Penalties for Trespass

  • If the offender is armed with a firearm or other dangerous weapon, it is a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Taking into Custody

  • Any owner or person authorized by the owner may take into custody and detain a person who is reasonably believed to be committing trespass on property other than a structure or conveyance.
  • A law enforcement officer must be called as soon as possible after the person is taken into custody.
  • The taking into custody and detention does not result in criminal or civil liability for false arrest, false imprisonment, or unlawful detention.

  • Voyeurism is defined as secretly observing another person in a dwelling, structure, or conveyance, with a reasonable expectation of privacy, with lewd, lascivious, or indecent intent.
  • Penalties for voyeurism include a misdemeanor of the first degree for the first violation, and a felony of the third degree for subsequent violations.
