university of the philippines task force arki CONSTITUTION 2024 edition c/o the UP Task Force Arki Constitution Revisions Committee AY 2023-2024 Adopted by The Constitutional Commission of 1989 at the College of Architecture, University of the Philippines, Diliman, Quezon City UP TASK FORCE ARKI Building an environment that builds people THE CONSTITUTION OF THE university of the philippines task force arki PREAMBLE “We, the members of the University of the Philippines Task Force Arki, hereby ordain and promulgate this Constitution with the aim of establishing a relevant and effective student Organization that shall serve the needs of the Filipino people, equip students with responsive architectural education, and foster unity with students in other disciplines.” ARTICLE I General Provisions Section 1. This organization shall be officially known as the University of the Philippines Task Force Arki and will subsequently be referred to as “UP TFA” or “the Organization”. Section 2. This document shall be known as “The Constitution of the University of the Philippines Task Force Arki”. Section 3. UP TFA shall have its principal office at the University of the Philippines College of Architecture Complex (UPCA), Diliman, Quezon City, 1101. Section 4. The UP TFA logo shall serve as an emblem consisting of visual elements representing the Organization’s identity and property. Section 5. All matters referring to logo’s components, official color, guidelines for fair use and alteration shall be found in the “UP TFA Brand Manual”. ARTICLE 2 Goals and Objectives Section 1. The Guiding Principle of UP TFA shall be “Building an environment that builds people”. UP TFA is primarily a service-oriented organization that responds to the basic needs Section 2. of the Filipino people through use of architectural and design solutions, and promotes the upward development of society. Section 3. UP TFA dedicates itself to the upliftment of human dignity, the pursuit of truth and freedom through critical thinking, the achievement of social justice, and the promotion and practice of the democratic system. UP TASK FORCE ARKI Building an environment that builds people ARTICLE 3 Declaration of Objectives Section 1. The Organization shall give assistance to underserved, underprivileged, and blighted areas that need the services of students, practitioners and other sectors by: 1.1 Undertaking research on the analysis of housing programs for the poverty- stricken and giving active support to those who are in agreement with the Organization’s principles; 1.2 Tapping government agencies, community organizations and other resources to give assistance to the problems of the poverty-stricken; 1.3 Giving seminars and lectures to the poverty-stricken on community planning and organizing housing maintenance, and other practical skills in related subjects; and 1.4 Actively participating in services to be rendered to the community. Section 2. UP TFA shall develop the level of awareness of the studentry and the various sectors of society regarding poverty, housing situations, and other related current issues through: 2.1 Disseminating information via exhibits, symposia, lectures, and the like; 2.2 Holding workshop seminars wherein the issues are tackled; and 2.3 Providing exposure trips to the areas of concern. Section 3. UP TFA shall equip the members with the necessary knowledge and skills to become more capable professionals by: 3.1 Providing supplementary education through group discussions, tutorials, and lectures by invited guests; 3.2 Holding workshops for personal development and leadership training; and 3.3 Practicing the knowledge and skills gained in the Organization’s programs and projects. ARTICLE 4 Projects and Events Section 1. The projects and events to be carried out by the Organization shall focus on three main areas, namely: 1.1 The pursuit of declared principles and objectives of UP Task Force Arki. UP TASK FORCE ARKI Building an environment that builds people 1.2 The basic organizational functions of academic excellence, educational attainment, research, and extension services; and 1.3 The resources (i.e. human, physical, and financial) which are required in carrying out these basic functions. Section 2. The projects and events to be carried out by the Organization shall focus on two main areas, namely: 2.1 It is in line with the principles, goals, and objectives of the Organization; and 2.2 The Organization can support it in terms of manpower and financial resources. Section 3. The Organization's Executive Board will have the discretion to accept or reject projects and events. 3.1 Any member or applicant may propose any project or event to the Organization’s Executive Board ARTICLE 5 Application Process Section 1. The following shall be the General Qualifications of Applicants: 1.1 They must be bona fide students of the University of the Philippines Diliman. 1.2 They must not have been found guilty of any disciplinary action of any act involving moral improbity. 