Pregnancy and Lactation Considerations for Omaha Police Department Employees
- The Omaha Police Department (OPD) aims to ensure employees work free from discrimination related to pregnancy, childbirth, or related medical conditions.
- This policy does not affect any rights or privileges employees may have under federal, state, or local laws, or other City or OPD policies/agreements.
- The OPD recognizes pregnancy as a normal occurrence and will make accommodations for pregnant employees to participate in the workforce, and for new mothers related to lactation and/or health needs.
General Procedure
- Pregnant employees are not required to disclose their pregnancy, except as outlined in the OPD "Temporary Limited Duty" policy.
- Pregnant employees are eligible for temporary Limited Duty assignments, appropriate to their physical capabilities. Details are found in the OPD "Temporary Limited Duty" policy.
- The OPD attempts to ensure the workplace of known pregnant employees is free of toxic chemicals or activities with high physical trauma potential.
- Pregnant employees can decline Limited Duty Status if they prefer to remain in their regular duty assignments, provided this preference is stated before the third trimester, otherwise must be notified to the Employee Resources Sergeant.
Sworn Employees
- Pregnant sworn employees are allowed accommodations from the uniform requirements while on temporary limited duty, and can potentially wear business casual, unless another suitable dress is agreed upon.
- Pregnant sworn employees are strongly encouraged to consult their medical professionals about firearm qualifications and maternity-related issues.
- Pregnant sworn employees who cannot qualify for firearm qualifications due to their pregnancy or who choose not to can request a waiver from the Nebraska Law Enforcement Training Center (NLETC).
- Employees who need to qualify after an NLETC waiver can coordinate with training specialists for a later qualification shoot.
- Pregnant sworn employees are not recommended to participate in the OPD Recruit Academy due to the physical nature of the training/firearm qualification requirements.
Lactation Accommodations
- Employers must provide reasonable break time for expressing breast milk for one year after the child's birth. Separate and shielded space from view is also required, avoiding public places and coworkers.
- Lactation break times and locations need to be coordinated with the Employee Resources Sergeant (or appropriate supervisor).
- Employees/Supervisors will cooperate to determine appropriate times for lactation breaks, considering both physical employee needs and operational requirements.
- OPD facilities have designated Lactation Rooms.
Additional Considerations
- Employees can use workspaces, if needed to express breastmilk, that are shielded from coworkers/public.
- Lactation breaks may be delayed to avoid significant disruption of daily operations.
- Employees are allowed time off due to pregnancy/childbirth issues in accordance with the OPD “Leave Procedures" policy, including Family Medical Leave Act (FMLA).
- Upon returning from absence related to pregnancy/childbirth, the employee will coordinate with the OPD Employee Resources Sergeant for procedures to resume full duty.
