ICAO- INTERNATIONAL CIVIL AVIATION ORGANISATION The International Civil Aviation Organization is a specialized agency of the United Nations. It changes the principles and techniques of international air navigation and fosters the planning and development of international air transport to ensure safe and orderly growth. HISTORY OF ICAO The convention on International Civil Aviation (Chicago Convention) was signed on 7 Dec 1944 by 52 states The provisional ICAO was established from 6 June 1947 until 4 Apr 1947 (cause of the pending ratification by 26 states. ICAO came into being 4 Apr 1947. ICAO became a specialized agency of the United Nations. ICAO now have 193 member states (signatory states) ROLE OF ICAO 1.Encourage the development of airways, airports, and air navigation facilities for international civil aviation. 2.Meet the needs of the peoples of the world for safe, regular, efficient, and economical air transport 3. Prevent economic waste caused by unreasonable competition 4. Ensure that the rights of contracting states are fully respected and that every contracting state has a fair opportunity to operate international airlines 5. Promote safety of flight in international air navigation; and promote generally the development of all aspects of ICAO Assembl Secretar Council y iat The Assembly, composed of The Council is a governing body representatives from all elected by the Assembly for a contracting states, is the three-year term. It is composed sovereign body of ICAO. It of 36 states. As the governing meets every 3 years body, the Council gives continuing direction to the work of ICAO. It is in the Council that SARP’s are adopted and incorporated as Annexes to the Convention on International Civil Secretariat is headed by secretary general. Mr. Juan Carloz Salazar is the current secretary general of ICAO Secretariat Bureau of Air Technical administratio Air Transport Navigation Legal Bureau Cooperation n and Bureau, Bureau Bureau services ICAO ANNEXURES: Annexures: The Annex is a wide-ranging document which reflects the flexibility of ICAO in keeping pace with international civil aviation. ICAO SARPS (Standards and Recommended Practices) for each area of ICAO responsibility are contained in 19 Annexes. Each Annex deals with a particular subject area. Standards And Recommended Practices (SARPs) are technical specifications adopted by the Council of ICAO DGCA AND ROLE OF DGCA. The Directorate General of Civil Aviation (DGCA) is the regulatory body in the field of Civil Aviation, primarily dealing with safety issues under MOCA Role: This directorate investigates aviation accidents and incidents,maintains all regulations related aviation and is responsible for issuance of licenses pertaining to aviation like PPL's, SPL's and CPL's India. It is responsible for regulation of air transport services to/from/within India and for enforcemen of civil air regulations, air safety and airworthiness standards. It also co-ordinates all regulatory functions with International Civil Aviation Organisation. It is headquartered along Sri Aurobindo Marg, opposite Safdarjung Airport, in New Delhi. FUNCTIONS OF DGCA Registration of civil aircraft Certification of airports Licensing of pilots, aircraft maintenance engineers, air traffic controllers and flight engineers, and conducting examinations and checks for that purpose Carrying out amendments to the Aircraft Act, the Aircraft Rules and the Civil Aviation Requirements Grant of certificates of airworthiness to such aircraft Granting Air Operator's Certificates to Indian carriers and regulation of air transport services operating to/from/within/over India by Indian and foreign operators Approval of institutes engaged in flying training including simulator training, AME training, air traffic services training or any other training related with aviation, with a view to ensuring a high quality of training Approval to aircraft maintenance, repair, design and manufacturing organizations and their continued oversight Keeping a check on aircraft noise and engine emissions in accordance with ICAO Annex 16 and collaborating with the environmental authorities in this matter, if required Safety Oversight of all entities approved/ certified/ licensed under the Aircraft Rules 1937. DEPARTMENTS OF DGCA REGIONAL OFFICES AIRCRAFT ACTS (1934) AND AIRCRAFT RULES (1937) Aircraft Act, 1934 and Aircraft Rules, 1937 were enacted to regulate the civil aviation industry in India. AIRCRAFT RULE 2021 THE DRONE RULES SECTIONS OF CAR- TOTAL 11SECTIONS AIRCRAFT ACTS 1934 Section 1: short title and extent Section 2: Definitions: AIRCRAFT: means any machine which can derive support in the atmosphere from reactions of the air, other than reactions of the air against the earth's surface and includes balloons, whether fixed or free, airships, kites, gliders and flying machines; aerodrome" means any definite or limited ground or water area intended to be used, either wholly or in part, for the landing or departure of aircraft, and includes all buildings, sheds, vessels, piers and other structures thereon or appertaining thereto; Section 3:Power of Central Government to exempt certain aircraft Section 4:Power of Central Government to make rules to implement the Convention of 1944 Section 5: Power of Central government to make rules AIRCRAFT ACTS 1934 Section 5A: Power to issue directions Section 6:Power of Central Government to make orders in emergency Section 7: Power of Central Government to make rules for investigation of accidents Section 8: Power to detain aircraft. Section 8A: Power of Central Government to make rules for protecting the public health Section 8B: Emergency powers for protecting the public health.- Relation between CAR 145,CARM, 21,147,66 WHAT IS AIC AIC – Aeronautical information circular An Aeronautical Information Circular (AIC) is a notice containing information that does not qualify for the origination of a Notice To Airmen (NOTAMS) or for inclusion in the AIPs, but which relates to flight safety, air navigation, technical, administrative or legislative matters. SECTION 1 GENERAL SERIES A PART 1: Subject: Issuance of the Civil Aviation Requirements and revisions thereof etc. – Requirements to be complied with. This CAR describes the procedure for issue and revision of Civil Aviation Requirements and their dissemination to various organizations and is issued under rule 133A. (ISSUE OF SPECIAL DIRECTIONS BY DGCA) The first page of the CAR shall indicate the Section, Series, Part and date of issue along with the date of applicability. Subsequent pages shall indicate the date of issue only. SECTION 1 GENERAL Every revision shall be accompanied by a “Revision Notice”, which shall indicate the pages affected and the justification for the revision All revisions to the CAR shall be indicated by a sideline on the left side of the affected pages indicating the change/ revision to the CAR. Whenever a new CAR or revision to the existing CAR is proposed to be issued, the draft of the proposed CAR/revision shall be posted on DGCA website or circulated to all the persons likely to be affected thereby for their objections/ suggestions. The objections/ suggestions received within the stipulated period of 30 days or less as may be determined by Director General shall be analyzed and if found acceptable shall be incorporated in the proposed CAR before promulgation SECTION 1 SERIES A PART II: SUBJECT: DEFINITIONS (RULE 29C) 29C. Adoption of the Convention and Annexes SERIES A PART III SUBJECT: Procedure for holding examinations, proficiency checks etc. for Defense personnel to fulfill the requirements for grant of civil licenses SERIES A PART V SUBJECT: Regulatory Document Management System SERIES B PART I SUBJECT: Units of Measurements to be used in air and ground operations. SECTION 1. ICAO Annex 5 provides the Standards and Recommended Practices pertaining to the units and measurements to be used in Air and Ground operations which are required to be adopted by the Contracting State. SERIES B PART III SUBJECT: Procedure for seeking exemption from Civil Aviation Requirements. sub-rule (4) of Rule 133A of the Aircraft Rules, 1937 provides Director-General of Civil Aviation (DGCA) the power to exempt any aircraft or class of aircraft or any person or class of persons from the direction(s) given in CARs The application shall be submitted to the concerned Head of the Directorate in the region or to the directorate at headquarters (in case regional offices do not exist).