1.3 They must not be in the final semester of their expected program in the University of the Philippines upon application. Section 2. The app process should emphasize app integration in the organization’s projects and events in the semester of application. Section 3. The following will be the general outline of the application process for the Applicants of UP TFA, this outline along with it’s content are subject to flexibility to what the Membership head/s deem appropriate: 3.1 Sigsheet - The UP TFA sigsheet shall contain information about the Organization, the applicant’s profile, the members of the organization, tambay hours log, events attendance, and other necessary contents that the applicant must fill in. 3.2 Tasks - The Membership Committee shall design a unique series of tasks to be accomplished by applicants during each application cycle. The aim of these tasks is to give applicants and members the opportunity to get to know one another and for applicants to learn more about the Organization. UP TASK FORCE ARKI Building an environment that builds people 3.3 Batch Project - The batch project shall be the last contribution of the applicant batch to the Organization. It may be in the form of an event or project that is in line with the Organization’s objectives which must be organized by the applicant batch or in the form of a tangible object which shall serve as an addition to the Organization tambayan. 3.4 Formal Interview - The second phase of the application process will be the formal interview. The interview serves to test each applicant’s knowledge of the Organization’s objectives, causes, constitution, bylaws, and members. The formal interview will follow a format designed by the Membership Committee that suits the application process of a given period. 3.5 Final Rites - The final phase of the application prior to achieving inducted Membership status. This shall be done under the supervision of inducted members of the Organization and its alumni and will be organized by the preceding batch of inductees. Section 4. The following shall be the General Terms for Acceptance into the Organization: 4.1 Any applicant shall be qualified to be an Inducted Member after fulfilling all the requirements in application process 4.2 The Membership Committee Head/s shall approve the acceptance of applicants to the Organization, upon the recommendation of the the Executive Board. 4.3 Any member may question the recommendation of the Membership Committee through their Committee Head/s. ARTICLE 6 Membership Section 1. Types of Membership 1.1 Inducted Members – Members who have accomplished the requirements of the application process and officially inducted into the organization in any TFA program or event. 1.1.1 Active Inducted Members – An inducted member who has filed for “active membership” status at the beginning of the semester 1.1.1.1 All new members should file for“active membership” status at the beginning of the semester. 1.1.2 Inactive Inducted Members – A UP TFA member shall only be considered inactive if they meet any of the following conditions: 1.1.2.1 The member is currently taking their thesis (or its equivalent) wherein the “inactive” status is automatically assigned, unless the member requests for “active” membership. UP TASK FORCE ARKI Building an environment that builds people 1.1.2.2 The member who has filed for a Leave of Absence (LOA) or intends to be Absent Without Leave (AWOL) with the college they belongs to. 1.1.2.3 Any member who is not doing their thesis and has not filed for a LOA but has reasons that are deemed acceptable by the Executive Board. 1.1.2.3 Any member of the Organization, except for those under conditions stated in 1.1.2.1 and 1.1.2.2, shall only be allowed “inactive status” for two (2) consecutive semesters or a total of three (3) semesters as an inducted member. 1.2 Non-inducted Members – Non-inducted members are members who have accomplished the application process but haven’t been officially inducted into the organization. 1.2.1 A non-inducted member must be inducted immediately that shall be scheduled by the Membership Committee Head/s 1.2.2 Non-inducted members who fail to attend any induction ceremony within their stay in the University shall not be considered alumni of the Organization. 1.3 Special Membership 1.3.1 Alumni – Inducted members who have graduated from the University shall be recognized as alumni members. 1.3.2 Honorary Member – Any person who is nominated by at least two thirds of the members of the Executive Board and has distinguished themself to be of high reputable character, has contributed and given special service to the Organization shall be identified as an Honorary Member. The following shall be cases wherein a Certificate of Appreciation shall be awarded, upon discretion of the Executive Board: 1.3.2.1 A certificate of appreciation shall be awarded to any Alumni Member in the Organization. 1.3.2.2 A same certificate shall be given to those persons who had given service to any Organization activity or project for a short period of time. Section 2. Terms for Disciplinary Action 2.1 A member may be subject to disciplinary action or may be put on probation only when any of the following grounds are met: 2.1.1 A member who filed for “active” membership and fails to participate in one (1) internal and one (1) external project and event. UP TASK FORCE ARKI Building an environment that builds people 2.1.2 Gross negligence of the Organization’s principles and objectives; 2.1.3 Dereliction of duty; 2.1.4 Misuse of the Organization’s funds; 2.1.5 Defamation of the Organization’s identity and property 2.1.6 Has been found guilty of deliberately violating the Organization’s Constitution and bylaws; and 2.1.7 Has been inactive for two consecutive semesters, whereupon the member shall be given a forced active status in their next semester. 