, "setting out the organization of 3rd cycle training and the conditions of preparation and defence of the doctoral thesis", indicates among the obligations of the doctoral student commitment to respect the rules of ethics and deontology. This charter also specifies the respective responsibilities of the thesis director, the laboratory director and the CFD doctoral training committee. 3.3.3 Without prejudice to the penal qualification and in accordance with article N° 13 of the order of the minister of higher education and scientific research N°371 of 11 June 2014, th following are constitutive of faults of the 2nd degree: Psychological, moral or sexual harassment or Sexist behaviour. Manifestations of racism and discrimination against migrants or on the basis of gender identity, religious beliefs, political opinions, ethnicity or minority status, social origins, illness and disability. or Hate speech relating to any form of expression that promotes, encourages or justifies discrimination, or that expresses contempt, humiliation, hostility, detestation or violence. 3.3.4 The penal system has been completed and enriched by two important law published in the official journal N°25 of 29 April 2020. Law N° 20-05 of 28 April 2020 on the prevention and fight against discrimination and hate speech. With a view to the moralization of public life, the dissemination of the culture of tolerance and dialogue as well as the eradication of violence in society, this law defines and for the first time hate speech and discrimination as 9  University of Science and Technology of Oran Mohamed BOUDIAF. L2. follows: or Hate speech: any form of expression that propagates, encourages or justifie for the first time hate speech and discrimination as follows: or Hate speech: any form of expression that propagates, encourages or justifies discrimination or violence against a person or group of persons, because of sex, race, colour, descent, rational or ethnic origin language, geographical origin, disability or health status. Discrimination: any distinction, exclusion, restriction or preference based on sex, colour, descent, rational or ethnic origin language, geographical origin, disability or health status, which has the purpose or effect of impairing or nullifying the recognition, enjoyment or exercise, on an equal footing of human rights and fundamental freedom in the political, economic, social, cultural or any other field of public life. Hate speech and discrimination, thus, constitute criminal offences of particular gravity. Law N 20-06 of April 2020 modifying and completing the penal code. This law has introduced a new chapter entitled “The infringement of the integrity of examination and competition” composed of the articles 253 bis6 to 253 bis12”. In view of the extreme importance of this new provision, which must be known by all members of the university community, the National Committee on University Ethics and Deontology has deemed judicious to reproduce it below, so that no one ignores or forgets. Article 253 bis 6: anyone who, before or during examination and competitions, disseminates or divulges questions for primary, middle and secondary education or for 14 national vocational competitions as well as for national vocational competition shall be liable to imprisonment for a period of one (1) to three (03) years and a fine of 100.000 to 300.000 DA. Any person who substitutes himself for the candidate in the examinations and competitions mentioned in paragraph (01) of this article shall be liable to the same penalties. Article 253 bis7: the penalty shall be imprisonment for a term of five years to ten years and a fine of 500.000 to 1000.000DA, if the acts mentioned in the article 253 bis6 are committed by: Persons responsible for preparing, organizing, administering r supervising examinations and competitions. A group of persons The use of an automated data processing system. The use of remote of communication. Article 253 bis8: the penalty is criminal disqualification for a period of seven to fifteen years and a fine of 700.000 to 1500.000 DA, if the commission in time of the acts mentioned in article 253 bis6 results in total or partial cancellation of the examination or the competition. Article 253 bis9: the attempt of offences provided for by the present chapter is punished by the same penalties of the offence committed. 