Intestate Succession

  • Intestate succession refers to the distribution of a deceased person's estate when they die without a will.

Basic Concepts

  • Collateral: a person with a common ancestor (e.g., sibling, aunt, uncle)
  • Spouse: includes married, civil union, and permanent life partners

  • Stirps/Stirpes: every child who survives the deceased, including those who predeceased but had descendants

Capacity to Inherit