2.1.7.1 If the member has been inactive prior to the year of their thesis year, they must file for an active status in one of the semesters of their thesis year or its equivalent. 2.1.7.2 If the member refuses to be an active member, it shall be grounds for expulsion. Members with special cases that inhibit the member’s ability to be active are upon the approval and discretion of the Organization’s Executive Board. 2.2 All members must be active for at least half of their membership with the Organization. Failure to fulfill the required number of active semesters will result in expulsion from the Organization. 2.2 The above-mentioned grounds for probationary proceedings shall remain under the approval and discretion of the Executive Board. Their retention or expulsion will also be a subject of deliberation for the Executive Board. ARTICLE 7 Rights of the Members The following are the rights of the members: Section 1. UP TFA shall adopt its own internal government and exercise internal powers in implementing its own systems and procedures. Section 2. It shall be the right of every member to carry the name and represent the Organization. Section 3. It shall be the right of every member to participate in all affairs, activities and programs in the Organization. Section 4. It shall be the right of every member to be part of at least one standing committee and one Ad Hoc committee as assigned by the Executive Board. Members may be part of more than one Ad hoc committee granted that they may be able to fulfill their duty satisfactorily in all of their committees including their standing committee. Section 5. It shall be the right of every member to move to impeach any member of the Executive Board. UP TASK FORCE ARKI Building an environment that builds people Section 6. It shall be the right of every member to have access to Education and Research and academic materials (i.e., books, photos, research materials, sample exams) and to the office or “tambayan” for their personal use with due process. Section 7. It shall be the right of every member to have access to the documents of the Organization which include official acts, transactions, decisions, accounting of the funds, and minutes of meetings. However, documents such as the Membership Committee records and papers must remain confidential in order to protect the personal security of the applicants of the Organization. Section 8. It shall be the right of every member to raise their questions, ideas and petitions through the proper channels, and to propose events and activities that are in line with the Organization’s objectives. Section 9. It shall be the right of every member to know all the activities, events, and issues concerning the Organization. Section 10. It shall be the right of every member to be entitled to equal and just treatment within the Organization. Section 11. It shall be the right of every member to be secure in the Organization. Section 12. It shall be the right of every member to undergo due process before any final decision is made regarding any case against him/her. Section 13. It shall be the right of inducted members to have full voting rights on all the matters concerning the Organization. Section 14. It shall be the right of inducted members to vote and be voted for and to hold any designated position or elective. ARTICLE 8 Duties and Obligations of the Members The following are the duties and obligations of all members, unless otherwise stated: Section 1. It shall be the duty of every member to abide by the bylaws herein stated. Section 2. It shall be the duty of every member to know their rights and duties as a member of the UP TFA, of the University, and as a citizen of the Republic of the Philippines, and to exercise their rights, duties, and responsibilities. Section 3. It shall be the duty of every member to participate in the fulfillment of the Organization’s goals and objectives. Section 4. It shall be the duty of every active member to attend or participate in fulfilling any task required for one (1) internal and one (1) external project or event. Section 5. It shall be the duty of every member to take personal measures to keep informed of the current activities and projects of the Organization. UP TASK FORCE ARKI Building an environment that builds people Section 6. It is the duty of every member to pay fees required by the Organization. Section 7. It is the duty of every member to promote and protect the name and integrity of the Organization. Section 8. It is the duty of every member to attend all meetings or general assemblies of the Organization and of their committee/s. Section 9. It is the duty of every member to maintain the good condition of all properties of the Organization. Section 10. It is the duty of every member to be part of one standing committee and comply with the job description