  • Once practical completion is achieved, the employer is able to take possession of the works, the employer’s right to instruct variationsto the works will cease, and claims for delay on the part of the employer and for loss and expense/extension on the part of the contractor will no longer be valid.

  • Liquidated and ascertained damages or "LADs" (or sometimes "LDs") are damages that are agreed in advance and payable upon the occurrence of a specified breach of contract.
