Methods of Legal Reasoning
- Istihsan (Preference): A juristic reasoning strategy used to depart from a ruling based on a particular analogy in favor of a principle considered more beneficial.
- Istishab (Presumption): A form of legal argumentation that relies on the presumption of the continuity of a legal condition to draw a ruling on a related situation.