of their committee as indicated in the Constitution. Section 11. It is the duty of every member to renew their membership by accomplishing the re- affiliation form, answer semestral directory, and paying their membership fees. Otherwise, they shall forfeit their membership for that semester, including their rights and privileges as indicated in the Constitution. Section 12. It shall be the responsibility of every member to abide by all official decisions of the Organization. ARTICLE 9 General Assembly Section 1. The General Assembly is a meeting that shall consist of all members, both Inducted and Non-inducted. Section 2. The voting power shall be vested on all members of the UP TFA during the General Assembly. Section 3. A first General Assembly of the regular semester shall convene on any day of the first two weeks agreed upon by the members and set forth by the Executive Board and Chairperson. Thereafter, a General Assembly shall be held once a month or whenever deemed necessary. Section 4. A Quorum is defined as fifty percent (50%) plus one (1). The First Degree Quorum shall be defined fifty percent (50%) plus one (1) of the total number of inducted members, active or inactive, in the current roster of members of the UP TFA. But whenever a decision has to be made through the approval of the Organization, the Second Degree Quorum will be applied. A Second Degree Quorum shall be defined as the fifty percent (50%) plus one (1) of the physically present members of the First Degree Quorum. In the case of absence of the required quorum wherein an important and immediate decision must be made, the responsibility shall be passed on to the Executive Board. UP TASK FORCE ARKI Building an environment that builds people ARTICLE 10 Organizational Adviser Section 1. The Organization Adviser shall be a faculty member of the UP College of Architecture. Section 2. They shall be nominated by the Organization’s Executive Board, which is decided by the simple majority vote whether or not to invite the nominee to become the Organization Adviser. Section 3. The Organization Adviser shall advise, suggest or comment regarding the plans and projects of the Organization. Section 4. The Organization Adviser must be the official signatory of all the Organization’s official documents. Section 5. The Organization Adviser is entitled to participate as a nonvoting member in any meeting of the Organization. Section 6. In case of incapacitation (temporary or permanent) a new Organization Adviser shall be nominated following the rules stated in Section 1 of this Article. ARTICLE 11 Standing Committees Section 1. There shall be five (5) standing committees upon the direct supervision, coordination and monitoring of the Standard Bearers: the Education and Research Committee, the Finance and Marketing Committee, the Membership Committee, the Projects Committee, and the Publicity and Creatives Committee. Section 2. The members of these committees shall be based on the choices of the members and preferences of the Committee Heads. Section 3. The Education and Research Committee shall be the main information bank of the Organization. It shall: 3.1 They must be bona fide students of the University of the Philippines Diliman. 3.1.1 Research 3.1.2 Seminars and Workshops 3.1.3 Publications and Write-ups 3.2 Conduct research and feasibility studies related to the Organization’s projects and other relevant issues for purposes of exhibits, awareness campaigns, projects, publications, and other documents released by the Organization; UP TASK FORCE ARKI Building an environment that builds people 3.3 Create write-ups and reports on all internal and external activities of the Organization; 3.4 Assist the Organization’s Executive Board on all c constitutional matters of the organization; 3.5 Organize educational activities (i.e. lectures, symposia, discussions, workshops, exposure trips and immersions) so as to enhance the awareness, knowledge, and skills of its participants; 3.6 Procure, organize, and provide access to educational resources (i.e. plates, notes, lecture slides, etc); 3.7 Take charge of the Organization’s publications (i.e. online statements, research material) in partnership with the Publicity and Creatives Committee; 3.8 Perform such other duties as deemed necessary by the Chairperson and/or are beneficial to the Organization. Section 4. The Finance and Marketing Committee shall manage all financial and marketing matters that involve the funds of the Organization. It shall: 4.1 Focus on the following aspects: 4.1.1 Income-Generating Projects 4.1.2 Sponsorships and Solicitations 4.2 Identify potential sources of funds and communicate with the funding institutions; 4.3 Coordinate fundraising activities for the Organizational fund; 4.4 Have the discretion to accept or reject funding proposals by other committees; 4.5 Keep a record of the expenditures and audit the funds of the standing committees and the ad hoc or Project Committees; 4.6 Handle all marketing and sponsorship matters of the Organization; 4.7 Handle the production and distribution of the Organization’s merchandise and uniforms; 4.8 Prepare financial reports at least once every semester; and 4.9 Perform such other duties as deemed necessary