- IT pervasively affects daily life (online shopping, social media, digital education)
- Many existing legal issues take on new dimensions digitally (contracts, consumer protection, IP rights, privacy)
- New legal issues emerge due to novel technologies (e.g., cloud computing, AI, digital identity)
What is Law in General?
- Law encompasses differing definitions across cultures and time periods
- Different perspectives include punishment, oppression, rules laid down by power, or court predictions
- Modern definitions focus on conduct rules binding, regulated actions through penalties, and social infrastructure for conflict resolution and beneficial behavior
What is IT Law?
- Part of a broader legal study concerned with the use of computers and the internet
- Addresses the storage, transmission, and manipulation of large quantities of data
- Addresses privacy issues, internet use, and new technology
- Attempts to create rules for new technologies, particularly regarding contracts
Internet Governance
- Internet governance is the development and application by governments, the private sector, and civil society of shared principles, norms, rules, decision-making procedures, and programs, that shape the use and evolution of the internet.
- The internet lacks a central governing authority which requires self-regulation
- Governance mechanisms exist at multiple levels (international agreements, national laws).
Key Assumptions in IT Law
- IT law continually adjusts to a global and decentralized context, with a mixture of supra-national, and national-specific laws and regulations
- IT self-regulation and national laws frequently intertwine to regulate IT aspects
- Attempts at global coordination exist, but challenges remain due to the decentralized nature of IT systems.
