Leaving Children Unattended in Motor Vehicles
Prohibited Actions
- Leaving a child under 6 years old unattended or unsupervised in a motor vehicle for more than 15 minutes
- Leaving a child under 6 years old unattended or unsupervised in a motor vehicle with the engine running, if the child's health is in danger, or if the child appears to be in distress
Penalties for Violations
- Violating paragraph (1)(a): misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083
- Violating paragraph (1)(b): noncriminal traffic infraction, punishable by a fine of $50 to $500
- Violating subsection (1) and causing great bodily harm, permanent disability, or permanent disfigurement to a child: felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084
Authority of Law Enforcement Officers
- May use reasonable means to protect the child and remove the child from the vehicle
- Should place notification on the vehicle if the child is removed from the immediate area
- May remand the child to the custody of the Department of Children and Families pursuant to chapter 39, unless the parents or legal guardian are located
