THE CONSTITUTION OF NU DELTA FRATERNITY UPDATED 12 MAY 2024 Preamble: The mission of Nu Delta Fraternity is to continually promote and strengthen our bond of Brotherhood, inspire a sense of pride in our House and its accomplishments, and instill honor and integrity in our new members as we collectively strive to attain academic excellence. In accomplishing these goals, we are committed to maintaining contact with the Alumni who have dedicated themselves to our fraternal order before us. Article I - Identity Section 1: The name of this fraternal organization shall be "Nu Delta Fraternity, Incorporated." Article II - Membership Section 1: A Brother is a duly initiated person. To be considered an Active Brother, one must be in compliance with all of the following: Enrolled as an undergraduate student of the Massachusetts Institute of Technology or have been so enrolled in the previous academic semester. In good financial standing with the House or have created a plan to achieve good financial standing that is both in compliance with the Nu Delta Housing Contract and approved by the Internal Revenue Committee. Section 2: Anyone enrolled as a student of the Massachusetts Institute of Technology may be given a bid to join Nu Delta Fraternity as a Pledge if at least 3/4 of the Active Brothers present vote in favor of this being done.. Section 3: After the completion of a Pledge training period, the duration of which is to be determined each year by the Active Brothers, a Pledge may be initiated into the Brotherhood of Nu Delta Fraternity if at least 3/4 of the Active Brothers vote in favor of this being done and that they are not a member of any other fraternity, excepting service and honorary fraternities. Once initiated, the status of Pledge is dropped in favor of Brother. Section 4: No person other than a properly qualified Pledge may be initiated into the Brotherhood of Nu Delta Fraternity. Section 5: Active Members consist of Brothers and Pledges. Active Brothers do not include Pledges. Section 6: Any Brother who fails to abide by this Constitution and its by-laws may be censured by a majority vote of the Active Brothers, or suspended by a 2/3 vote of the Active Brothers. In the case of suspension a period of suspension shall be set, not to exceed one month. During this period of time, the suspended Brother may attend meetings of the Active Members, but they may not participate. Section 7: If a serious offense is committed by a Brother, they may be expelled from the Fraternity by a 3/4 vote of the Active Brothers. Section 8: Once a Brother has been a Member of the House for four academic years or they have finished their undergraduate degree, they shall lose all statuses and titles. However, they may be granted the status of Brother Alumnus by a majority vote of the Active Brothers present. This shall be done during a special meeting which shall occur after four academic years have passed since the Brother entered the folds of the House. Article III - Officers Section 1: An Executive Committee of officers consisting of, in order of rank from highest to lowest, the President, Vice President, Pledge Trainer, Treasurer, House Manager, Maintenance Chair, Steward, Rush Chair, Social Chair, and Brotherhood Chair shall exist for the purpose of making routine decisions and formulating policy proposals for the Fraternity. Section 2: Officers shall hold office for a term of one year. The offices of President and of Pledge Trainer may not be held by the same person for two consecutive terms. If, for some reason, the President or the Pledge Trainer has to relinquish their office mid-term, the person who replaces them is only eligible to run for reelection of their newly gained position if they have held it for less than half the length of one term. Section 3: Only one person shall be elected to hold any given Executive Committee office, unless the brotherhood count is too limited to do so. Section 4: A Brother may hold only one Executive Committee position at a time, unless the brotherhood count is too limited to do so. Section 5: Only Active Brothers are eligible to hold an Executive Committee position. Section 6: Election Proceedings a) The election of the Executive Committee officers shall be held starting the second week of the second semester of the academic year, or two weeks following the initiation of the Pledge class, whichever comes later. b) The election for offices will be held in order of rank, from highest to lowest. c) Nominations for each office shall be opened at least seven days prior to the election of that office. d) For an election to take place, a quorum of 2/3 of the Active Brothers must be present. e) After the nominations have been closed for any seat on the Executive Committee, all Brothers nominated shall leave the room. f) Nominees shall appear singly before the Brotherhood in the reverse order in which they were nominated. g) Nominees shall be allowed to speak for no longer than five minutes. Nominees may answer questions, but no answer may exceed two minutes, and the question period itself may not exceed ten minutes h) When all nominees have spoken and answered questions, the Brotherhood shall discuss their various qualifications. Nominees shall not be present at this discussion. i) When the discussion is terminated, a vote will be taken by secret ballot. Only Active Brothers who are present for the proceedings are eligible to cast a vote. j) The votes will be tallied in an isolated