10  University of Science and Technology of Oran Mohamed BOUDIAF. Article 253 bis10: in case of conviction for the offences provided in this chapter, the perpetrator may be punished by the deprivation of one or more of the rights provided for in article 9 bis1 of the present code(N.B: this article 9 bis1 refers in its paragraph 4 to the deprivation of the right to teach, to direct a school or to be employed in an educational establishment as a teacher, master or supervisor. Article 253 bis11: without prejudice to the rights of bonafide third parties, the instruments, programmes, and means used in the commission of the offences, provided for in this chapter, as well as the funds resulting there from, shall be confiscated, and the website or electronic account used in the commission of the offence shall be closed down, or access to it shall be prohibited. Besides, the premises and places of operation shall be closed down, in the event that the owner had knowledge of the offence. Article 253 bis12: A legal person who commits any of the offences provided for in this chapter, shall be punished in accordance with the provisions of this code. d) Commitments The Charter of Ethics and University Deontology must be read by every member of the university community, and they must sign the commitment to respect the charter. a) Model No.1 specific to responsible personnel, teaching-researchers, ATS b) Model No.2 specific to students 4- APPLICATIONS The works of the commissions of the regional university conferences (CRU 2020 Works) are published in a document entitled "lu et approuvé.dz" in various forms (Android application, slideshow, PDF format, on the web). This document is a reference tool that allows students and teachers to learn about the rules and applications of conduct to be followed in order to rehabilitate ethical and deontological behaviors in the university environment. The content of the CRU Works concerns student and teacher-researcher members. 4-1 Teaching Applications related to courses, knowledge and behavior assessment for both student and teacher categories. L2. - Bachelor's degree - Master's degree - Doctoral degree - Regarding access and environment (first registration, service provision) - General discipline (mandatory attendance at all pedagogical activities - absence from tutorials, practical work, etc.) - Evaluation and grade calculation (mandatory attendance at exams - right to replacement exam if absence is justified - calculation of the average of a unit is done based on the averages of each subject of the unit with the coefficient) - Deliberation and acquisition (evaluation at the end of each semester and each year by a deliberation jury...) - Progression and reorientation (transition from the 2nd to the 3rd year if the total credits are 120 in the 4 semesters of the program) - Certificate and diploma (issuance of the bachelor's degree diploma) 4-2 Scientific Research Applications related to research methodology, plagiarism, copyright, scientific writing, etc. For 3rd cycle students: - Upon passing the entrance exam, the student has the right to registration and access to services. - They join a research team in a laboratory to conduct their research. - They adhere to discipline (mandatory attendance, respect for others...) - Participation in national and international scientific events - Preparation of an original research thesis, supervised by the thesis director. - Writing the thesis manuscript (literature review - Problem statement - Work plan - Expected results - Discussion - Conclusion - Bibliographic references) - Writing national or international publications in category A or B journals - Any act of plagiarism, falsification of results, or fraud with the scientific work contained in the thesis, duly noted during or after the defense and confirmed by the authorized scientific bodies, may lead to the cancellation of the defense and withdrawal of the acquired title. 12 University of Science and Technology of Oran Mohamed BOUDIAF. University Deontology and Ethics. L2. 1- INTRODUCTION 1.1 Contexte de l’université algérienne En moins de cinquante années après l’indépendance de notre pays, beaucoup a été réalisé. L’université doit s’acquitter de ses missions de formation et de recherche dans un environnement socio-économique, pour atteindre les normes internationales. a) Questionnement de l’éthique Le contexte de la question d’éthique de l’université algérienne remonte aux années 90 marquées par les bouleversements politique et socio-culturel. Dans ce contexte, un avant projet de décret portant création d’un Conseil d’éthique et de déontologie universitaire, qui devait être présider par Monsieur le Ministre de l’enseignement supérieure, initié en 1993 mais n’a pas abouti; contrairement à celui de la déontologie médicale promulgué en 1992. b) Rapport de la Commission nationale de réforme du système éducatif En 2001, la Commission nationale de réforme du système éducatif a, dans son rapport, rappelé avec force la nécessité d’élaborer et de publier une charte de l’éthique et de déontologie universitaire. c) Elaboration de la charte d’éthique et de déontologie de la profession universitaire - En 2004, création (décret exécutif N° 04-180 du 23 Juin) du Conseil d’éthique et de déontologie de la profession universitaire. - En Avril 2010, élaboration et publication de la charte d’éthique et de déontologie de la profession universitaire par le Conseil d’éthique et de déontologie de la profession universitaire.  - La charte de 2023 actualise celle de 2010 et s’applique à la communauté universitaire, publique et privée et à l’ensemble de ses acteurs : * Enseignants-chercheurs * Chercheurs-permanents * Enseignants associés ou invités * Etudiants *Responsables administratifs ministériels ou universitaires * Personnel administratif, technique et de service 16  University of Science and Technology of Oran Mohamed BOUDIAF. L2. d) But de la charte d’éthique et de déontologie universitaire a) Responsabiliser la communauté universitaire dans ses fonctions, ses missions et ses rôles. b) Agir collégialement afin de renforcer la confiance entre les enseignants/ étudiants/ corps administratif et surtout l’institution universitaire et son environnement. 1.2 Consensus Mondiale Un consensus mondial autour du rôle, des fonctions et des missions de l’institution universitaire considère que trois choses tombent sous l’activité des universités et qui sont * L’enseignement * La recherche * Un service à l’égard de la société Ces missions fondamentales sont détaillées dans la déclaration mondiale de l’UNESCO du 9octobre 1998 et validée en 2009. La déclaration recommande fortement aux établissements d’enseignement supérieur et à sa communauté de : a) Soumettre toutes leurs activités universitaires aux exigences de l’éthique, de la rigueur scientifique et intellectuelle b) Pouvoir s’exprimer sur les problèmes d’éthique, culturel et sociaux en toute indépendance et responsabilité, exerçant une sorte d’autorité intellectuelle dont la société a besoin pour l’aider à réfléchir, comprendre et agir. c) ) Jouir sans restriction de leur liberté académique et de leur autonomie, comme un ensemble de droits et de devoirs, tout en se montrant responsable rendant compte à la société. Qu’entend-t-on par Ethique et Déontologie? Nous verrons leur définition dans le cous suivant (Concepts). 2-CONCEPTS Les concepts de l’éthique est de la déontologie sont : 2-1 Morale La morale (latin : moralis) a) Ensemble des règles de conduite, considérés comme bonne de façon absolue en découlant d’une certaine conception de la vie (culturel- histoire- traditions- éducation, religion). 17  University of Science and Technology of Oran Mohamed BOUDIAF. L2. b) Science du bien et du mal, théorie des comportements humains, en tant qu’ils sont régis par des principes éthiques. c) Enseignement qui se dégage de quelque chose, conduite que l’évènement ou le récit invite à tenir : la morale de l’histoire (moralité de l’histoire ou fable) 2-2 éthique L’éthique (grec: ithiki, latin : ethica : morale) a) Partie de la philosophie qui envisage le fondement de la morale et les valeurs qui guident le comportement humain b) Ensemble de questions de ce qui est considéré comme bien et juste des principes moraux qui sont à la base de la conduite de quelqu’un En général, l'éthique explore les concepts de moralité, de responsabilité, de vertu et de justice. 2-3 Déontologie La déontologie (anglais deontology : grec : deon : devoir -ontos : ce qu’il faut faire et -logie) : ensemble des devoirs qu’impose à des professionnels l’exercice de leur métier. La conduite de ceux qui l’exercent, les rapports entre ceux -ci et leurs clients et le public. 2-4 Droit Le droit (du latin : directus : en ligne droite) est l’ensemble des règles qui régissent les membres d’une même communauté, société. Le droit est la science qui a pour objet l’étude de ces règles. 2-5 Valeurs professionnelles Les valeurs professionnelles sont des comportements que l’individu doit adopter au sein de son lieu de travail. La Pédagogie (grec: pedagogia: education) est l’art d’enseigner, méthodes d’enseigner 3) CHARTE D’ETHIQUE ET DE LA DEONTOLOGIE UNIVERSITAIRE La charte de 2023 actualise celle de 2010 publiée par le conseil d’éthique et de déontologie universitaire du ministère de l’enseignement supérieure et de la recherche scientifique. La charte s’applique à la communauté universitaire, publique et privée et à l’ensemble de ses acteurs. Les différentes parties de la charte sont : - FONDEMENTS ETHIQUES - REGLES DEONTOLOGIQUES - FAUTES ET SANCTIONS - ENGAGEMENTS A) Fondement éthique Conformément aux dispositions de l'amendement constitutionnel de 2020 et du système juridique correspondant au principe de transparence, de prévention et de lutte contre la corruption, l'université doit s’engager dans cette démarche, à travers ses multiples missions (enseignement, recherche, service communautaire, prestation de services et d'expertise) identifier et respecter ses valeurs morales fondamentales que l'ensemble de la communauté universitaire doit mette en œuvre et défendre. B) Règles déontologiques Les règles déontologiques