PORTES, AE Course Instructor © Copyright | All Rights Reserved INTRODUCTION The Civil Aviation Authority of the Philippines (CAAP) is the agency responsible for implementing policies on civil aviation to assure safe, economic and efficient air travel. Formerly the Air Transportation Office, it is an independent regulatory body attached to the Department of Transportation for the purpose of policy coordination. Refer to R.A. 9497 for more information about CAAP. Philippine Civil Aviation Regulations | Engr. Venice D. Portes AE621: Civil Air Laws & Regulation PCAR PARTS The Civil Aviation Regulations (CAR) provide the regulatory requirements dealing with aviation safety related to aircraft operations, airworthiness and personnel licensing; and are presented in Parts. Currently in total, there are thirteen (13) Parts. PART 1 - GENERAL POLICIES, PROCEDURES, and DEFINITIONS sets forth the basic rules of construction and application of the regulations, definitions applicable to more than one Part, and the rules governing the administration of licenses and certifications. All of the definitions of ICAO Annexes 1 through 16 Volume 2 and ICAO Annex 18 are listed in Appendix A to Part 1 of these regulations. Philippine Civil Aviation Regulations | Engr. Venice D. Article 32 of the Chicago Convention requires Republic of the Philippines to issue certificates of competency and licenses or validate such certificates or licenses issued by other Contracting States to the pilot of every aircraft and to other members of the operating crew of every aircraft engaged in international navigation. presents detailed requirements for the general rules of licensing and detailed requirements for the certification of airmen, pilots, non-pilot flight crew members, and airmen, such as mechanics, who are not flight crew. also presents medical standards for the granting of licenses and certification, and for the administration of medical examinations. PART 4 - AIRCRAFT REGISTRATION AND MARKING sets forth the requirements for registration of aircraft in the Republic of the Philippines and governs the application of nationality and registration marks. derived from ICAO Annex 7. Portes AE621: Civil Air Laws & Regulation PCAR PARTS PART 5 - AIRWORTHINESS presents regulatory requirements for the airworthiness of aircraft expected to operate in the Republic of the Philippines using the standards and recommended practices (SARPs) in ICAO Annexes 6 and 8. requires all persons operating Republic of the Philippines registered aircraft to notify the Authority when certain events occur. The Authority is required to open lines of communication with the State of Design and/or the State of Manufacture so that the Authority can receive all safety bulletins and airworthiness directives for each type of aircraft operating in the Republic of the Philippines. Maintenance requirements are set forth in Part 5 for persons who are neither employees of an Approved Maintenance Organization (AMO). Philippine Civil Aviation Regulations | Engr. Venice D. Portes AE621: Civil Air Laws & Regulation PCAR PARTS PART 6 - APPROVED MAINTENANCE ORGANIZATION provides regulations for the registration and monitoring of Approved Maintenance Organizations (AMO) in Republic of the Philippines. In the Republic of the Philippines, persons have to be individually licensed in accordance with Part 2 to perform any maintenance task and to sign the maintenance release to return to service any aircraft or component. An AOC holder must use the services from an AMO with the appropriate ratings, through administrative arrangements. An AMO applicant within the Republic of the Philippines is required to disclose any and all AMO certificates in any Contracting State other than the Republic of the Philippines. PART 10 - COMMERCIAL AIR TRANSPORT BY FOREIGN AIR CARRIERS WITHIN REPUBLIC OF THE PHILIPPINES prescribes the regulations governing the operations within Republic of the Philippines of aircraft of each foreign air carrier holding a permit issued by the Civil Aeronautics Boards under the provisions of Republic Act 776 and/or Republic Act 9497. PART 13 - ACCIDENT & INCIDENT REPORTING & INVESTIGATION contains amendments to implement the new provisions of Standards and Recommended Practices (SARPs) of Annex 13 under Article 26 of ICAO (Chicago) Convention, and the Corrective Actions Proposed (CAPs) per USOAP Audit Findings on Accident Investigation Group (AIG) conducted to CAAP in CY- 2009 which were duly considered and accepted by ICAO. License holders cannot exercise privileges beyond those granted. Commercial Pilot License (CPL): At least 18 years old. Airline Transport Pilot License (ATPL): At least 21 years old. Types of Ratings Category Ratings: Airplane, Helicopter, Glider, Free Balloon. Class Ratings: Single-engine land, Single-engine sea, Multi-engine land, Multi- engine sea. Type Ratings: Required for aircraft that need at