RA 8344: Uniform Discharge/Transfer Slip and Penal Provisions

An official who violates the provisions of RA 8344 may be punished by imprisonment of NLT 2 years and 4 months but NMT 6 years.

Hospitals and medical clinics are required to establish a billing and collection procedure for non-emergency cases.

The provision of medical and surgical goods and services is covered by the Act's provisions.

Alleged violations of the Act's provisions may be reported to the Philippine National Police.

To demonstrate compliance with the Act's provisions, hospitals and medical clinics must maintain a copy of the law and its implementing rules and regulations.

If a violation of the Act's provisions is committed pursuant to an established policy of the hospital or clinic, the responsible director or officer may be punished by imprisonment of NLT 2 years and 4 months but NMT 4 years.

Receiving hospitals can refuse to provide care to patients based on payment.

Hospitals are allowed to transfer patients without proper documentation.

Hospitals can refuse to accept patients who cannot pay a deposit or advance payment.

All hospitals must use a Uniform Discharge/Transfer Slip for cases covered by RA 8344.

The transferring and receiving hospital can be located at any distance from each other.

Hospitals are not required to obtain the patient's consent before transferring them to another hospital.

It is lawful for hospitals or medical clinics to request deposits or advance payments from patients in emergency or serious cases.

A hospital can refuse to administer medical treatment and support to a patient if no deposit or advance payment is made.

In cases where a hospital lacks adequate care, the attending physician cannot transfer the patient to a facility with appropriate care.

The law does not provide any penalties for non-compliance with the provisions of RA 8344.

A patient or their representative cannot report violations of RA 8344 to the appropriate authorities.

RA 8344 does not amend any existing laws, including Batas Pambansa Bilang 702.