concernent 1- Droits et Devoirs des Personnels Enseignants-Chercheurs et chercheurs permanents des Secteurs 2- Droits et devoirs des personnels administratifs, techniciens et agents des services 3- Les Droits et Devoirs de l’Étudiant B1) Les Droits et Devoirs de l’Étudiant - L’étudiant doit disposer de toutes les conditions possibles pour évoluer harmonieusement au sein des établissements d’enseignement supérieur. Il a de ce fait des droits qui ne prennent leur sens que s’ils sont accompagnés d’une responsabilité qui se traduit par des devoirs. B1.1) Les Droits L’étudiant a droit : - aux informations concernant la structure d’enseignement supérieur à laquelle il appartient, notamment son règlement intérieur. - à la liberté d’expression et d’opinion dans le respect des règles régissant les institutions universitaires. - au respect et à la dignité de la part des membres de la communauté universitaire. - à la sécurité, à l’hygiène et à la prévention sanitaire nécessaires aussi bien dans les universités que dans les résidences universitaires. - à un enseignement et à un encadrement de qualité fondés sur des méthodes pédagogiques modernes et adaptées. - à une évaluation pédagogique juste, équitable et impartiale. Il a en outre le droit de présenter un recours s’il s’estime lésé dans la correction d’une épreuve. - L’étudiant en post-graduation a droit à une formation à la recherche par la recherche ainsi qu’à des mesures de soutien. 20  University of Science and Technology of Oran Mohamed BOUDIAF. L2. - Les programmes de la formation ainsi que des modules y afférents doivent être communiqués à l’étudiant dès le début de l’année. Les cours doivent lui être accessibles sous forme de syllabus. - La remise des notes accompagnées du corrigé et du barème de l’épreuve ainsi que la consultation de copie doivent être impératives. - L’étudiant a accès à la bibliothèque, au centre de ressources informatiques et à tous les moyens matériels nécessaires à une formation de qualité. - L’étudiant élit ses représentants aux comités pédagogiques sans entrave ni pression. - L’étudiant peut créer, conformément à la législation en vigueur, des associations estudiantines à caractère scientifique, artistique, culturel et sportif. Ces associations ne doivent pas s’immiscer dans la gestion administrative des institutions universitaires en dehors du cadre fixé par la réglementation en vigueur. - L’étudiant, qu’il soit national, étranger ou réfugié, ne doit subir aucune discrimination fondée sur le genre, les convictions religieuses, les opinions politiques, l’appartenance ethnique ou à une minorité, les origines sociales, la maladie et le handicap. De même qu’il ne doit subir aucun type harcèlement (psychologique, moral ou sexuel). B1.2) Les Devoirs de l’Étudiant - L’étudiant est dans l’obligation de fournir des informations exactes et précises lors de son inscription et de s’acquitter de ses obligations administratives envers l’établissement. - L’étudiant doit respecter le règlement intérieur de l’établissement, la réglementation en vigueur et la charte de déontologie et d’éthique. - L’étudiant doit respecter la dignité et l’intégrité des membres de la communauté universitaire. - L’étudiant doit respecter le droit des membres de la communauté universitaire à la libre expression et d’opinion. - L’étudiant doit s’interdire d’entraver le bon fonctionnement de l’établissement, notamment par la fermeture des voies d’accès aux structures d’enseignement et de re cherche. - L’étudiant doit respecter en conséquence le droit de tous les membres de la communauté universitaire d’accéder à l’exercice de leurs activités et fonctions. 21  University of Science and Technology of Oran Mohamed BOUDIAF. L2. - L’étudiant doit porter une tenue vestimentaire digne de son statut d’étudiant. - L’étudiant doit faire preuve de civisme dans et en dehors de l’enceinte universitaire. - L’étudiant doit préserver les locaux et les matériels mis à sa disposition et respecter les règles de sécurité et d’hygiène dans tout l’établissement. - L’étudiant doit respecter les résultats des jurys de délibération qui sont souverains. - L’étudiant s’interdit de recourir à la fraude et au plagiat. Les sanctions qu’il en court, prévues par la réglementation en vigueur et le règlement intérieur de l’établissement, sont du ressort du conseil de discipline et peuvent aller jusqu’à l’exclusion définitive de l’établissement. C Fautes et sanctions Les sanctions prévues dans cette charte relèvent davantage du non-respect des règles déontologiques que de la violation des principes de l’éthique. Trois (3) types de sanctions sont envisageables : 1- Pédagogiques, 2- Administratives 3- Pénales C1) Étudiants 3.3.1- S’agissant des étudiants, les infractions et les sanctions ainsi que la procédure disciplinaire sont consacrées par l’arrêté du Ministre de l’Enseignement Supé rieur et de la Recherche Scientifique N° 371 du 11 juin 2014, publié au Bulletin Officiel du MESRS, année 2014, 2ème trimestre, portant « création, composition et fonctionnement des conseils de discipline au sein des établissements de l’enseignement supérieur ». 