SHERIFF’S POLICY MANUAL 9.7 PROCEDURE FOR COMPLETION OF BSO A#18 DISCIPLINARY ACTION RECOMMENDATION AND BSO A#55, COUNSELING REPORT: These forms will be used to provide employees with basic information about disciplinary recommendations or counseling. A. Disciplinary Action Recommendation (BSO A#18): 1. A Disciplinary Action Recommendation will be used if discipline rather than counseling is recommended. Note: Counseling will not be considered discipline. 2. If an employee receives a Disciplinary Action Recommendation, the employee shall acknowledge receiving a copy by signing the original form. The employee's signature on a Disciplinary Action Recommendation will only be evidence the employee received the recommendation and it was discussed with the employee. 3. Failure of an employee to sign acknowledging their receipt of a copy of the Disciplinary Action Recommendation after being directed shall subject the employee to further disciplinary action. 4. If the employee refuses to sign the Disciplinary Action Recommendation, the employee's supervisor will write “Refused” and the date/time of the refusal in the applicable employee's signature area. If a witness is present, the witness will sign and date the report below the employee's signature area. 5. A Disciplinary Action Recommendation will not be copied for the purpose of including the form in any file other than to the designated distribution, without express approval of Internal Affairs. Internal Affairs will be responsible for any other distribution of these reports. 6. Information relating to an employee Disciplinary Action Recommendation will be recorded on the Employee Counseling/Disciplinary Action Log (BSO A#101). Internal Affairs will be responsible for complying with all applicable Florida Statutes on archiving disciplinary reports. B. Counseling Report (BSO A#55): 1. Counseling Reports will be used for documenting counseling only. It is a non-disciplinary process used to denote: a. Performance deficiencies b. Corrective processes c. Additional training or educational needs 2. If an employee receives a Counseling Report, the employee shall acknowledge receiving a copy by signing the original form. The employee's signature on the Counseling Report will only be evidence the employee read each page and the report was discussed with the employee. 3. Failure of an employee to sign acknowledging their receipt of a copy of the Counseling Report after being directed shall subject the employee to disciplinary action. 4. If the employee refuses to sign the Counseling Report, the employee's supervisor will write “Refused” and the date/time of the refusal in the applicable employee's signature area. If a witness is present, the witness will sign and date the report below the employee's signature area. 5.
