To assist in discharging its duty of care, the Sovereign Base Areas Police has developed policies and training programmes that will help to minimise the risk of harm to its employees. The SBA Police is committed to ensuring officers' personal safety and this responsibility rests with the Deputy Chief Constable. **(a)** Reviewing and updating the content of skills training within the safety training programme to meet force requirements **(b)** Assisting in the evaluation of equipment for use **(c)** Delivering the training according to the training programme The dedicated Headquarters 'Personal Safety Instructor' organises and delivers the training with the support of other qualified Personal Safety Instructors. -- ----------------------------------------- **Personal Safety -- Fitness for Duty** -- ----------------------------------------- **2.1** As part of the process for ensuring that the risk of harm is minimised: Personal safety training will be given to all officers up to and including the rank of Inspector and will be carried out annually to ensure knowledge and fitness levels are kept high. 3. Use of force =============== **3.1** Legal powers to use reasonable force are derived from Common Law. Criminal Procedure Ordinance Section 16 and Criminal Code Cap. 154. Section 17. ***[The Common Law]** recognises that there may be circumstances in which one person may inflict violence on another without committing a crime. It recognises as one of these circumstances the right of a person to protect themselves from attack and to act in* defence of others and if necessary, to inflict violence on another in doing so. If no more force is used than is reasonable to repel the attack such force is not unlawful. **[Section 16(2) of Criminal Procedure Ordinance]** states: *If the person to be arrested forcibly resists arrest or attempts to evade arrest, the police officer or other person making the arrest may use all means necessary to make the arrest but must not use more force than is reasonable in the circumstances.* **[Section 17 Criminal Code Cap 154]** states: *An act or omission which would otherwise be an offence may be excused if the person accused can show that it was done or omitted to be done only in order to avoid consequences which could not otherwise be avoided, and which if they had followed, would have inflicted upon him or upon others whom he was bound to protect inevitable and irreparable evil, that no more was done than was reasonably necessary for that purpose, and that the evil inflicted by it was not disproportionate to the evil avoided. The objective of police use of force is for self-defence and/or to preserve the safety of the public and police by establishing control.* **When control is established and maintained the officer's use of force must cease.** **3.2** The approach that should be taken can be summarised in the simple acronym **J.A.P.A.N:** - - - - - **3.3 [Justification]** **3.4 [Authorisation]** **3.5 [Proportionality]** **3.6 [Auditable]** **3.7 [Necessary]** -- ------------------------------------------------- []{#NDM.anchor}**The National Decision Model** -- ------------------------------------------------- **4.1** The National Decision Model (NDM) is suitable for all decisions and should be used by everyone in policing. These factors include all actions, situational factors and conditions surrounding the confrontation. Evaluation of these factors allows a more accurate picture of why the force was used. Officers should apply **the Conflict Resolution Model to justify 'Individual Perceived Appropriate Response'.** - - - ![](media/image3.png) **5.2** **[Profiled Offender Behaviour]** **Profiled Offender Behaviour** refers to a set of behaviours displayed by an offender. It involves working out the characteristics of **offender** behaviour and assisting a police officer to respond appropriately to that behaviour. Sadly, dialogue does not always succeed and in some cases may be inappropriate. **8.** []{#useofforceRECORDS.anchor}**Use of Force Records** **8.1** The SBA Police will maintain a formal 'use of force' reporting system to assist in the evaluation and maintenance of the Personal Safety Programme. a. b. c. d. e. - - - - - **9.** []{#personalsafetytraining.anchor}**Personal Safety Training** **9.1 [General]** The SBA Police has adopted the Personal Safety Training Programme in line with UK standards. The training programme consists of: - - - - - - - All Personal safety instructors will be recertified every two years by a qualified personal safety trainer. Training will be implemented as detailed in the Personal Safety Training Programme in suitable locations and where possible in as real conditions as possible. **9.2 [Officers' Responsibilities]** a. b. c. d. e. f. **9.3 [Training Records]** a. b. c. d. **10.** []{#SPEAR.anchor}**SPEAR System** **10.1 SPEAR** is the acronym for **S**pontaneous **P**rotection **E**nabling **A**ccelerated **R**esponse. **10.2 [The priority systems of survival]** Chemicals such as adrenaline, dopamine, endorphins and cortisol exist in the human body. Powerful emotions such as excitement, apprehension, fear and severe stress may trigger the flood of these chemicals around the body to boost a reaction to the stimulus. However, these classic, hormonally induced fight, fright or flight effects are secondary responses to an immediate attack or threat because before the hormonal responses take effect and prior to the conscious thought, part of the brain known as the amygdale has already initiated what is termed as a 'Flinch Response'. **10.3 [Flinch Response]** To fully grasp the significance of the priority system of survival two vital areas must be understood. Firstly, even when the Officer has awareness, if the speed, aggression or proximity of the attack is strong enough to initiate the Flinch response, the physiological survival mechanisms that are hard-wired in the body's nervous system will by-pass any cognitively learnt muscle memory personal safety techniques. This important principle is referred to as the SPEAR System, while the flinch response cannot be eradicated it can be modulated though training. This is known as 'converting the flinch' and is the basis of the SPEAR System training method. ***Flinches are characterised in the following way:*** **10.3.1 [No Flinch (this is a rare phenomenon)]** **10.3.2 [Primal Flinch]** **10.4 [Protective SPEAR (Converting the Primal Flinch)]** **10.4.1 [Full SPEAR]** **11.