room by the current President and a representative of each class (who will be chosen amongst their class) the President is not a part of. Once the votes have been tallied and a decision has been made, the Brothers who tallied the votes are to never discuss the specifics of the results again. k) In the event of a tie between nominees, the decision shall be made by random chance. From a normal deck of playing cards, the current President shall choose a card for each nominee and the nominee with the higher card wins. The suits of the cards are insignificant and if two cards of the same value are drawn, the President shall simply redraw a card for each nominee. l) For a nominee to win an election, they must earn a number of votes which is greater than half of the number of Active Brothers. If no nominee receives enough votes to meet this qualification, the Brotherhood will be polled again. The nominee receiving the fewest number of votes in one poll will be excluded from consideration in further polls. The Brotherhood will be polled until an officer is elected or all the nominees are excluded. m) If there is only one nominee for an office, a motion can be made to white ballot this person, meaning that this person will win the office immediately. For the motion to pass, all people who are present and are eligible to vote must vote in favor. If this does not occur, then the nominee must undergo the regular procedure. If they does not earn a majority vote by secret ballot, then that office is to remain empty and it shall follow as if there were no nominees for that office. n) If there are no nominees for an office, or if all nominees are excluded, the newly elected Executive Committee will appoint a temporary officer after the conclusion of the election process. The existence of a temporary officer will not impede the election of a permanent officer. o) In the event of a vacancy of office, a special election shall be held as soon as possible. This special election shall be carried out as detailed in Article III, Section 6, b-n. Section 7: An election shall also be held to elect Rush Chair(s). Although they are elected, they are not to be members of the Executive Committee. They are elected through a plurality vote of the Active Brothers present for the election. The election of the Rush Chair shall take place after the elections of all Executive Committee members have taken place. Section 8: Duties of Officers All Executive Committee members are responsible for ensuring that all business conducted under their office is done in a manner that is in accordance with the policies set forth by the Fraternity and Interfraternity Council of the Massachusetts Institute of Technology. a) The President shall act as the official representative of all members in all external affairs, shall be empowered to call meetings of the Active Members and of the Executive Committee and shall preside over these meetings. b) The Vice President shall be prepared to assume the role of President in the President's absence, serve as secretary and parliamentarian at meetings and preside over all committees excepting the Executive Committee. They shall also act as the official Risk Manager of the Fraternity, ensuring that all House activities are conducted safely and in a way that abides by all necessary rules and regulations. c) The Pledge Trainer shall be responsible for proposing and implementing a program designed to familiarize the Pledges with all aspects of the Fraternity. d) The Treasurer shall be responsible for the collection and disbursement of all corporate funds, the keeping of accurate financial records, presenting a budget to the Brotherhood at the beginning of each semester and the setting of the House bill at a level commensurate with the Fraternity's obligations. e) The House Manager shall be responsible for the physical maintenance of the House, for the update and maintenance of the dormitory license and ensuring the House meets all codes set forth by the City of Boston. f) The Maintenance Chair shall be responsible for assigning weekly house cleanups to Active Brothers and Pledges, along with making sure the house has the necessary cleaning supplies. g) The Steward shall be responsible for the management of the Fraternity food service and for dealings with the Fraternity food service employees. h) The Social Chair shall be responsible for the planning of Fraternity social functions, for keeping Active Brothers informed about social events outside of the House and for the coordination with the House Manager in organizing the Brotherhood to perform both setup and cleanup duties for any social event. The Social Chair will be the head of the Social Committee, members of which they will select and appoint, to their discretion. i) The Brotherhood Chairshall be responsible for Fraternity Alumni relations. This shall be done through the distribution of Alumni Bulletins to all of the Alumni and the organization of an annual Alumni Reunion. They are also responsible for working with the Social Chair to have engaging social events with our close community. j) The Rush Chair shall be responsible for the planning and execution of Rush and all other prospective new member recruitment endeavors. Section 9: The Executive Committee shall be empowered to appoint other officers and create or dissolve committees. Section 10: The Executive Committee shall appoint Active Brothers to the following offices within two weeks of the conclusion