3.3.2- S’agissant particulièrement des doctorants, la charte de la thèse annexée à l’arrêté du Ministre de l’Enseignement Supérieur et de la Recherche Scientifique N° 961 du 02 décembre 2020 « fixant les modalités d’organisation de la formation de 3ème cycle et les conditions de préparation et de soutenance de la thèse de doctorat », édicte au titre des obligations du doctorant, l’engagement à respecter les règles d’éthique et de déontologie. Cette charte précise en outre, les responsabilités respectives du directeur de thèse, du directeur du laboratoire et du responsable du Comité de Formation Doctorale (CFD). 22  University of Science and Technology of Oran Mohamed BOUDIAF. L2. 3.3.3- Sans préjudice de la qualification pénale et conformément à l’article 13 de l’arrêté du Ministre de l’Enseignement Supérieur et de la Recherche Scientifique N° 371 du 11 juin 2014, sont constitutives de fautes du 2ème degré : ou le harcèlement psychologique (moral) ou sexuel, ou le comportement sexiste, ou les manifestations de racisme et les discriminations à l’égard des migrants ou fondées sur l’identité de genre, les convictions religieuses, les opinions politiques, l’appartenance ethnique ou à une minorité, les origines sociales, la maladie et le handicap ; ou le discours de haine se rapportant à toutes formes d'expression qui propagent, incitent, encouragent ou justifient la discrimination, ou ceux qui expriment le mépris, l'humiliation, l'hostilité, la détestation ou la violence. 3.3.4- Le dispositif pénal a été complété et enrichi par deux importantes lois publiées au journal officiel n°25 du 29 avril 2020. La loi n°20-05 du 28 avril 2020 relative à la prévention et à la lutte contre la discrimination et le discours de haine. En vue de la moralisation de la vie publique, de la diffusion de la culture de la tolérance et du dialogue ainsi que de l'éradication de la violence dans la société, cette loi définit notamment, et pour la première fois, le discours de haine ainsi que la discrimination comme suit : *Discours de haine : toutes formes d'expression qui propagent, encouragent ou justifient la discrimination ainsi que celles qui expriment le mépris, l'humiliation, l'hostilité, la détestation ou la violence envers une personne ou un groupe de personnes, en raison de leur sexe, race, couleur, ascendance, origine nationale ou ethnique, langue, appartenance géographique, handicap ou état de santé. *Discrimination : toute distinction, exclusion, restriction ou préférence fondée sur le sexe, la race, la couleur, l'ascendance, l'origine nationale ou ethnique, la langue, l'appartenance géographique, le handicap ou l'état de santé, qui a pour but ou pour effet d'entraver ou de compromettre la reconnaissance, la jouissance ou l'exercice, dans des conditions d'égalité, des droits de l'homme et des libertés fondamentales dans les domaines politique, économique, social et culturel ou dans tout autre domaine de la vie publique. Discours de haine et discrimination sont ainsi constitutifs d'infractions pénales d'une particulière gravité. Pénal. La loi n°20-06 du 28 avril 2020 modifiant et complétant le code Cette loi a introduit un nouveau chapitre intitulé "de l'atteinte à l'intégrité des examens et concours" composé des articles suivants 253 bis 6 à 253 bis 12. Eu égard à l’extrême importance de ce nouveau dispositif qui doit être connu de tous les membres de la communauté universitaire, le comité national d'éthique et de déontologie universitaires a estimé judicieux de le reproduire ci-après, afin que nul n'ignore ou que nul n'oublie : 23  University of Science and Technology of Oran Mohamed BOUDIAF. L2. *article 253 bis 6 : Est passible de l'emprisonnement d'un (1) an à trois (3) ans et d'une amende de 100.000 à 300.000 DA, quiconque diffuse ou divulgue, avant ou pendant les examens et les concours, les questions et/ou corrigés des sujets d'examens finaux d'enseignements primaire, moyen ou secondaire ou des concours de l'enseignement supérieur ou de la formation et de l'enseignement professionnels ainsi que des concours professionnels nationaux. Est passible des mêmes peines, quiconque se substitue au candidat lors des examens et concours cités à l'alinéa 1er du présent article. *article 253 bis 7 : La peine est l'emprisonnement de cinq (5) ans à dix (10) ans et l'amende de 500.000 à 1 000.000 DA, si les actes mentionnés à l'article 253 bis 6 sont commis par :-les personnes chargées de préparer, d'organiser, d'encadrer ou de superviser les examens et concours ;- un groupe de personnes ;- l'utilisation d'un système de traitement