CITY OF NAPLES PERSONNEL POLICIES & PROCEDURES MANUAL Section No.: 3-VI SUBJECT: EMPLOYMENT ISSUES: TOBACCO-FREE WORKPLACE Revision Date: 11/1/2010 Effective Date: 06/01/95 POLICY: The City of Naples shall comply with federal and state laws as well as established City and department policies regarding employment practices and procedures. The City of Naples will not discriminate against any person in recruitment, examination, hiring, training, promotion, discipline or any other benefit or condition of employment because of race, color, national origin, age, sex, marital status, or disability. TOBACCO-FREE WORKPLACE The City is dedicated to providing a healthy, comfortable, and productive work environment for its employees. State law prohibits smoking in public buildings and facilities and has allowed areas to be designated for smoking at the discretion of the person in charge (i.e. City Manager). All owned or leased City buildings, facilities, and vehicles are designated as non-smoking. Smoking areas have been designated outside City buildings and facilities. This policy applies to all employees, clients, contractors, vendors, and visitors. Effective November 1, 2010, it is the policy of the City that smokers/tobacco users will not be hired. All new employees are required to sign an affidavit stating they have not been a tobacco user for at least six (6) months prior to their application for employment and will remain tobacco free during their employment with the City of Naples. Tobacco is defined as any lighted or unlighted cigarette, cigar, pipe, nicotine dispensing device, or any other types of smoking product, including smokeless tobacco such as spit tobacco, dip, chew, or snuff, in any form. Employees who smoke and would like to quit smoking are invited to participate in one of the City’s approved smoking cessation programs that are administered under the City's health plan. Contact the Human Resources Department for additional information. The success of this policy depends upon the thoughtfulness, consideration, and cooperation of all employees. Problems should be brought to the attention of the appropriate supervisor and handled through the normal chain of command. Employees who violate this policy may be subject to the same disciplinary action that applies to other infractions of City policies.