of the main election ceremony: Work Week Chair, Webmaster, Athletic Chair, Academic Chair, Careers Chair, and Chaplain. The people appointed to these positions shall be in charge of their respective areas of the House and be in charge of notifying the Brotherhood of all pertinent information regarding their office. Section 11: There shall also be an Assassin. The Assassin holds their position for as long as they are a Brother. When the current Assassin is about to lose their Brother status, they are to appoint another person from the freshman class to replace them. The person who is appointed will carry out this position with the same terms their predecessor did. Section 12: All decisions of the Executive Committee shall be made by a majority vote of the Committee and may be overruled by a majority vote of the Active Brothers. If the Executive Committee makes a decision, they must give a summary of what transpired in their meeting to the Active Brothers before the general discussion takes place. Section 13: An officer may be removed from office according to the following procedure. a) A motion to recall the officer must be introduced at a meeting of the Active Members; b) After at least one week has passed, the vote may take place. The officer will be removed if 2/3 of the Active Brothers vote in favor of their removal. Section 14: All members of the Executive Committee must live in the House during the academic year unless: The Brother in question notifies the Brotherhood that they intend to live in an annex prior to being voted on and is still elected. The House is over capacity and the Brother that is elected to move out already holds an Executive Committee position. Article IV - Meetings Section 1: Regular meetings shall be held once each week of the academic year. Special meetings may be called by the highest-ranking officer present or by petition of a majority of the Active Brothers. Notice of a meeting must be given at least twenty-four hours before the meeting is scheduled to start. Section 2: Meeting Procedure a) The order of business for a regular meeting shall be the following: called to order by the presiding officer, roll call, officers’ reports, old business, dialogue, new business, good of the order and adjournment. In the case of a pressing situation, the presiding officer will determine any change to the order of business. b) The presiding officer of any meeting shall be the highest ranking officer present. c) A quorum of 2/3 of the Active Brothers must be present at a meeting in order to transact business. d) Any members of the Fraternity are allowed to attend any given meeting, but only Active Brothers are allowed to transact business in the meeting. e) Every Active Brother with the exception of the presiding officer shall be entitled to a single vote on all questions for which a vote is taken. The presiding officer may vote only when their vote alters the outcome or in the event of a secret ballot. f) A meeting is considered adjourned only after being killed by the Assassin by order of the presiding officer. g) Dialogue will be a space for brothers to bring up any issues they deem necessary to a special space of open communication and respect. Section 3: The presiding officer at a meeting is responsible for the interpretation of the Constitution and the Standing Rules. Section 4: The discussion of Pledges and Pledge matters shall not be recorded in the minutes of the Brotherhood meetings. Section 5: Alumni may attend meetings of the Active Brothers but may neither introduce, second, nor vote on any motion. Pledges may neither introduce, second, nor vote on any motion proposed by an Active Brother. All Pledge Training decisions that are made during meetings are to be decided by the Pledge Trainer themself. If the Pledge Trainer is not present, the presiding officer will take over their place and make all necessary decisions. Section 6: Active brothers must let the presiding officer know if they intend on missing a meeting before the call to order by the presiding officer. Otherwise the Active Brother will be given an unexcused absence. Every Active Brother will be allowed one unexcused absence to a regular brotherhood meeting per one semester. Every one unexcused absence thereafter will result in one punt. Additionally, any Active Brother will be punted for their third and any following consecutive excused absence. ARTICLE V - Finances Section 1: The collection of House bills shall be enforced through the rules outlined in the Nu Delta Housing Contract. Every Brother living in the House must sign the Resident Nu Delta Housing Contract every year they are a Brother. This must be done by a date which will be set every semester by the President. If a Brother does not sign the contract or does not give a valid reason for not signing it by the deadline set, that Brother will become an Inactive Member of the Fraternity until they do so. Section 2: An Internal Revenue Committee composed of the President, Vice President and Treasurer shall exist to enforce this procedure. Section 3: If any of the officers of the Internal Revenue Committee are in bad financial standing, they will immediately be replaced by the officer of next highest rank who is in good financial standing. Section 4: Fines A fine of $100 per day will be enforced for missing Work Week unless the Work Week Chair, House Manager and Brother in violation create a plan of recourse consisting of extra cleanups, dinner points, or