Article III: Organization of the Board of Nursing

Qualifications of Chairperson and Members of the Board

Examination and Registration

Qualifications for Admission to the Licensure Examination
- Applicants must be citizens of the Philippines.

Scope of Examination
- The scope of the examination is determined by the Board and covers fundamental nursing, professional adjustment, maternal and child health nursing, community health and communicable disease nursing, the nursing of adolescents, adults, and the aged, as well as mental health and psychiatric nursing.

Oath
- Successful examination candidates must take an oath of profession before the Board or an authorized government official.
Revocation and Suspension of Certificate of Registration/Professional License and Cancellation of Special/Temporary Permit
- The Board has the power to revoke, suspend, or cancel a nurse's certificate or permit.
- Grounds for action include violations of the act, unethical conduct, incompetence, malpractice, fraud, deceit, or false statements.
- A 4-year moratorium from revocation exists, for reasons of equity and justice, with proper application, payment of fees, and a corrected cause for revocation.
Nursing Education Program

Qualification of Nursing Service Administrators
- Must be a registered nurse in the Philippines.
- Have at least two years experience in nursing service administration.
- Possess a Bachelor of Science in Nursing degree with at least nine units in management and administration courses at the graduate level.

Position of Chief Nurse or Director of Nursing Service Qualifications
- Must have at least five (5) years of experience in a supervisory or managerial position.

Penal and Miscellaneous Provisions
- Fines of P50,000 to P100,000, or imprisonment of 1 to 6 years, are imposed on prohibiting acts.
- Those who improperly practice, misuse certificates, or give false information to obtain a license or permit can be penalized.
- Those who aid unlawful drug use may also be penalized.
Security of Tenure
- Regular public health workers' services should not be ended except for legal reasons, and after proper process.
- If unfairly dismissed from work, the worker is entitled to reinstatement, seniority, and back wages.
Discrimination Prohibited
- Public workers cannot be discriminated against based on gender, civil status, creed, religion, political beliefs, or ethnicity in the workplace.
No Understaffing/Overloading of Health Staff
- Understaffing or overloading of public health workers is prohibited.
- The ratio of health staff to patient load must support sustained, quality care without excessive work.
- Health students are only allowed for training and education purposes.
Administrative Charges
- Administrative charges against public health workers are investigated by a committee, which includes the provincial health officer and representation from existing national/provincial public health worker organizations, supplemented by a supervisor from the district when appropriate.
- The committee must present findings and recommendations to the Secretary of Health within 30 days.
- If the provincial health officer is involved, the Secretary of Health will appoint the committee members.
Service Beyond Normal Hours
