SHERIFF’S POLICY MANUAL 4.2 DEFINITIONS 4.2.1 Accumulated Sick Time: Sick time accumulation starts from the employee's date of hire through date of separation. 4.2.2 Administrative Leave: A. Administrative leave is excused time from work with pay. B. Administrative leave may be given to employees at the Sheriff’s discretion, for the following: 1. Appearing for BSO employment interviews 2. Full-time employees exempt from overtime provisions, working in excess of their normal work schedule Note: Employees eligible to receive administrative leave will work beyond their normal workday on an as-needed basis, not to be limited by amount of administrative leave hours. 3. For the good of BSO 4. For nonessential employees during extreme weather or emergency situations if authorized by the Sheriff C. Employees will obtain supervisory approval before using administrative leave. D. Administrative leave will not be given in place of sick leave for employees exhausting their accumulated sick leave. 4.2.3 Anniversary Date: A. Employees who are hired or have a change in their personnel or pay status (other than a step increase) on the 1st up to and including the 15th day of the month will have an anniversary date of the 1st day of that month. Employees newly hired or have a change in their personnel or pay status (other than a step increase) on the 16th through and including the last day of the month will have an anniversary date of the 1st day of the following month. 4.2.4 Continuous Service: A. For computing leave with pay, continuous service means employee service between their date of hire and date of separation; provided that pay periods will not be counted when an employee is in an unpaid status for half or more of the employee's assigned work hours. B. Though unpaid status is not included in computing length of continuous service, service immediately following unpaid status will be considered a continuation of continuous service immediately preceding it. C. Employees rehired following a separation other than layoff will be considered new employees for annual and sick leave purposes. Persons reinstated from a layoff list will have their prior continuous service preserved and not serve a new probationary period. 4.2.5 Domestic Partners: Two adults who are parties to a valid domestic partnership relationship and who meet the requisites for a valid domestic partnership relationship as established by BSO. Criteria and registration will be accomplished pursuant to Human Resources/Employee Benefits SOP. 4.2.6 Good Standing: A resignation (not resignation in lieu of termination) with no charges pending and minimum two weeks notification given. 4.2.7 Holiday Time: Time given to employees required to work or whose regular day off falls on a BSO holiday. Holiday leave may be used for the same purpose as annual leave and is payable on separation. 4.2.8 Immediate Family: A spouse, county registered domestic partner, children, mother, father, step-mother, step-father, step-child, sister, brother, mother-in-law, father-in-law, mother or father of domestic partner, employee's grandparents, or grandchildren. 4.2.9 Leave Year: The base period for maintaining an employee's leave record. It comprises 26-biweekly pay periods in a pay status. Reviewed: 12/02/2015 Revised: 12/02/2015 Rescinds: 01/13/2014 Effective: 12/07/2015 4.2 Page 2 of 4 SHERIFF’S POLICY MANUAL 4.2.10 Pay Period: BSO's 14 calendar day payroll period. 4.2.11 Pay Status: An employee is in pay status during any period where payment is received for services performed or on paid leave time (annual, disability, administrative, etc.). Workers' Compensation payments alone do not constitute pay status. 4.2.12 Shift Substitution: Shift substitution is defined as mutually agreed switching of shifts between two employees holding the same job titles in the same district/division. The following pertains to shift substituting: A. Shift substitution will only pertain to hours actually worked. Employees will only substitute hour for hour. B. Employees will be prohibited from exchanging their pay with a substitute. C. Shift substitution will only take place during the same pay period. Employees will be prohibited from working over 80 hours within the pay period as a result of shift substitution. D. Employees who mutually agree in writing to substitute their shifts must obtain their supervisor's prior approval for the substitution. E. Shift substitution must be documented in memo form and have both employees and approving shift commander's signatures prior to initiating the substitution. F. Management reserves the right to approve or disapprove mutually agreed shift substitutions to efficiently administer their operation.