projects. This plan shall be brought before the Brotherhood and it must be approved by a 3/4 vote of the Active Brothers. A Brother can be excused for one or more days of Work Week if they present their reasons to the Brotherhood and a 3/4 vote of the Active Brothers support the said Brother being excused. ARTICLE VI - Risk Management Policy Section 1: Everything done by the House must be in accordance with the rules stated in the Risk Management Policy of Nu Delta Fraternity. ARTICLE VII - Standing Rules Section 1: Any motion, which is designed to be in effect for more than one academic semester, shall be moved as a Standing Rule. Section 2: A Standing Rule requires a 2/3 vote of the Active Brothers to be enacted. A Standing Rule may be repealed by a 2/3 vote of the Active Brothers unless more than six days notice is given, in which case it may be repealed by a majority vote of the Active Brothers. Section 3: A Standing Rule cannot be in conflict with any part of the Constitution unless 3/4 of the Active Brothers approve of its existence. ARTICLE VIII - Miscellaneous Section 1: This Constitution may be amended by a 3/4 vote of the Active Brothers. All amendments must be announced and posted at least one week before they are considered. Section 2: So long as quorum is attained, whenever a vote takes place, only the Active Brothers present at that time are counted towards the number which determines how many votes are needed to pass legislation. Section 3: The spirit, rather than the technical wording of this Constitution, shall take the higher precedence. STANDING RULES OF NU DELTA FRATERNITY UPDATED 21 APRIL 2013 GENERAL A failure to comply with these Standing Rules shall be dealt with by the Executive Committee. MEMBERSHIPS 1. No non-member of Nu Delta is allowed on the premises without the consent of some member. 2. Keys to the front door, back door, and bike shed will be given free of charge to Active Brothers and Pledges of Nu Delta. Keys may be given to Alumni upon request. ACTIVE/INACTIVE POLICY 1. All Brothers must sign a Brotherhood Contract to be considered a Brother, which includes the following details: 2. All Brothers are initially considered Active. 3. All Active Brothers are required to complete a Brotherhood Contribution, which include dinner points determined by the Steward, party duties determined by Social Chairs, and cleanups determined by the House Manager. In addition, beginning their Sophomore fall, Active Brothers are required to provide a $500 contribution. 4. Brothers who live in the house will pay a Resident Contribution in addition to their Brotherhood Contribution. The Resident Contribution will be determined by the Treasurer. 5. To be considered an Inactive Brother, a Brother must petition to EC with valid reasoning as to why they will be unable to contribute to the House or use House resources. If EC votes with a majority to approve the Brother’s petition, they will be considered an Inactive Brother. This petition must be redone every semester to maintain Inactive status. EC also retains the right to revoke a Brother’s Inactive status as they see fit with a majority vote. 6. Inactive brothers are not responsible for any of the Brotherhood Contribution described in point 3 and are not allowed to vote. 7. An Active Brother will lose their voting rights for missing three meetings in a row, but will not be considered Inactive. To regain voting rights, said Brother must attend at least one meeting before being allowed to vote. 8. A brother cannot be Inactive for two semesters in a row. 9. All Inactive brothers must pay an Inactivity contribution of $250 if they’re still a full-time student. PHYSICAL HOUSE STRUCTURE 1) The following concerns alterations and improvements: a) Major structural alterations of the House must be approved by the Executive Committee. b) Minor improvements not involving structural changes to the loft or to the room are to be approved by the House Manager. c) Failure of a Brother to seek prior approval will result in no reimbursement of repair/improvement costs. 2) The House will pay for one half the cost of all permanent, non-structural items: a) With Executive Committee approval if the permanent, non-structural item costs less than $500. b) With Brotherhood approval if the furniture costs more than $500. LIFESTYLES 1) Quiet hours shall be enforced from 12:00 a.m. to 8:00 a.m. every school day. 2) No one shall be in the dining room during the setup of meals except for the servers. ENFORCEMENT OF DUTIES House duties shall be enforced by The Duty Enforcement System of Nu Delta Fraternity. VOTING ON HOUSE BUSINESS For a vote regarding house business (not a standing rule, risk management, or constitutional change) the following rules will apply: Quorum is required in both cases. In the case of no default procedure: If there are multiple options being voted upon, an option is eliminated in each round of voting until only two (2) options remain. Afterwards, plurality (excluding abstainers) will be used to decide the business. In the case of a default procedure: If there are multiple options being voted upon, an option is eliminated in each round of voting until only one (1) option remains (excluding the default). Afterwards, majority of quorum is required to overturn the default option. BROTHER INPUT INTO EXPENDITURES Up to 25% of the Social Chair budget may be used by an individual or coalition of Brothers for full House events where every Brother and their