Study Notes
Lawyer-Client Relationship Formation and Termination
- A lawyer owes numerous professional duties to a client under the Legal Profession Act once a professional relationship is formed.
- Professional conduct rules and other laws govern solicitor-client relationships.
- Lawyers have a duty of reasonable care regarding client's legal rights and duties.
Defining a Client
- A client is defined in the Legal Profession Act's interpretation provisions.
- In contentious business (disputes or litigation), a client is any person who retains or employs a solicitor.
- In non-contentious business (e.g., transactions), a client is any person with power to retain a solicitor.
- A person is potentially a client even before formal engagement, if they retain or are liable to pay the lawyer’s fees.
Duties to the Court
- Lawyer’s duty to the client is paramount, subject only to the duty to the court.
- The Legal Practitioner’s duty must uphold the Singapore Legal System's integrity.
Implied Retainers
- An implied retainer may arise where, despite no formal agreement, a person's actions suggest a lawyer-client relationship.
- Examples include cases where a lawyer acts for a person who wasn't formally retained.
- This is determined under circumstances and the conduct of parties.
Termination of Retainer
- The client has the right to terminate the retainer at any time for any reason.
- A lawyer has grounds to withdraw from the retainer, (e.g., conflict of interest) which must consider the best interest of all parties concerned.