automatisé des données ;- l'utilisation des moyens de communication à distance. *article 253 bis 8 : La peine est la réclusion criminelle à temps de sept (7) à quinze (15) ans et l'amende de 700.000 à 1 500 000DA, si la commission des actes mentionnés à l’article 253 bis 6 a pour conséquence l'annulation totale ou partielle de l'examen ou du concours. *article 253 bis 9 : La tentative des délits prévus par le présent chapitre est punie des mêmes peines prévues pour l'infraction consommée. *article 253 bis 10 : En cas de condamnation pour les infractions prévues au présent chapitre, l'auteur peut être puni de l'interdiction d'un ou plus des droits prévus à l'article 9 bis 1 du présent code (NB : cet article 9 bis 1 évoque en son paragraphe 4, la privation du droit d'enseigner, de diriger une école ou d’être employé dans un établissement d'enseignement à titre de professeur, maître ou surveillant). *article 253 bis 11 : Sans préjudice des droits des tiers de bonne foi, il est procédé à la confiscation des instruments, programmes et moyens utilisés dans la commission des infractions prévues par le présent chapitre, ainsi que les fonds en résultant et à la fermeture du site ou du compte électronique utilisé dans la commission de l'infraction ou à l'interdiction de l'accès à ce site et à la fermeture des locaux et lieux d'exploitation dans le cas où le propriétaire a eu connaissance de l'infraction. *article 253 bis 12 : La personne morale qui commet l'une des infractions prévues par le présent chapitre, est punie conformément aux dispositions du présent code. a) Engagements 24  University of Science and Technology of Oran Mohamed BOUDIAF. La charte d’éthique et de déontologie universitaire doit être lu par chaque membre de la communauté universitaire et signer l’engagement du respect de la charte a) Modèle N°1 spécifique aux personnels responsable, enseignant-chercheur, ATS b) Modèle N°2 spécifique aux étudiants 4- APPLICATIONS Les travaux des commissions des conférences régionales universitaires (Travaux CRU 2020 sont publiés dans un document intitulé « lu et aprouvé.dz » sous différentes formas (application Android, Diaporama, format PDF, sur web). Ce document et un outil de référence permettent aux étudiants et enseignants de s’informer des règles et applications de conduite à tenir en vue de réhabiliter les comportements éthiques et déontologiques en milieu universitaire. Le contenu des Travaux CRU concerne les membres étudiants et enseignants-chercheurs. 4-1 Enseignement : cours, évaluation des connaissances et comportement Des applications qui concernent sur les cours, l’évaluation des connaissance et comportement destinés à la catégorie de personnel : étudiant (e) et la catégorie de personnel : enseignant (e)  Pour la catégorie étudiant de licence 1er cycle LMD - formation LMD à l’université - Premier cycle de licence - Second cycle de Master - Troisième cycle de Doctorat - concernant l’accès et environnement (première inscription, prestation de service,) - Discipline générales (présence obligatoire à toutes les activités pédagogiques - absences aux TD, aux TP, …) - Evaluation et calcul des moyennes (présence obligatoire aux examens- droit à l’examen de remplacement si l’absence est justifiée- le calcul de la moyenne d’une unité se fait à partir des calculs des moyennes de chaque matière de l’unité avec le coefficient) - Délibération et acquisition (évaluation au terme de chaque semestre et de chaque année par un jury de délibération. - Progression et réorientation (passage de la 2ème à la 3ème année si le total de crédit est de 120 dans les 4 semestres du parcours) 25  University of Science and Technology of Oran Mohamed BOUDIAF. L2. - Attestation et diplôme (retrait du diplôme de licence.) 4-2 Recherche scientifique : méthodologie de recherche, plagiat, droit d’auteur, écriture scientifique L’étudiant du 3ème cycle après avoir réussi au concours a droit - A l’inscriptions, droit aux prestations de service. - Il intègre une équipe de recherche dans un laboratoire pour effectuer ses travaux de recherche - Il adopte une discipline (présence obligatoire, respect des autres…) - Participation aux manifestations scientifiques nationales et internationales - Elaboration d’un travail de thèse de recherche original, dirigé par le directeur de thèse. - Rédaction du mémoire de thèse (étude bibliographique- Problématique-plan de travail- résultats attendus- discussion –conclusion-références bibliographiques) - Rédaction de publication nationale ou internationale dans des revues de catégorie A ou B - Tout acte de plagiat, falsification des résultats ou fraude avec les travaux scientifiques contenus dans la thèse, dûment constaté pendant ou après la soutenance et confirmé par les organes scientifiques habilités, expose à l'annulation de la soutenance et au retrait du titre acquis.
