Study Notes
Reportable Collisions
- The term "collision" is preferred over "accident" because a collision can be caused by a deliberate act.
- Injury can include shock, but not being dazed.
- A collision involving only one vehicle, where the driver is injured, is not reportable. However, if a passenger in that same vehicle is injured the collision is reportable.
- If two or more vehicles are involved and the only injury or damage is to the offending vehicle, all parties have a responsibility to report the incident.
Drivers Duties
- A driver who has stopped their journey, even for a short time, is still considered to be driving until they have finished their journey.
- Drivers must stop at or near the scene of a reportable collision, give their details to a constable on demand or to any other person who has reasonable grounds to require it, and report the incident to the police if it involved injury to any other person.
- If a driver does not report a collision to the other party involved, they must immediately report it to the police.
- Hit and Run is a separate offence.
Collisions Involving Non-Mechanically Propelled Vehicles
- A collision involving a mechanically propelled vehicle and a non-mechanically propelled vehicle (e.g., a bicycle) is reportable under Article 175.
- A collision between two non-mechanically propelled vehicles is not reportable under Article 175 but would be reportable under Article 176.
Damage to Property
- Property is defined broadly in this context and includes things belonging to someone.
Collision Investigation
- Police officers must provide professional service and a positive approach to the investigation and recording of road traffic collision, remembering always to respond within the terms of the Code of Ethics.
- It is important that police officers record details of property damaged, the owner of the property, and whether they have been informed.
- If a collision involves only damage and no injury, police do not need to complete a detailed report. However, they must still record specific details of the incident.
- All drivers involved in road traffic collisions should be given a preliminary breath test (PBT) in accordance with Article 17 of the Road Traffic (NI) Order 1995.
- Drivers with injuries who cannot provide a PBT should be assessed by medical staff.
- If a driver has been taken to hospital before or upon arrival of police at the collision scene, officers must follow the hospital procedure as outlined in Form DD/C ‘Drink/Drugs – hospital procedure’.
Collision Scenarios
- A driver who throws a bottle from a moving car, causing damage to a property, is not obliged to report the incident under Article 175.
- A driver who causes a pedestrian, who is not in a vehicle, to be injured by swerving on the road is obliged to report the incident under Article 175.
- A driver who leaves their trailer unattended on a hill, which rolls down the hill hitting a parked car, is still obliged to exchange details with the driver of the other vehicle involved.
