Transferable Development Rights (TDR) and Development Rights Certificate (DRC) under UDCPR
- The questions are based on the Unified Development Control and Promotion Regulations (UDCPR).
Calculating Permissible TDR
- The formula to calculate permissible TDR on a receiving plot is X = (Rg / Rr) × Y
- 'Rg' stands for the rate of land of the generating plot in the TDR utilization formula.
Restrictions and Allowances for TDR Use
- TDR utilization is restricted in areas under the Irrigation Department’s blue line (flood control zone).
- TDR utilization is restricted in Coastal Regulation Zone (CRZ) areas.
- TDR cannot be used in Green Zones.
- Infrastructure improvement charges are not required for TDR utilization.
- TDR utilization is based on the Gross Plot Area excluding reservations.
- Koregaon Park area under Pune Municipal Corporation is exempted from TDR utilization.
Slum/URT/Amenity TDR Percentages
- A minimum of 30% of Slum/URT/Amenity TDR must be used in non-congested areas
- A maximum of 50% of Slum/URT/Amenity TDR is allowed in non-congested areas.
- The requirement of 30% slum/amenity TDR is not applicable in congested areas.
DRC Transfer
- In case of the DRC holder’s death, the DRC will be transferred to the legal successor after verification of title and legal heir documents.
- Voluntary transfer of DRC is valid only after endorsement by the Planning Authority.
- A registered agreement between the transferor and transferee is compulsory for DRC transfer.
Land and Ownership
- The Planning Authority must correct the Record of Rights before issuing a DRC
- The Record of Rights (7/12) document must show the land ownership for DRC generation.
Handing Over Land
- If the Appropriate Authority is a State Government Department, land shall be handed over free of cost.
- The Planning Authority may act as a facilitator to grant TDR to land reserved for other Appropriate Authorities.
- The value of land for handing over to the Appropriate Authority shall be considered as per the Ready Reckoner (ASR) of the handing over year.
Calculation Example
- Using the formula X = (Rg / Rr) × Y, if Rg = ₹2000/sq.m, Rr = ₹2500/sq.m, and Y = 1000 sq.m, then X = 800 sq.m.
