    The Florida Sexual Predators Act

    • The Act may be cited as "The Florida Sexual Predators Act"
    • Definitions:
      • "Change in status at an institution of higher education" means the commencement or termination of enrollment, employment, or volunteering at an institution of higher education
      • "Chief of police" means the chief law enforcement officer of a municipality
      • "Child care facility" has the same meaning as provided in s. 402.302
      • "Community" means any county where the sexual predator lives or establishes a permanent, temporary, or transient residence
      • "Conviction" means a determination of guilt, including a plea of guilty or nolo contendere, regardless of adjudication
      • "Department" means the Department of Law Enforcement
      • "Electronic mail address" has the same meaning as provided in s. 668.602
      • "Entering the county" includes being discharged from a correctional facility or jail or secure treatment facility within the county
      • "Institution of higher education" means a career center, community college, college, state university, or independent postsecondary institution
      • "Internet identifier" means any designation, moniker, screen name, username, or other name used for self-identification to send or receive social Internet communication
      • "Permanent residence" means a place where the person abides, lodges, or resides for 3 or more consecutive days
      • "Professional license" means the document of authorization or certification issued by an agency of this state for a regulatory purpose
      • "Social Internet communication" means any communication through a commercial social networking website or application software
      • "Temporary residence" means a place where the person abides, lodges, or resides, including vacation, business, or personal travel destinations
      • "Transient residence" means a county where a person lives, remains, or is located for a period of 3 or more days in the aggregate during a calendar year
      • "Vehicles owned" means any motor vehicle registered, co-registered, leased, titled, or rented by a sexual predator or sexual offender

    Legislative Findings and Purpose

    • Repeat sexual offenders, sexual offenders who use physical violence, and sexual offenders who prey on children are sexual predators who present an extreme threat to public safety
    • Sexual offenders are extremely likely to use physical violence and to repeat their offenses
    • The state has a compelling interest in protecting the public from sexual predators and in protecting children from predatory sexual activity
    • The designation of a person as a sexual predator is neither a sentence nor a punishment but simply a status resulting from the conviction of certain crimes

    Sexual Predator Criteria

    • An offender shall be designated as a "sexual predator" if:
      • The felony is a capital, life, or first-degree felony violation, or any attempt thereof, of certain specified offenses
      • The offender has not received a pardon for any felony or similar law of another jurisdiction
      • A conviction of a felony or similar law of another jurisdiction necessary to the operation of this paragraph has not been set aside in any postconviction proceeding
    • In order to be counted as a prior felony, the felony must have resulted in a conviction sentenced separately, or an adjudication of delinquency entered separately, prior to the current offense

    Sexual Predator Designation

    • An offender who meets the sexual predator criteria is designated as a sexual predator
    • The court shall make a written finding at the time of sentencing that the offender is a sexual predator
    • The clerk shall transmit a copy of the order containing the written finding to the department within 48 hours after the entry of the order### Sexual Predator Registration and Requirements
    • A person who establishes or maintains a residence in Florida and has been designated as a sexual predator, sexually violent predator, or other sexual offender designation in another state or jurisdiction must register in the manner provided in s. 943.0435 or s. 944.607.
    • Such person shall provide the department with an order issued by the court that designated the person as a sexual predator, or demonstrate that the designation has been removed by operation of law or court order in the state or jurisdiction in which the designation was made.

    Registration Information

    • A sexual predator shall register with the department by providing the following information:
      • Name; social security number; age; race; sex; date of birth; height; weight; tattoos or other identifying marks; hair and eye color; photograph; address of legal residence and address of any current temporary residence; electronic mail addresses; Internet identifiers and each Internet identifier’s corresponding website homepage or application software name; home telephone numbers and cellular telephone numbers; employment information; vehicle information; date and place of each conviction; fingerprints; palm prints; and a brief description of the crime or crimes committed.
    • If the sexual predator’s place of residence is a motor vehicle, trailer, mobile home, or manufactured home, they shall also provide vehicle identification information, including the license tag number, registration number, and a description of the vehicle.
    • If the sexual predator’s place of residence is a vessel, live-aboard vessel, or houseboat, they shall also provide vessel identification information, including the hull identification number, manufacturer’s serial number, registration number, and a description of the vessel.

