Criminal Law I
- Full completion stage of a crime is when the crime is committed, even if the completion stage is not further advanced.
- The rules on attempts in sections 20 and 21 of the Penal Code apply even if the crime is fully committed.
- Full completion stage of a crime is symmetrical.
- There is a less likely chance of an attempt to commit a crime.
Omission
- When assessing whether an omission falls under the concept of an act, it must be assessed whether the person is able to perform the act.
- Homicide can never be committed by omission.
- Direct omission crimes are always symmetrical crimes.
- Indirect omission crimes can be damage crimes, in which case the conditions of causality and probable consequence apply.
Classification of crimes - Omission
- Parents or other guardians of incompetent children can incur independent or derivative criminal liability if they show culpable neglect regarding the criminal acts of their children.
- Section 231 of the General Penal Code (burglary) describes, among other things, omission crimes.
- When assessing whether a person has violated section 120 of the General Penal Code (use of emergency flares), experience and knowledge related to the use of emergency flares does not matter.
