Restrictions on Law Enforcement Members
- A member's employment status will be reviewed by their chain of command if they are still subject to a restriction order after one calendar year.
POST License Expired, Suspended, Probated, or Revoked
- Sworn members must immediately notify their supervisor/commander if their POST license is expired, suspended, probated, or revoked.
- The notification must include a copy of all related documentation.
- The supervisor/commander will forward the notification through the chain of command, with a copy to the OGC and HRD.
Returning to Full Duty
- Prior to returning to full duty, the member must:
- Submit documentation to HRD confirming their commission has been reinstated.
- Not be returned to full duty until HRD receives proof of reinstated commission.
- Contact the Professional Training Section to verify POST certification requirements are met and current.
Limitations on Members with Restricted Authority
- Members with restricted authority may not:
- Carry a firearm in any law enforcement capacity.
- Work secondary employment that requires law enforcement authority or uniform.
- Access Department facilities, records, or equipment specific to their assignment.
Review of Restrictions
- The office handling the restriction will review documents submitted by the member, including:
- POST settlement, prosecutor declination, or administrative orders.
- Written, final disposition of the case issued by the Chief of Police.
- Criminal charges declined.
Notification of Legal Restrictions
- Members must immediately notify their supervisor/commander if they are:
- Arrested.
- Aware of a criminal case presented to a prosecutor involving them.
- Aware of an administrative revocation for refusal to submit to alcohol testing.
- Aware of a warrant issued for their arrest.
- Aware of restrictions on their privilege to drive.
- Named as a respondent in an Ex Parte Order of Protection or domestic/family court case.
Review and Amendment of Restrictions
- The Department may restrict a sworn member's authority based on various circumstances, including ensuring they can perform full and unrestricted duties, preserving Department integrity, and minimizing liabilities.
- Restrictions may be amended or extended by the authorizing office.
- Release of restrictions prior to the indicated end date will be sent by the authorizing office.