by the Chairperson and/or are beneficial to the Organization. Section 5. The Membership Committee shall decide on all matters regarding member recruitment for the Organization. It shall: UP TASK FORCE ARKI Building an environment that builds people 5.1 Focus on the following aspects: 5.1.1 Recruitment of new members 5.1.2 Application process 5.2 Formulate guidelines and manage the application process; 5.3 Spearhead all activities related to the recruitment of new members to the Organization; 5.4 Be in charge of all social and team-building activities to promote camaraderie among the Organization’s members and applicants; 5.5 Coordinate with other organizations for freshman-related and recruitment- related activities; 5.6 At the end of every application process, submit a report to the Executive Board that should include a list of recommended applicants for Induction; and 5.7 Perform such other duties as deemed necessary by the Chairperson and/or are beneficial to the Organization. Section 6. The Projects Committee shall be responsible for the service activities of the Organization. It shall: 6.1 Focus on the following aspects: 6.1.1 Volunteer Design Services 6.1.2 Social Relevance 6.2 Brainstorm on potential projects and service activities of the Organization; 6.3 Spearhead and facilitate the Organization’s projects, providing for the particular needs and demands of the activity; and 6.4 Perform such other duties as deemed necessary by the Chairperson and/or are beneficial to the Organization. Section 7. The Publicity and Creatives Committee shall be in charge of all publicity and branding matters of the Organization. It shall: 7.1 Focus on the following aspects: 7.1.1 Promotions 7.1.2 Exhibits 7.2 Take charge of the physical design for the production of newsletters, papers, publications of the Organization, merchandise and other creative materials of the Organization; UP TASK FORCE ARKI Building an environment that builds people 7.3 Photodocument all internal and external activities; 7.4 Produce all necessary publicity materials (print and online) for all the Organization’s activities; 7.5 Produce and organize exhibits and publicity campaigns that are in line with the Organization’s projects, goals, and principles; 7.6 Manage all the Organization’s online media accounts; 7.7 Protect the integrity of the Organization’s Brand Manual; and 7.8 Perform such other duties as deemed necessary by the Chairperson and/or are beneficial to the Organization. Section 8. Ad Hoc Committees 8.1 The Ad Hoc Committees are temporary committees that serve a specific purpose and are dissolved after the accomplishment of this purpose. 8.2 The Ad Hoc Head/s are to be assigned and approved by the Organization's Executive Board. 8.3 Ad Hoc Committees shall be composed of volunteers or assigned members from the five (5) standing committees. 8.4 The allegiance of the members of the Ad Hoc Committee must always remain with their original standing committee. 8.5 The types of Ad Hoc Committees are: 8.5.1 Volunteering Opportunities 8.5.2 Social Relevance 8.5.3 Volunteer Design Services 8.5.4 Social Relevance ARTICLE 12 Organizational Structure Section 1. The UP TFA Executive Board shall be composed of the following duly elected positions: 1.1 Standard Bearers 1.1.1 Chairperson 1.1.2 Vice Chairperson for Internal Affairs 1.1.3 Vice Chairperson for External Affairs UP TASK FORCE ARKI Building an environment that builds people 1.2 Committee Heads 1.2.1 Education and Research Committee Head/s 1.2.2 Finance and Marketing Committee Head/s 1.2.3 Membership Committee Head/s 1.2.4 Projects Committee Head/s 1.2.5 Publicity and Creatives Committee Head/s 1.3 It is the discretion of the Electoral Board to allow two committee heads for a committee if deemed necessary for the fulfillment of the goals and objectives of the organization. Section 2. The following shall be the qualifications of the Chairperson: 2.1 They must be an inducted member of UP TFA; 2.2 They must have an active status in the Organization in the semester immediately before the elections; 2.3 They must not have been found guilty in any disciplinary action of any act involving moral improbity, as determined by the Electoral Board; 2.4 They must be a UP College of Architecture student having at least a third year academic status and has been a member of the Organization for at least one year immediately preceding the elections; 2.5 They must have been a member of the Executive Board for at least a semester preceding the elections; 2.6 They must not be graduating or undergoing their thesis year on the academic year after the elections; and 2.7 They must not be a chairperson or hold any equivalent position in any other organization. Section 3. The following shall be the qualifications of the Vice Chairperson for Internal Affairs, Vice Chairperson for External Affairs, and Committee Heads: 3.1 They must be inducted members of the UP TFA; 3.2 Candidates for Vice Chairperson for Internal Affairs and Vice Chairperson for External Affairs must have an active status prior to the semester of the elections in the Organization; 3.3 They must have been accomplished any sanction imposed upon them for any past moral improbity; 3.4 They must not be graduating or taking thesis on the year of elections; 3.5 Any member of the Executive Board other than the Chairperson must have spent at least one (1) academic year in the university; UP TASK FORCE ARKI Building an environment that builds people ARTICLE 13 Duties of the Executive Board Section 1. The highest executive authority shall be vested in the Chairperson of the UP TFA. Section 2. The Chairperson shall have the following duties and authority: 2.1 Align the overall execution of the constitution’s duties and objectives to the entire organization. 