  • Children: Legitimate, step, and adopted children. Validity of adoption considered based on the circumstances of each case.

Gratuity for Temporary Railway Servants (1003)

Railway Board's Orders (Specific to Temporary Engineers 1002 (i))

  • Provident Fund: Employees must subscribe to the State Railway Provident Fund after 1-year continuous service.
  • Service Termination Before 5 Years: No government contribution or interest payable in cases of resignation before 5 years. Instead, gratuity is half a month's pay for each completed year of service.
  • Special Contribution: Additional special contribution might be payable for more than 12 years of service, similar to gazetted officers.

Gratuity for Temporary Railway Servants -Specific Conditions(1004)

  • Re-employed retired staff cannot receive gratuity.
  • Gratuity Amount: Based on years of service, max of 15 months' pay for 15+ years of service and max 6 months' pay if less than 15 years of service.

Death in Service (1006)

  • Gratuity to widow/children: Railway servants who die in service are granted gratuity (like those who are permanently incapacitated) to their widows and dependent children, based on years of service.
  • Payment in cases of death before gratuity: Widows or dependent children will receive gratuity if the servant dies before receiving gratuity, regardless of the father's employment status.

Compassionate Gratuity (1008)

  • Eligibility: Non-gazetted railway servants (permanent or temporary), whether deceased in service or after service but before payment, or receiving compensation, can be granted compassionate gratuity to their widows, children, parents, brothers, sisters, or other dependent relatives as approved by Railway Board if left in straitened circumstances after the employee's death.. Amounts calculated based on years of service (max 15 months' pay but not less than 12 months payable).
  • Railway Board's Approval: Railway Board approval needed if compassionate gratuity exceeds Rs. 5,000.

Additional Details

  • Minor/Lunatic Recipients: Payments managed by a legal guardian or a manager.
  • Deductions: Controlling officer can deduct any dues from gratuity payable to employees (Railway Institutes, co-operative societies, stores, and hospitals).
  • Deputation/Foreign Service Contributions: Government contribution towards provident fund and gratuity, governed by paragraph 1255 of the Indian Railway General Code, Vol. I. If leave salary is regulated by rule 829, contribution levies based on 1/24th of total pay in foreign service
  • Delegation of Powers: Senior officers can delegate their powers in accordance with rule 1012, but provisions of rules 1007 and 1008 cannot be delegated
