Indian Railway Establishment Code (Volume 1), Chapter 5 - Leave Rules
- Short Title: Railway Services (Liberalised Leave) Rules, 1949
- Application: Applies to railway servants appointed on or after February 1, 1949, those who elected to be governed by these rules previously, and others under special orders; temporary servants with 3 years of continuous service also qualify, from the date of completion of their three-year continuous service, for the same leave conditions of original appointees.
Definitions
- Audit Officer: The Accounts and Audit Officer in the circle where the railway servant's office is located.
- Authority competent to grant leave: Specified in the First Schedule, according to the type of leave.
- Completed years of service: Continuous service under the Railways, including duty and leave (including extraordinary leave)
- Date of retirement: The afternoon of the last day of the month in which the employee reaches retirement age.
- Disability: Defined as "specified disability", "benchmark disability" and "disability having high support needs," per the Rights of Persons with Disabilities Act, 2016.
- Foreign service: Service where a railway servant receives pay from a source other than the Consolidated Fund of India or a State/Union Territory.
- Form: Forms referenced at the end of Chapter 5.
- Railway servant in quasi-permanent employ: A temporary railway servant who is eligible for the Ministry of Railways' ministerial service, but their position is not made permanent after three years.
- Railway servant in permanent employ: An officer who substantively holds a permanent position or has a lien on one.
- Vacation Department: A division permitting regular vacations for department employees.
Leave Rules
- Right to leave: Leave can be refused or revoked by the leave approving authority, but the kind of leave cannot be changed without the employee's written request.
- Effect of dismissal/removal/resignation: Ceases from the date of action, except in specified cases involving another post outside the Railways;
- Break in service due to strike: Legal strikes don't break service, while illegal ones do; the President can nullify an illegal strikes "dies non" period.
- Conversion of leave types: One type of leave can be converted to another before leaving service, but not as a right.
- Combination of Leave types: Different leave types can be combined. Casual leave isn't combinable with other leave types.
- Leave on a holiday: Employee can leave duty during holidays on certain conditions, if their next move is not impeded, etc..
General Conditions