2.2 Exercise Articles III and IV in the implementation of the organization’s General Plans of Action (GPOA); 2.3 Call for and preside over general assemblies and Executive Board meetings or instruct the Executive Board to do so; 2.4 Approve an Ad hoc committee and appoint the head of the Committee and the members upon the approval of the Executive Board; 2.5 Represent the Organization in their official capacity as Chairperson on occasions or events where the organization needs representation or authorize a representative from the organization to do so; 2.6 Coordinate and delegate the duties and functions of the officers of the organization; 2.7 Assume the supervision of all the Organization’s affairs, programs and activities; 2.8 Serve as an ex officio member of all committees; 2.9 Sign all resolutions, communications, and papers of the Organization; and 2.10 Perform such other duties as deemed beneficial to the Organization. Section 3. The Vice Chairperson for Internal Affairs shall have the following duties and authority: 3.1 Transcribe the minutes of the Executive Board meetings and general assemblies and provide copies to the officers; 3.2 Disseminate necessary information and/or announcements to the members; 3.3 Schedule general assemblies at least once a month; 3.4 Supervise the planning of all internal activities and events; 3.5 Organize, file, and safeguard all records of the Organization; 3.6 Be in charge of all the Organization’s property including the “tambayan” and its contents; UP TASK FORCE ARKI Building an environment that builds people 3.7 Act as facilitator on behalf of any Executive Board Member in instances where any Executive Board Member is indisposed; 3.8 Monitor the performance of the members in coordination with the Committee Heads; and 3.9 Perform such other duties as deemed necessary by the Chairperson and/or beneficial to the Organization. Section 4. The Vice Chairperson for External Affairs shall have the following duties and authority: 4.1 Coordinate all correspondences and partnerships with other organizations or external entities; 4.2 Handle all correspondences with Alumni members; 4.3 Manage the Organization's official documents for college-based and/or university wide recognition; 4.4 Handle the Organization’s accounts for external affairs (i.e. email); 4.5 Act as facilitator on behalf of any Executive Board Member in instances where any Executive Board Member is indisposed; 4.6 Perform such other duties as deemed necessary by the Chairperson and/or beneficial to the Organization. Section 5. The Committee Heads shall have the following duties and authority: 5.1 Manage and supervise their Committee; 5.2 Extensive planning of projects and events that includes the allocation of resources and manpower to the duties of the committee; 5.3 Be the official representative of their Committee; 5.4 Call for and preside over Committee meetings or assign any member of their Committee to take over in case of their indisposition; 5.5 Be in charge of all activities in their Committee or delegate the responsibility to any member of their Committee in case of indisposition; 5.6 Monitor active statuses of committee members; 5.7 Sign all official documents of the Organization that concerns their Committee; and 5.8 Perform such other duties as deemed necessary by the Chairperson and/or are beneficial to the Organization. UP TASK FORCE ARKI Building an environment that builds people ARTICLE 14 Elections, Electoral Board, and Term of Office Section 1. The Electoral Board shall be an Ad Hoc Committee that handles the elections of the Organization. Section 2. There shall be an Electoral Board composed of five (5) members: 2.1 Chairperson; 2.2 Secretary; 2.3 Two (2) Elections Officers; 2.4 Publicity Officer. Section 3. The following shall be the responsibilities of the Electoral Board: 3.1 Set and announce the specific schedule of the election proceedings; 3.2 Implement the provisions of the Electoral Code duly approved by the General Assembly and formulate all other rules and perform such duties as may be necessary and expedient in the fulfillment of its functions; 3.3 Convene members for all meetings and Miting de Avances; and 3.4 Make sure that the election’s integrity is upheld by implementing measures to ensure that minimum voter turnout is achieved. Section 4. All members of the Electoral Board must have the following qualifications: 4.1 All five (5) members of the Electoral Board will have the right to vote. All activities, transactions, and information regarding the elections shall be kept transparent among the members of the electoral board. 