    Disciplinary Procedures and Employee Rights

    • Employees who are relieved from duty pending an investigation will continue to receive full salary and benefits.
    • Investigations by Internal Affairs can result in various dispositions: sustained, unfounded (not involved, exonerated, unwarranted, false), and not sustained.
    • Unfounded or unsubstantiated complaints of misconduct will not be placed in the employee's personnel file with sustained complaints.
    • If a sustained Internal Affairs complaint leads to suspension, demotion, or dismissal, the employee can request a Complaint Review Board.
    • Third-party complaints alleging criminal conduct may be submitted to the State Attorney if proven false.
    • Court orders to expunge records must be provided to the City, which will take necessary action to carry out the order.
    • Progressive and appropriate discipline will be administered for employee misconduct, including oral admonishment, counseling, reprimand, suspension, demotion, dismissal, and payment for lost or damaged equipment.
    • Training costs will be paid by the City.
    • Employees will be notified in writing of disciplinary actions and provided with supporting documentation.
    • Officers have the right to have a PBA representative or attorney present during disciplinary interrogations.
    • Employees, attorneys, and PBA representatives can review disciplinary documentation upon request.
