Study Notes
Omaha Police Department (OPD) Policy for Mentally Ill and Dangerous Juveniles
- OPD policy prioritizes mental health facilities over jail for mentally ill and dangerous juveniles, aligning with Nebraska Revised Statutes (NRS).
- Officers are to use de-escalation techniques (verbal skills, empathy, active listening) before physical intervention, when feasible, for juveniles experiencing behavioral health crises.
- This policy does not apply to situations involving deadly force.
Definitions
- Adult: Individuals 18 years or older, or emancipated by courts.
- Behavioral Health Crisis: Episodes of mental/emotional distress causing significant or repeated disruptions.
- Behavioral Health Incident Tracking Form (OPD Form 78B): Records details of officer interactions with individuals exhibiting behavioral health issues. Data aids in tracking incidents and informing training, interventions, and procedures.
- Columbia-Suicide Severity Rating Scale (C-SSRS): Used to assess suicide risk in individuals being considered for temporary protective custody.
- Co-Responder: Trained mental health therapists who assist officers in the field. Coordinate with the Mental Health Coordinator and Mental Health professionals.
- Crisis Intervention Team (CIT) Officers: Trained and certified in crisis intervention techniques for dealing with mental illness.
- Custody: Detention and control by a person in charge.
- Dangerous: Significant risk of harm to self or others in the immediate future; or the inability to care for self.
- Emergency Admittance Pursuant to Certificate of Peace Officer Form (OPD Form 78): Used to document an officer's belief that a person is mentally ill and dangerous and needs further evaluation.
- Involuntary Mental Health Placement: Placement in a mental health facility for juveniles deemed mentally ill and dangerous, if harm is likely before court proceedings. Options include voluntary admission (with parental consent) or involuntary placement.
- Juvenile: Individuals under 18 years old who haven't been emancipated.
- Medically Stable/Unstable: Describes a person's medical needs at the time of encounter.
- Mental Health Facility: Licensed facility for treating mental illness. Requirements outlined in NRS §71-914.
- Mental Health Professional: Licensed professionals able to provide psychiatric care, as per relevant Nebraska statutes.
- Mentally Ill and Dangerous Person: Defining criteria for involuntary placement, including substantial risk of harm, based on NRS §71-908. Criteria includes recent violent acts/threats, suicide attempts/threats, or inability to meet basic needs (food, shelter, etc) for the individual or risk of harm to self due to self-inflicted harm. Juvenile inability to maintain health is included as a criteria if endangering health (e.g. constantly refusing personal hygiene to the extent of immediate health risk) or refusing medication to address serious medical needs (e.g insulin).
- Mobile Crisis Response Team (MCRT): Mental health professionals available 24/7 to assist responding officers with calls regarding behavioral health crises.
- Region VI Behavioral Health Care: Regional organization for community-based behavioral health services.
- Voluntary Admission: Agreement by parent(s)/guardian(s) to voluntarily place a juvenile in treatment.
Procedures
- General Principles: Mental illness is not a crime, no custody unless arrestable offense or threat to self/others, and treatment should be necessary only when compelling reasons exist.
- Training: All officers receive training on guidelines for dealing with mentally ill juveniles, mandatory annual review of this specific policy.
- Placement Decisions: Weigh the offense against the seriousness of behavioral health symptoms, attempt voluntary admission from parents/guardians first, proceed with involuntary placement only with probable cause.
- Placement Procedures: Officers: determine medical needs, contact field sergeant, notify parents/guardians, complete various forms like OPD Form 96 and 78 (juvenile affidavit and officer’s certification form.
- Transportation: Two officers should transport juveniles for placement. Body cameras are activated.
- Alternative Resources: Crisis Intervention Team (CIT) officers, Mobile Crisis Response Team (MCRT) and designated Co-Reponders are available for assessment and recommendations. The appropriate forms must be filled out, and notifications made if resources are utilized for voluntary or involuntary placements.
Additional Information
- OPD forms (78, 78B, 96) are specifically referenced for documentation of interactions.
- The C-SSRS screening tool is to assist in identifying suicide risk.
- OPD emphasizes a careful approach to determining whether a placement is necessary, with emphasis on the safety of all involved and respect for the juvenile’s rights.
