Executive Department
- Executive Power: Vested in the President of the Philippines.
- Presidential Qualifications: Natural-born citizen, registered voter, able to read and write, at least 40 years old, resident of the Philippines for at least 10 years prior to election.
- Vice-Presidential Qualifications: Same qualifications as President, elected with President in the same manner.
- Terms of Office: President and Vice-President serve 6-year terms, starting June 30th following election. President not eligible for re-election. No person who served as President for more than 4 years can be re-elected. Vice-President not eligible for more than two successive terms. Vacations do not count against the terms.
- Election: Held on the second Monday of May (regular election), unless otherwise specified. Certificates of canvass from each province/city are sent to Congress. The Congress determines the authenticity of certificates and counts the votes.

- Tie: If a tie in votes, the Congress (both houses) votes separately.
- Contests: Supreme Court is the sole judge for election contests related to the President or Vice-President.
- Oath: President, Vice-President, or Acting President take an oath.

Vacancies:
- Vice-President acts as President if President fails to qualify
- Vice-President acts if President dies, is disabled or removed.
- Speaker of the House acts as President, next in precedence, if the Vice-President dies or is disabled
- Congress determines who acts if the preceding offices cannot or do not act.
- Absence from Office: If President declares inability to discharge powers/duties, the Vice-President assumes responsibilities. Majority of cabinet can also trigger this. The Congress determines if the declaration of inability is valid and whether Vice-President should take over.
- Martial Law: President may suspend the writ of habeas corpus (60 days max.), place Philippines or a part of it under martial law, in cases of invasion, rebellion, and when public safety requires it. Congress may revoke this or extend it with 2/3 vote; Supreme Court can judge whether this is justified.
