Incident Reporting and Management
- This training reviews the Office of Developmental Programs (ODP) Incident Management process.
- The goal is prompt action in reporting, responding to, and investigating incidents.
- Corrective actions mitigate risks and decrease future occurrences.
Reportable Incident
- A reportable incident includes various situations: abuse, behavioral health crisis events, death, exploitation, fires, law enforcement activities, missing persons, rights violations, serious illnesses, serious injuries, sexual abuse, suicide attempts, and fatalities.
- Incidents must be reported within 24 hours of being witnessed or discovered.
Employee Responsibilities
- Employees are mandated reporters, required by law to report suspected or known abuse to the correct authorities.
- Report any incidents immediately to your supervisor (phone/email).
- Reporting is required even if the incident was not directly observed.
Incident Management Roles and Process
- People hold multiple roles in incident management (providers, SCOs, and AEs).
- Each role has specific responsibilities, determined per incident.
- The roles may change.
- Initial Reporter: Anyone who first sees, experiences, hears about, or recognizes the signs of an incident. This includes those receiving services and their family members.
- Point Person: Receives initial reports and manages the incident throughout. Each provider and SCO must have at least one.
- Incident Management Representative (IM): Chosen by the agency to oversee management.
- Certified Investigator (CI): Trained by ODP to conduct investigations within 24 hours of entry into the Enterprise Incident Management system (EIM).
Administrative Review Process
- Entities handle incident reports and conduct investigations with a clear review policy.
- A committee reviews, following ODP Administrative Review Manual guidelines.
- Committee responsibilities include: evaluating speed, objectivity, and thoroughness; determining if the investigation is confirmed, not confirmed, or inconclusive; identifying preventative and corrective actions; completing the investigator report; and ensuring corrective actions are implemented.
Response upon Discovery of an Incident
- The agency must protect the person's health, safety, rights, and well-being after an incident.
- Immediate actions include: calling 911, removing the individual from danger, arranging for medical care, informing family/support coordinator, informing appropriate entities (e.g., Adult Protective Services), and letting the person know they can contact local law enforcement.
6100 and 6400 Reportable Incidents in PA
- Chapter 6100 (24-hour reporting): includes death, abuse, neglect, exploitation, missing persons, injury (beyond first aid), fire, and law enforcement activity; 72-hour reporting: medication errors; critical health and safety events.
- Chapter 6400 (unusual incidents): includes abuse, injury, trauma, illnesses requiring hospitalization, suicide attempts, rights violations, missing persons, misuse of funds, and serious disease outbreaks.
Abuse
- Abuse occurs when someone with authority misuses their power to harm or distress another person.
- Types of abuse include, but aren't limited to, physical, psychological, and neglect.
Physical Abuse
- Physical abuse is when someone uses force or mistreatment against a vulnerable person.
- It does not necessarily require visible injury.
- Common examples include hitting, pushing, rough handling, being exposed to cold or heat.
Psychological Abuse
- Psychological abuse involves harming a person mentally and emotionally through threats, intimidation, humiliation, isolation, or belittling.
Seclusion
- Seclusion happens when a person is placed in an area where they cannot leave.
- Includes physical barriers and verbal instructions preventing departure.
Behavioral Health Crisis Event
- A crisis event occurs when a person has extreme emotional or behavioral reactions that are too much for them to handle.
- Responses may include community-based crisis response (without transport), facility-based crisis response (transport to a psychiatric facility or hospital), immediate arrest/incarceration, voluntary psychiatric hospitalization, and involuntary psychiatric hospitalization.
Death
- All deaths must be reported.
- Natural causes (e.g., terminal illness, DNR)
- Unexpected deaths (e.g., external force, accidents).
Exploitation
- Exploitation happens when someone uses another individual's resources for their own benefit through illegal or improper acts.
- Includes various examples like failing to obtain consent, misuse of funds, and coercing behaviors from others.
Neglect
- Neglect is failing to provide vital or needed support to a person.
- Includes failing to provide needed care, supervision, and/or protection from hazards.
Self-Neglect
- Self-neglect is when a person denies themselves needed care, support, or services (actions or inactions).
- Examples include environmental factors (unsafe or unsanitary living conditions), medical factors (refusing necessary medications or medical attention), personal care and nutrition, etc.
Rights Violation
- A rights violation is an action that restricts or denies an individual's rights.
- Examples include civil/legal rights violations (voting, freedom of speech), communication restrictions, restricting services, and unauthorized restrictive procedures.
Serious Illness
- A serious illness is a physical condition requiring hospitalization and treatment.
- Includes chronic conditions (e.g., heart disease, diabetes) as well as acute conditions (e.g., broken bones, pneumonia).
Serious Injury
- A serious injury requires more than first-aid treatment.
- Includes fractures, lacerations, burns, dislocations, electric shocks, and injuries causing loss of consciousness.
Sexual Abuse
- Sexual abuse includes various actions with a sexual nature.
- It happens when a person cannot consent to sexual acts, and includes examples like rape, sexual assault, verbal harassment and grooming.
Site Closure
- A site closure is a situation where a location closes for various reasons.
- These include pest infestations, loss of utilities (power, water), natural disasters, structural damages, and other causes.
Unauthorized Use of Restraint
- Unauthorized use of restraints occurs when restraints aren't used according to ODP policies and guidelines.
- This includes various examples such as physical and chemical restraints causing pain, or using mechanical restraints like geriatric chairs, bed rails, or helmets.
Medication Errors
- Errors include administering the wrong medication, wrong dose, or not administering at the prescribed time.
- Medication errors must be reported within 72 hours and documented.
Fire
- Any situation requiring fire/safety personnel is considered reportable.
- This includes fires that cause or don't cause property damage.
Law Enforcement
- Any incident involving law enforcement should be reported, either as investigation details or as crimes, like vandalism, break-ins, threats, or acts causing harm in facilities
- Any crime/misbehavior that happens within a JFC location should be recorded as separate from police involvement.
Missing Person
- A missing person requires a report within the timeframe described in the policy.
Emergency Events and Declarations
- ODP provides specific guidance and direction on reporting procedures related to emergencies (declared emergency, public health emergency, outbreak, epidemic, pandemic, natural disasters, and bio-terrorism attacks).