respective guests are invited. The amount of money given from the Social Chair budget will match whatever is collected from the Brothers who are in charge of hosting one of these events. The event must be approved by 50% of Active Brothers, but it does not have to be voted on in a meeting. A maximum of 10% of the Social Chair budget may be used a single event of this type. The President and Vice President must approve all of these events and the event must be carried out in a fashion which abides by the rules outlined in Article VI. The Social Chairs are not required to have 25% of their budget available for this reason. If the events that are included in the Social Chairs' Social Calendar require an amount of funds that leave less than 25% of their budget available for this use, only the amount of money left over may be used for this cause. Any House expenditure (Items, Events, Trips, etc.) over $1000 must be approved by 50% of the Active Brothers. The individual making the purchase is allowed to decide on the voting method, which must be approved by the Treasurer and the President. AWARDS Brother of the Year (Possemato Award) - December 3, 2000: The Brother of the Year award was named after and first given to Rich Possemato '01 by their Brothers for their performance as House Manager. The award may be given to one Brother each year for outstanding and unfailing commitment to the Brotherhood of Nu Delta. The recipient of the award is to receive a plaque with the following inscription: FOR OUTSTANDING AND UNFAILING COMMITMENT TO THE BROTHERHOOD OF NU DELTA, WE PRESENT THE NTH ANNUAL POSSEMATO AWARD OF EXCELLENCE TO OUR ESTEEMED BROTHER NAME OF BROTHER YEAR a) For a Brother to be selected for consideration for the award, at least three Brothers must nominate them by secret ballot during the last House meeting of the Spring Semester. b) Although there is no regulation preventing them from doing so, members of the Brotherhood are asked not to vote for themselves. c) There may not be more than four nominees. If there are more than four Brothers receiving three votes, then the four Brothers with the highest vote totals will be the ones who are considered nominated. In the event of a multi-way tie for the final remaining spot(s), all tied Brothers will be nominated, even if the total number of nominees exceeds four. d) The Brother(s) that are nominated must leave the room while a discussion of the merits of each individual takes place. e) When the discussion is over, another vote by secret ballot will be held. This time, the person who receives the most votes will be revealed to all those present for the discussion. f) A final discussion for this nominee will take place. Once this discussion is over, one last vote by secret ballot will take place. g) In order for the Brother to win the award, they must be approved by a unanimous vote with no more than 1/3 of the Active Brothers absent and/or abstaining. h) If all of the above criteria are not met, then there will be no award given that year. i) No Brother shall receive the award more than once. BROTHER ACCOUNTABILITY POLICY In the case a brother damages any property owned or rented by the house they are responsible for fully paying for said damages. If the brother damages property owned by the house they are also responsible to get it repaired in a timely fashion. Every week the brother doesn’t make considerable progress on the repair they will be given a punt as determined by EC. The cost of the damages and punts will be added onto the balance of the brother and if they do not pay their registration for the next semester can be held. DIRTY ROOM FINE POLICY All rooms occupied by brothers must be clean 24 hours before new occupants move into the room. Whether a room is clean or not will be determined by the (house manager/someone). If the room is not certified as being clean by the (house manager/someone)’s standards, every prior occupant of the room will be fined $200. If a brother who was not a prior occupant of the room cleans the room, their house bill or current balance will be discounted by $50. In the case that no brother cleans up the room and the boarder complains to the leader of the house (president or summer president) their house bill will be discounted $100. Any brother living in the house during their final semester will be required to pay a deposit of $200 because they’re registration can no longer be held. The $200 deposit will be returned if they leave their room clean for the next occupant(s). If a brother feels that they were unfairly fined, they can petition to EC to have the fine lifted. A majority of EC must vote to lift the fine. A member of EC cannot vote to lift the fine for themself. HOUSING CANCELLATION POLICY Once the housing doc has been decided a contract will be given to all the brothers who plan on living in the house the following academic year. A brother must sign the contract in order to guarantee their spot in the house. If the contract is not returned within a week/some time period, any brother may claim their spot. If a brother signs the contract but doesn’t move into the house the following fall semester they will be fined $100. If the brother feels that they were unfairly fined, they can petition to EC to have the fine lifted. A majority of EC must vote to lift the fine. A member of EC cannot vote to lift the fine for themself. THE RISK MANAGEMENT POLICY OF NU DELTA FRATERNITY V5 - UPDATED 5 APRIL 2009 Section 1 - General Rules This section lays out rules that apply to all events, public or private, house-sponsored or independent. The President, Risk Manager, and Residential Advisor have the authority to shut down any event, large or small, public or private, based on risk considerations to preserve the status of the house. Either we do it, or the cops do it. The President and the Risk Manager reserve the right to approve an event outside of the realm of the following guidelines, given appropriate risk considerations. No alcohol on the 1st Floor. Kegs are prohibited on house property. Hard alcohol may not be served at open or closed parties. Do not leave open sources of alcohol around an event. Properly dispose of alcoholic containers. Any items present during an event, whether used or not, are accounted for in the risk considerations of the event (i.e. empty beer cans remaining from the night before insinuate drinking, even at a party where no alcohol is present). Take every step to avoid unwanted attention (noise complaints, police intervention, etc.) Keep windows closed, and noise to a reasonable level. Never use the roofdeck for an event that is not explicitly approved by the President and Risk Manager. Find the President and Risk Manager if you anticipate a situation with any risk involved. Section 2 - Events in Public Rooms Our events in public rooms are organized into four categories, each corresponding to the number of guests in attendance, Guest-to-Brother Ratio, and areas of use. They are, in order of increasing size, Small Events, Pubnights, Closed Parties, and Open Parties. Registered = Party Registration form submitted to the IFC by 5pm the Wednesday prior to event (Weekend Events). Max G:B = Maximum Guest-to-Brother Ratio Small Event Guests Attending: 5-15 Brothers Attending: Few Areas: Chapter Room Private event. Not registered. ○ If 5 to 15 Guests are in attendance, the person(s) organizing the event must submit a request to the President and the Risk Manager at least 2 days prior to event and garner approval. ○ The President and Risk Manager have the right to deny the event due to risk considerations. ○ If submitted less than 2 days prior to the event, the President and Risk Manager have the right to deny the event due to heightened risk considerations. ○ This event must not conflict with a house-sponsored activity. Alcohol may or may not be present. Protocol ○ One or two Brothers in attendance will be designated as "holder(s)" of the event. Said person(s) will be responsible for any actions that transpire over the entire course of the event. ○ Keep music down to a reasonable level - especially the bass (which reverberates through the walls). Put couch cushions behind speakers if used. ○ Keep windows closed at all times. ○ Duties are assigned at the discretion of the President and Risk Manager. Pubnight Guests Attending: 15-30 Brothers Attending: Most Areas: Chapter Room House event. Must be registered. Alcohol may or may not be present. Ratio of Guests to Brothers may not exceed 2:1 - duties are based on this assumption. Protocol ○ Keep music down to a reasonable level - especially the bass (which reverberates through the walls). Put couch cushions behind speakers if used. ○ Keep windows closed at all times. ○ Duties assigned at the discretion of the President and Risk Manager. Potential duties include: Door (1), Stairs (1), Bar (1). Make sure that crowds do not form in front of the house, which will bring us unwanted attention. Closed Party Guests Attending: 30-100 Brothers Attending: All Areas: Chapter Room, 2nd Floor Hallway House event. Must be registered. Alcohol may or may not be present. Open Party Guests Attending: 100-200 Brothers Attending: All Areas: Foyer, Chapter Room, 2nd Floor & 3rd Floor Hallways. House event. Must be registered. Alcohol may or may not be present. Put couch cushions behind speakers if used. ○ Check music volume throughout the party, and adjust if necessary. ○ Keep windows closed at all times. ○ Cover all windows on the 1st Floor and Chapter Room. ○ Duties will be assigned by Social Chairs and approved by the President and Risk Manager. ○ Full Duties: Door (2-3) Desk (2) Bar (2-3) Stairs (1) Cup Ranger (1-2) Coat Check (2) Couch (1) DJ (1) Scanner (1) Post-Event Conduct: Events conclude at 1 AM. No public area may be used for an event after this time. If Brothers wish to entertain guests after that time; they may do so in the privacy of their own rooms. Do not allow random guests to remain in the house after 1 AM. Aid your Brothers in bouncing remaining guests. Section 3 - Events in Private Rooms Events in a Brother's private room are not subject to the rules listed in §1. However, the owner(s) of the room will be held responsible for the conduct and actions of the person(s) in attendance. Nevertheless, the President and Risk Manager must be notified of any private event expected to exceed ten persons, Brothers and guests included. This includes events that might include more than ten guests at any point in the night, regardless of whether attendance is sustained over a long period. A few guidelines for private events are suggested below: What happens in your room is your responsibility. Refrain from loud screams or dangerous behavior that could attract attention from bystanders. If a complaint is filed, you will be held responsible, regardless of whether you personally took the risk. You are responsible for your guests. Make sure that your guests' conduct