4.2 All five (5) members of the Electoral Board are not eligible for candidacy in the upcoming elections. Unless deemed necessary by the Organization's Executive Board. Section 5. Elections shall be held every academic year in accordance with the provisions in the Electoral Code. Section 6. At least two-thirds (2/3) of the registered members must have cast their votes for the elections to be declared valid. Section 7. The induction of the officer shall be held after the official proclamation by the Electoral Board, with the oath to be administered by the outgoing Chairperson in the presence of the General Assembly. UP TASK FORCE ARKI Building an environment that builds people Section 8. Any member who has become a candidate or has already been elected for an Executive Board position is eligible for re-election. Section 9. Officers shall have a Term of Office starting on the day after their Induction and ending on the day of the next Induction of the next set of Executive Board Officers. ARTICLE 15 Special Elections Section 1. Special elections are held when the following situations arise: 1.1 Resignation, permanent incapacitation, or impeachment of an officer; and 1.2 Less than two-thirds (2/3) of the registered inducted members have cast their votes for the elections. Section 2. All rules and regulations for regular elections as stated in Article X of this Constitution apply to special elections, except when a Committee Head is the position to be elected. In such case, only the current active inducted members of the concerned committee shall vote. 2/3rds of the committee must vote in order for the elections to be declared valid. ARTICLE 16 Succession of Duties and Responsibilities Section 1. In case of the Chairperson’s temporary incapacitation, the Vice Chairperson for Internal Affairs or Vice Chairperson for External affairs, to be voted upon by the remaining Executive Board, shall temporarily fill the vacancy. In the case of permanent incapacitation, a new Chairperson shall be elected by the General Assembly not later than the fourteen days after the vacancy in position is incurred. Section 2. Permanent incapacitation is assumed in cases of the assignment of missing status by police authorities, Leave of Absence (LOA) from the university, honorary dismissal from the university, impeachment, resignation, or death. Section 3. Any temporary incapacitation of any Committee Head shall be filled by the appointee of the Organization’s Executive Board from a member of that committee. 3.1 In the case of permanent incapacitation, the remaining committee members shall elect among themselves the person to fill that vacancy. UP TASK FORCE ARKI Building an environment that builds people 3.2 In the case that no officer was elected in the special elections, an Officer-in- Charge (OIC) shall be appointed by the remaining members of the Executive Board. Section 4. All rules and regulations for regular elections as stated in Article X of this Constitution apply to special elections, except when a Committee Head is the position to be elected. In such case, only the current active inducted members of the concerned committee shall vote. 2/3rds of the committee must vote in order for the elections to be declared valid. ARTICLE 15 Impeachment and Resignation of the Executive Board Section 1. Any officer may, by impeachment, be removed from the office for any of the following reasons: 1.1 Wilful violation of the Constitution and its bylaws; 1.2 Gross negligence of duties; 1.3 Embezzlement of Organization funds; 1.4 Expulsion from the University of the Philippines; and 1.5 Abuse or misuse of office. Section 2. Any motion of impeachment, regardless of the number of proponents, will be accepted by the Executive Board and will be presented to the General Assembly as soon as possible. Section 3. The impeachable(s) shall be subject to trial if at least one third (⅓) of the General Assembly votes in its favor of impeachment. Section 4. The Impeachment Process shall be as follows: 4.1 The remaining Executive Board members not subject to impeachment will assign among themselves one presider for the impeachment trial. 4.2 An Ad hoc team will be formed to decide on the impeachment case. The team will be composed of the remaining Executive Board members and two members from each committee chosen by either the Committee Head or the appointee of the Executive Board. If both heads are to be impeached, the committee members are to decide on their representative among themselves. 4.3 At least two thirds (⅔ ) of this team need to vote in favour of impeachment for a particular officer to be relieved of their duties. 