** []{#bodyarmour.anchor}**Body Armour** **11.1** This policy relates to the personal issued, proper use and care of body armour vests. Police officers within the SBA Police issued with armour, hereafter they shall be referred to as 'The Wearer'. **11.2** Body armour is Personal Protective Equipment (PPE) issued to provide protection against serious or permanent injury whilst exposed to the risk of any assault, injury or incident whilst engaged on Police duty. **11.3** The SBA Police will ensure that wearers are suitably trained in the use of body armour and are aware of their legal and professional responsibilities regarding wearing, storage and maintenance thereof. **11.4 [Purpose]** **11.4.1** It is the policy of the SBA Police to maximize officer safety through the use of body armour in combination with prescribed safety procedures. **11.4.2** The legal basis for this policy is to demonstrate how SBA Police intends to comply with Health & Safety at Work Ordinance 1999 and Health & Safety at Work Regulations (Use of Personal Protective Equipment) 2002. **11.4.3** The Health & Safety at Work Ordinance 1999 is designed to secure the health, safety and welfare of people at work and to protect people against all other risks to their health and safety arising from work activities. **11.4.4** Part III of the Health & Safety at Work Ordinance 1999, places a general duty on employers to their employees at work, namely: ***'It shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all his/her employees'.*** **11.4.5** The Ordinance also places a general duty on every employee while at work: - - - **11.4.6** The main requirement is that PPE be supplied and used at work wherever there are risks to health and safety that cannot be adequately controlled in other ways. **11.4.7** The Regulations also require that PPE is: - - - - **11.4.8** Members of staff, who do not routinely wear their body armour, must anticipate the risks if it is not put on immediately prior to any deployment to an incident where the circumstances could escalate or result in a violent or potentially violent assault or injury. All wearers must consider the principles of and undertake a Dynamic Risk Assessment (DRA) when faced with a potentially violent encounter. In doing so, they must consider the risks, which may be present with any unfamiliar person, place or object they encounter and the importance of thinking prior to. 5. **[Specifications]** Body armour offers both [knife] and [spike protection] (KR1 and SP1) but [not] ballistic protection. It has a spam life of five years and the renewal of it will be monitored by the Clothing and Equipment Office of SBA Police HQ. **11.6** **[Compliance]** Under no circumstances are wearers permitted to wear any alternative body armour obtained from another force, purchased privately or obtained by any other unofficial method whilst engaged on SBA Police duty. **11.6.1** The body armour risk assessment is based on both statistical and anecdotal research, which has been undertaken and is under regular review. It is concluded that the risk of attack is intermittent and that mandatory wearing of body armour is not warranted. However, the possibility of attack increases predictably in some situations and body armour should therefore be worn whenever officers may have to protect themselves: - - - - - - **11.6.2** In addition, wearers must put on body armour when instructed to do so by a supervisor or by way of instructions contained in a written order for specific events or operations. Although the routine wearing of armour is not mandatory, the SBA Police would encourage all staff to wear their armour whenever they are likely to come into contact with the general public whilst engaged on operational patrol. Officers are expected to dynamically risk assess their activities in considering whether there is any requirement to be in possession (readily available e.g. in patrol vehicle) if not actually wearing the armour itself. Officers on uniform vehicle patrol should have the body armour readily available for use in that vehicle. The following factors will seriously affect the performance of the armour and could reduce the protection afforded: - - - - - **11.6.3** Regular self-inspections of an individual's body armour should be carried out to ensure it remains fit for purpose. Wearers who do not comply with instructions to put on body armour are not only placing themselves at risk but also their colleagues if they are unable to support them due to an otherwise avoidable injury. The armour outer cover, or armour carrier as it is known, is not flame retardant. At all times when overt armour is worn, the wearer's personal issue slipover style epaulette sleeves must be attached to the shoulders of the armour cover. When wearing high visibility clothing the body armour must be worn underneath to maximise an individual's visibility. This is important for those wearers engaged on roads policing duties, traffic control or response work. Wearing body armour over the top of high visibility clothing obscures visibility markings and therefore impacts on staff safety. **11.7 [Wearing Procedures-Specific roles]** **11.7.1** **[Uniform Officers]** [ ] **11.7.2** **[Officers in plain clothes]** **11.7.3** [**ARV Officers** ] **11.7.4** **[Unarmed Officers involved in Firearms Operations]** **11.8 [User Guide]** **11.8.1** **[Introduction]** The body armour is supplied with the armour inserts already assembled into their outer cover ready to wear. Before use, a check needs to be carried out that the armour inserts are positioned so that the labels are facing the body side. If there is any sign of damage or there is any doubt the Clothing and Supply officer should be contacted before use of the armour. During the development of the armour in the vest and during the qualification testing of samples of the armour by an accredited test house of the Home Office Scientific Development Branch UK, bullets, knives and spikes were used that represent as far as possible the attack threats to which a police officer may be exposed. **11.8.2** **[Fitting and Adjustment]** - - - - - - - **11.8.3** **[Care and maintenance]** - - - - - - - - - - - - **12.** []{#handcuffs.anchor}**Use of Handcuffs** **12.1 [Carrying]** Officers will only use handcuffs that are of an approved type and have been issued for duty purposes. They should be maintained to ensure they are not capable of injuring the prisoner or allowing them to escape. If in doubt about their maintenance, then a Personal safety instructor should be consulted. Handcuffs will be carried by all officers to whom they have been issued whilst on duty. The approved handcuffs for the SBA Police are the Quik-Kuff / TCH / HIATTS Rigid type and for large scale arrests, the use of flexi cuffs. **12.2 [Application]** - - - **12.3 [Justification for use]** The primary reason for the use of handcuffs is safety of the; 1. 2. 3. **Any intentional application of force to a person by another is an assault**. The use of handcuffs amounts to such an assault and is unlawful unless it can be justified. **12.4 [Reasonable Grounds]** 1. Is attempting to escape 2. Offers violence to others or himself/herself. 3. Is informed that they are under arrest.