mirrors your own sense of responsibility. You shoulder the responsibility and the risk for the people you invite into the house. Do not play loud music. It is rare that we get a noise complaint from room gatherings, but it has happened. Especially if you plan on continuing into the night, be courteous to our neighbors and keep the volume (and especially the bass) toned down. Keep your windows closed. Opening your windows is a surefire way to attract attention and garner a noise complaint or worse. Be respectful of Brothers' adjacent rooms. If a Brother requests that you turn down your music or shut your door, especially late into the night, please accommodate them. See the President and Risk Manager if you have any concerns. If you are worried that risk will not be or is not being adequately handled in your private event, always consult the President and the Risk Manager for advice. Section 4 - Conduct of Brothers During House Events It is important to maintain sobriety in case the police arrive or other actions need to be taken during the course of an event. Below appear the guidelines for sobriety during specific events: If a Brother is assigned a duty, they must remain sober until they have completed all of their assigned duties. The President, Risk Manager, and Social Chairs must be sober for the duration of all Closed Parties and Open Parties. All of the Executive Committee must remain sober for the full duration of Open Parties. Section 5 - Definition of Duties This section defines the responsibilities of each duty. Door Stands at the entrance of the house, regulating the traffic in and out of the event. Ensures crowds do not form in front of the house by asking loiterers to leave or to go wait somewhere else. Bounces people that should not gain entrance to the house (i.e. obviously intoxicated people). If the cops come: One person keeps the cops outside as long as possible while the other notifies the President and Risk Manager. Desk Sits at a desk just inside the foyer entrance of the house. Keeps record of all guests who enter with a sign-in list. Checks the ID of all guests claiming to be over 21 and distributes bracelets when necessary. Monitors the number of people in the house using two counters and ensures that the house is under capacity at all times. If the cops come: Show them how many people are in the house and stall them so that there is more time for the Chapter Room to clear out. Stairs Stands at the top of the stairs near the entrance of the Chapter Room. Stops people from taking alcohol and cups down to the first floor. If the cops come: Grab and dispose of all cups in the 2nd floor hallway (including those in the hands of guests) and afterwards help clear out the Chapter Room. Bar Must be at least 21 years of age. Stands behind the bar in the Chapter Room. Serves alcohol to those who are permitted. Ensures that guests do not pour their own alcohol. Never serves to overly intoxicated people. If the cops come: Throw all alcohol-related trash away, put the remaining alcohol in the Social Chair Closet, and go around the Chapter Room to remove all traces of alcohol. Cup Ranger Walks around Chapter Room during the event. Disposes of any alcohol-related trash visible. When the bar is running low, retrieves alcohol from the kitchen and brings it to the bar. ○ When doing this, go up the stairs, through the 3 floor hallway door, down the back stairs to the basement, and back to the bar using the same route. Do not attempt to bring alcohol directly through the 1st or 2nd Floors. If the cops come: Work in conjunction with the Brothers on bar to make sure that all evidence of alcohol disappears. Couch Sits in front of the 3rd floor hallway door on a couch or desk chair, blocking access to both the hallway door and the staircase leading to the 4 floor. Allows people past the hallway door or up to the 4th floor only if they are a brother or are accompanied by a brother. ○ If a certain brother or small groups of brothers are taking a large amount of guests past the checkpoint, the Brothers on couch may choose to deny access to some or all of said guests. If the cops come: Move couch or desk chair into the nearest room, force all people in the 3rd floor hallway to remain quiet and in private rooms, and go down the back stairs and remove any impediments from the 2 floor hallway door. Coat Check Stands in the Kitchenette near the entrance to the Dining Room. Takes guests' personal effects and hangs them on the coat check racks (which can be found unassembled in the Boiler Room), writing the number that is on the hanger onto the hand of the owner. Returns said effects in a timely fashion. If the cops come: Remove any impediments from the 1st Floor hallway door and return guests' belongings as quickly as possible, moving the coat check racks back to the basement if the cops remain. DJ Plays music from DJ booth. Ensures the volume of the music is at an appropriate level at all times If the cops come: Immediately turn off the music and aid in calming the situation on the 1st floor Scanner Sits in a room that will remain relatively quiet during the party (preferably on the 4th floor) with the police scanner. Monitor the police activity for signs of our house address. If a call is heard that mentions the cops coming to the house: ○ Hide the police scanner and lock the door of that room. ○ Call one of the Brothers on door and notify them first. ○ Run down and tell every Brother that you see that the