least two pilots or as specified by the authority. Renewal Requirements: Submit renewal application 30 days before expiry. AVIATION MAINTENANCE LICENSING Proof of active service in the last 24 months in compliance with regulations. License Duration: 5 years. License remains valid as long as competency is maintained. Recent Experience Requirements (Last 24 months): Either proven by the Authority or by actively working as an Aviation Maintenance Specialist (AMS). Can also be met by supervising other AMS personnel. Recurrent training from an Approved Maintenance Organization (AMO) is required. License Display: Must be kept in the immediate area where the licensee works. Rating Requirements: Approved training course on topics including air law, ATC equipment, aerodrome control, meteorology, emergency procedures, and navigation. Experience requirements (under supervision of an ATC license holder) Minimum 90 hours or 1 month for aerodrome control rating. Minimum 180 hours or three months of supervised control service for approach or area control ratings. Approach precision radar control rating: Requires at least 200 precision approaches, with at least 50 performed at the designated unit and equipment. Philippine Civil Aviation Regulations | Engr. Portes AE621: Civil Air Laws & Regulation PART 2 - PERSONNEL LICENSING REMOTELY PILOTED AIRCRAFT (RPA) CONTROLLER CERTIFICATE Eligibility: Completion of an RPA training course conducted by the manufacturer. Minimum of 5 hours of RPA operation outside controlled airspace. Passed RPAS Exam. Demonstration flight with an authorized personnel. Conditions: Authority may impose restrictions on type of RPA operated, operational areas, and weather conditions (VMC). Certificate Validity: Effective for 5 years unless amended, suspended, revoked, or surrendered. Foreign RPA Certificates can be validated if current and valid from another Contracting State. Portes AE621: Civil Air Laws & Regulation PART 2 - PERSONNEL LICENSING REINSTATEMENT OF PRIVILEGES For Expired Pilot Licenses and Ratings any license that has expired for more than twenty four (24) months shall complete an aircraft initial ground and flight training program For Expired AMT/AMS Licenses and Ratings to seek reinstatement for licenses expired within 24 months, he/she shall pass the Civil Aviation Regulations Test given by the Authority to seek reinstatement on licenses expired for more than 24 months, he/she shall pass the Civil Aviation Regulations test and undergo appropriate recurrent training. Portes AE621: Civil Air Laws & Regulation PART 2 - PERSONNEL LICENSING CURTAILMENT OF PRIVILEGES OF PILOTS WHO HAVE ATTAINED THEIR 65TH AND 67TH BIRTHDAY If a person reaches 65 yrs old, a person shall not serve as pilot-in-command or co- pilot for international commercial air transport on a Philippine registered aircraft If a person reaches 67 yrs old, a person may not serve as pilot-in-command or co- pilot for domestic commercial air transport on a Philippine Registered Aircraft. If a person reaches 65 yrs old, he/she is not eligible to be granted flexibility in meeting medical qualifications. Any person beyond 67 yrs old may be allowed to fly as pilot-in-command or co- pilot for non-commercial air transport, and must undergo CAAP medical examination every 6 months. Recent Experience Requirement: Must have worked for at least 6 months in the last 24 months. Portes AE621: Civil Air Laws & Regulation PART 3 - APPROVED TRAINING ORGANIZATION APPLICATION FOR ISSUANCE OR AMENDMENT OF AN ATO CERTIFICATE ATO applicant shall apply at least 120 days before the beginning of any proposed training. An ATO certificate must contain: the name, location of the ATO date of issue and period of validity authorized locations of operations training courses as approved by the Authority Philippine Civil Aviation Regulations | Engr. Portes AE621: Civil Air Laws & Regulation PART 3 - APPROVED TRAINING ORGANIZATION APPLICATION FOR ISSUANCE OR AMENDMENT OF AN ATO CERTIFICATE An ATO located outside Republic of the Philippines may apply for a Republic of the Philippines ATO certificate, to provide training leading to a license issued by the Republic of the Philippines. Inspections are conducted at least annually, may be extended up to 24 months. Portes AE621: Civil Air Laws & Regulation PART 4 - AIRCRAFT REGISTRATION AND MARKINGS REGISTRATION ELIGIBILITY Aircraft is eligible for registration if it is: owned by or leased to a citizen of the Philippines or corporations or associations under the laws of the Philippines (at least 60% of whose capital is owned by Filipino Citizens) or a government entity of the Republic of the Philippines Not registered under the laws of any foreign country Foreign-owned or registered aircraft is eligible for registration if utilized by aero clubs for recreation/sport/development of flying skills, etc. within the Philippine airspace and if authorized by the authority.
