Licensing Hours
- Public houses, hotels, restaurants, guest houses, and conference centres have different permitted hours of operation throughout the week.
- The hours are divided into general permitted hours, additional permitted hours, and further additional hours, with varying times for each category.
- Private members clubs have specific hours but are allowed 104 special occasion authorizations throughout the year.
- Off-licences have restricted hours, with off-sales attached to public houses closing at 11pm.

Law and Order: Licensing
- It is an offence to fail to leave a licensed premise after being requested to do so by staff or a constable.
- Reasonable force may be used to remove an individual from the premises.
- Rioting, being disorderly or indecent in licensed premises are offenses punishable by fines or imprisonment.
- Youths under 18 cannot purchase or consume intoxicating liquor except in private residences.
Policing Your Beat: Underage Drinking
- Consuming alcohol in a public place is not explicitly defined but can be interpreted as drinking from a bottle or can.
- Possessing an open container in certain circumstances may also be considered consumption.

Confiscation of Alcohol (Young Persons) Act 1997

- It should not be used where young people’s drinking is not causing a problem, such as a family picnic.
- Police officers have the power to confiscate alcohol from a person under 18 if they reasonably suspect:

- The person intends for the alcohol to be consumed by someone under 18.
- A person under 18 who is or was recently with them has recently consumed alcohol.
- Police officers can also confiscate unopened containers of alcohol if there is a reasonable belief that the person is consuming or intends to consume the alcohol in a relevant place.
Drinking in a Public Place
- It is an offense to consume intoxicating liquor in a designated area within council boundaries.
- Most designated areas are clearly signposted, but even if the sign has been removed, it remains an area of no drinking.
- You must witness someone drinking alcohol as evidence; simple possession, even with an open container, is not sufficient.
- There are no powers to remove alcohol from offenders under this legislation, even if they continue to drink.
- Evidence must include observation of the person drinking, body worn video footage, and confirmation of the contents of the bottle/tin.
- If the offender refuses to provide their details, an arrest is necessary under Article 26 of the PACE.
- A statement must be completed and forwarded to OCMT who will forward the evidence and details to the council.
Private Security Industry Act 2001 (PSIA 2001)
- The Private Security Industry Act 2001 (PSIA 2001) regulates the security industry.
- The Security Industry Authority (SIA) is responsible for regulating the private security industry in the United Kingdom.
- The PSIA 2001 applies to a number of different security roles, including door supervision, close protection, cash and valuables in transit, public space surveillance (CCTV), security, key holding, and vehicle immobilising.
- Individuals undertaking licensable activity require a "front line" licence, while those managing, supervising, or employing licensed individuals require a "non-front line" licence.
- Door supervisors, security guards, and those working in house (directly employed) at pubs, clubs, events, or stadiums require a licence.
- A separate SIA licence is required for each different licensable activity undertaken.
- The PSNI works in partnership with the SIA, conducting joint operations to check compliance with the PSIA 2001.
PSIA Offenses
- The PSIA 2001 creates a number of offenses:
- Engaging in licensable conduct without a licence (Section 3(1)).
- Employing unlicensed persons in licensable conduct (Section 5(1)).
- Using unlicensed vehicle immobilisers in Northern Ireland only (Section 6(1)).
- Contravening licence conditions (Section 9(4)).
- Falsely claiming approved contractor status (Section 16(2)).
- Obstructing SIA officials or those with delegated authority (Section 19(5)).
- False statements to the SIA (Section 22(1)).
Police Powers under PSIA 2001
- Constables have the power to demand SIA licences for inspection.
- Door staff working at licensed premises must have a valid SIA licence (Section 3).
- Door staff must display their SIA licence at all times (Section 9) unless it's reported lost or stolen or in possession of the SIA.