cops are on their way and to pass on the message to Brothers on duty so that they can do what their particular duty asks of them in that situation. THE DUTY ENFORCEMENT SYSTEM OF NU DELTA FRATERNITY V4 - UPDATED 12 MAY 2024 Section 1 - Purpose The Brothers of Nu Delta Fraternity are expected to complete all duties assigned to them by the Executive Committee. These duties are assigned so that all house functions are carried out safely and efficiently. The purpose for this document is to ensure that all Brothers of Nu Delta Fraternity contribute equally to the betterment of the house and to the Brotherhood as a whole. Section 2 - Definitions Punt - Refers to the incomplete or otherwise unsatisfactory performance of a cleanup, dinner point, or party duty assigned by an officer of the Executive Committee to another member of Nu Delta Fraternity. Punter - A Brother who has punted a duty. Assigned Brother - The Brother assigned to a particular duty. Assigning Officer - The officer on the Executive Committee that assigned a particular duty. Section 3 - Procedure 1. The Executive Committee will assign and announce duties a minimum of 4 days before the duty must be completed. 2. Assigned Brothers must acknowledge that they were assigned the duty within 48 hours after being assigned. a. If the Assigned Brother is unable to complete the duty before the deadline, they must first notify the Assigning Officer. The Assigned Brother then must find another Brother willing to do it for them. If they do find a volunteer, the volunteering Brother becomes the Assigned Brother for the duty. If not, they will be punted. b. The Executive Committee must send a reminder to acknowledge 24 hours after assigning duties. 3. Each Assigned Brother must notify the Executive Committee upon completion of an assigned duty. a. The Assigning Officer may choose the method/criteria for notification, given that it is fair and consistent across the Brotherhood. 4. The Assigning Officer will then verify that the duty has been satisfactorily fulfilled. If not, the Assigned Brother will be punted. 5. At the following House Meeting, Assigning Officers will notify the rest of the Brotherhood of all punts that have occurred since the last House Meeting. a. At/Before this point, Punters may propose a plan to make up their work to the Assigning Officer. If the plan is deemed acceptable by the Assigning Officer and followed through by the Punter, the Punter will gain credit for completion of the duty and all further discussion about the incident shall cease. b. If the Punter fails to propose a plan, follow through with a proposed plan, or acknowledge an assigned duty, they will have the opportunity to defend themself by speaking on their own behalf or by submitting a written statement. A vote will be held whether to excuse the Punter or not. i. If the Punter is excused, they will not get credit for the duty, but they will not receive a punt. ii. If the Punter is not excused, they will receive a punt. Section 4 - Housing Points Upon joining the fraternity, each brother will start with 0 Housing Points. To gain Housing Points, a Brother may complete one of the following actions: Completion of an assigned duty - 1 Housing Point Completion of 1 Semester as a Brother - 20 Housing Points Completion 1 Semester Living in the House as a Brother - 10 Housing Points Completion of 1 Semester on Exec - 10 Housing Points Housing Points determine the order at which Brothers may choose their rooms (the Brother with the highest number of Housing Points choosing first). In the case of ties, the following tiebreakers are applied in order: 1. Brothers on the Executive Committee choose before Brothers that are not on the Executive Committee 2. Brothers with a higher Executive Rank (Outlined in Article III, Section 1) choose before Brothers with a lower Executive Rank 3. Brothers who’ve lived in the house longer choose before other Brothers 4. Brothers who’ve had Brother status longer choose before other Brothers 5. Brothers who’ve been at MIT longer choose before other Brothers 6. If ties still exist, use the process outlined in Article III, Section 6 (k) Section 5 - Penalty At the end of every semester, the number of punts each Brother has incurred is tallied and they will be penalized according to the following system: 1-2 Punts: No Penalty. These will be considered as warnings. 3 Punt: The Brother will have $10 added to their semester House bill. 4 Punts: The Brother is subject to all of the penalties described above and will have $20 added to their semester House bill. 5 Punts: The Brother is subject to all of the penalties described above, will have $30 added to their semester House bill. 6 Punts: The Brother is subject to all of the penalties described above and will have $40 added to their semester House bill. 7 Punts: The Brother is subject to all of the penalties described above and will have $80 added to their semester House bill. 8 Punts: The Brother is subject to all of the penalties described above and will have $160 added to their semester House bill. 9 Punts: The Brother is subject to all of the penalties described above and will have $320 added to their semester House bill. If a Brother punts more than 9 times, the amount that will be added on to the Brother's semester House bill for their nth punt will be determined from the following equation: n ∑ ($10)(2i−5) i=10 In addition to this, the Brother is still subject to all penalties outlined for punts 1-7.
