Warrantless Arrest for Assault or Battery
- A warrantless arrest for assault can be made if the assault occurs in the officer's presence, during a domestic violence situation, or upon a law enforcement officer, firefighter, emergency medical care provider, public transit employee, or another officer.
- Probable cause is required for a warrantless arrest for battery, which can consist of physical evidence or sworn statements.
Domestic Violence
- Domestic violence is defined as any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, or false imprisonment committed by one family or household member against another.
- Family or household members include spouses, former spouses, persons related by blood or marriage, persons who live together as a family, or who have lived together in the past as a family, and people who are parents of a child in common.
- The actual criminal charge will not be for domestic violence, but rather for the specific crime committed (e.g. assault, battery).
- The most dangerous time of a domestic violence call is when the officer approaches, as the abuser may know they are coming.
Determining the Abuser