4.4 The impeachment trial shall be conducted as discreetly as possible. UP TASK FORCE ARKI Building an environment that builds people Section 5. Any Executive Board Member may be relieved from their duties through voluntary resignation. They may turn in their resignation on the following grounds: 5.1 Health, spiritual, and emotional concerns; 5.2 Official Leave of Absence (LOA) from the University; 5.3 Confirmed Absence without Leave (AWOL); 5.4 Found to be guilty of any of the following: 5.4.1 Negligence of duty and/or incompetence 5.4.2 Malversation of funds 5.4.3 Absenteeism and constant tardiness 5.4.4 Expulsion from the University of the Philippines 5.5 Found to have a disciplinary case in the University. Section 6. No Executive Board Member shall be relieved from office through resignation without due process which shall include the following: 6.1 Submission and approval of resignation letter by the Executive Board; 6.2 Official announcement of the resignation internally; and 6.3 Proper turnover of duties, tasks, and projects on going to the officer replacing them ARTICLE 18 Expulsion Section 1. A member, who has failed to comply with their requirements in uplifting their probationary status, shall be ground for expulsion from the Organization. Section 2. The evaluation of probationary members by the Executive Board shall be based on reports by the Committee Heads, Vice Chairperson for Internal Affairs and from the members during evaluation period Section 3. The Expulsion Process shall be as follows: 3.1 A formal message or notification letter shall be sent by the Vice Chairperson for Internal Affairs 2-3 weeks before the first General Assembly of the semester. 3.2 The member under the expulsion process shall reply the following details within the time set by the Executive Board. 3.2.1 Reasons for neglect of member duties UP TASK FORCE ARKI Building an environment that builds people 3.2.2 Decision to continue/discontinue membership 3.2.3 Negotiate terms for reinstatement to full membership if continue which shall be evaluated by the Executive Board 3.2.4 Confirmation of attendance to first General Assembly 3.3 Failure to reply within the timeframe shall be grounds for automatic expulsion. 3.4 The final deliberation of the members for expulsion shall be held during the first General Assembly of the semester. 3.4.1 It shall be facilitated by the Standard Bearers; 3.4.2 The members under expulsion are required to attend to said General Assembly, unless they has been excused beforehand. In such case, the said member shall send a representative in order to discuss the terms with the Executive Board; 3.4.3 An open forum shall be held towards the members under expulsion process and their proposals; and 3.4.4 A Second Degree Quorum shall be made to finalize expulsion. Section 4. The following are the rights of the members under expulsion process: 4.1 A member may install a proxy in the case of their absence during the General Assembly. 4.1.1 They must notify the Executive Board their reason for absence. 4.1.2 He/ she must apply for the proxy (i.e. the proxy cannot notify the Executive Board themselves) and must show proof of proxy acceptance. 4.1.3 The proxy must be a non-probation inducted member. 4.2 A member may negotiate terms for reinstatement prior to final deliberation; these terms may be discussed as an individual, or as a representative of a group should there be cooperative work with other probation members. However, each member must indicate these in their reply letter explicitly (i.e. what particular work and which probation members will they work with). 4.3 A member may request documents and reports to contest their probation status and/or to support their proposals. 4.4 A member may refuse to answer questions posed during the open forum 4.5 A member may contest the facilitating Heads prior to the General Assembly which the Executive Board will have to consider UP TASK FORCE ARKI Building an environment that builds people Section 5. The following shall be the powers of the Members: 5.1 They can recommend a member for probation or expulsion with valid evidence to the Executive Board. 5.2 They can act as proxy for probationary members but cannot apply for themselves. 5.3 They can vouch for probation members during open forum. 5.4 They can vote during evaluation of proposals and raise concerns during deliberation if deemed necessary Section 6. A member may opt for voluntary expulsion if they has a valid reason as deemed by the Executive Board. 6.1 They must write a formal letter explaining their reasons for voluntary expulsion. 6.2 The following grounds for voluntary expulsion are as follows: 6.2.1 Health, spiritual, and emotional concerns; and 6.2.2 Failure to comply with the Organization’s requirements. ARTICLE 19 Constitution Amendment Section 1. Amendments to the Constitution shall be recommended by an affirmative vote of fifty percent (50%) plus one (1) of an ad hoc Constitution Revision Team (as proposed by the Education and Research Committee Head and approved by the Executive Board members) and will be submitted to the Chairperson for review and approval. Section 2. The amendments shall take effect as part of this Constitution if and only if an affirmative first degree quorum is achieved in a plebiscite where these amendments are submitted to the members for approval. Section 3. Notice of the proposed change(s) of these bylaws shall be immediately sent out to members at least seven (7) days before the proposed change(s) is/are to be ratified. Section 4. Such proposed change(s) shall be implemented immediately upon its ratification. UP TASK FORCE ARKI Building an environment that builds people ARTICLE 20 Effectivity Section 1. The Constitution Revisions Committee shall execute the ratification process, which shall include the Organization Adviser, Executive Board, and a first degree quorum from the General Assembly. Section 2.