    Changes in Registration Information

    • Any change in the following information shall be reported to the department:
      • Permanent, temporary, or transient residence; name; electronic mail addresses; Internet identifiers and each Internet identifier’s corresponding website homepage or application software name; home and cellular telephone numbers; employment information; and status at an institution of higher education.
    • A sexual predator shall report in person to the sheriff’s office within 48 hours after any change in vehicles owned to report those vehicle information changes.

    Institution of Higher Education Requirements

    • If a sexual predator is enrolled or employed at an institution of higher education in Florida, they shall provide to the department the name, address, and county of each institution, including each campus attended, and their enrollment, volunteer, or employment status.
    • The sheriff, Department of Corrections, or Department of Juvenile Justice shall promptly notify each institution of higher education of the sexual predator’s presence and any change in their enrollment, volunteer, or employment status.

    Sexual Predator Registration and Notification

    • A sexual predator must:

      • Register with the Department of Highway Safety and Motor Vehicles and obtain a driver license or identification card with a sexual predator designation
      • Pay costs for issuing or renewing a driver license or identification card
      • Provide fingerprints and additional information to confirm identity
      • Report in person to a driver license office for any changes or updates
    • Reporting Requirements:

      • A sexual predator must report in person to the sheriff's office within 48 hours of:
        • Establishing a transient residence
        • Changing a permanent, temporary, or transient residence
        • Changing name due to marriage or other legal process
      • A sexual predator must also report every 30 days while maintaining a transient residence
    • Electronic Mail Addresses and Internet Identifiers:

      • A sexual predator must register all electronic mail addresses and Internet identifiers with the department
      • This information must be updated within 48 hours of any changes
    • Home Telephone Numbers and Cellular Telephone Numbers:

      • A sexual predator must register all home telephone numbers and cellular telephone numbers with the department
      • This information must be updated within 48 hours of any changes
    • Employment Information:

      • A sexual predator must register all employment information with the department
      • This information must be updated within 48 hours of any changes
    • Institutions of Higher Education:

      • A sexual predator must register if enrolled or employed at an institution of higher education in this state
      • This information must include the name, address, and county of each institution
    • International Travel:

      • A sexual predator must report in person to the sheriff's office within 48 hours before traveling internationally
      • This information must include the address, municipality, county, state, and country of intended residence
    • Notification:

      • The department shall notify the sheriff and state attorney of the county where the sexual predator maintains a residence
      • The sheriff shall notify members of the community and the public of the presence of a sexual predator
      • The department shall maintain an online registry of sexual predators and provide information to the public
    • Verification:

      • The department and the Department of Corrections shall implement a system for verifying the addresses of sexual predators
      • Local law enforcement agencies shall verify the addresses of sexual predators who are not under the care, custody, control, or supervision of the Department of Corrections
    • Reregistration:

      • A sexual predator must reregister annually during the month of their birthday and every third month thereafter
      • Reregistration must include any changes to the required information### Presumption of Good Faith
    • Not overcome by technical or clerical errors made by departments or individuals compiling/providing information

    • Not overcome if information is incomplete or incorrect due to sexual predator's failure to report or provide false information

    Penalties for Non-Compliance

    • Failure to register, maintain/acquire/renew driver's license or ID card, provide required information, or respond to address verification correspondence: felony of the third degree
    • Failure to comply with requirements, including false registration information or omissions: felony of the third degree

    Enhanced Penalties for Specific Offenses

    • Convicted of or found to have committed certain offenses (e.g., s. 787.01, s. 794.011) where the victim is a minor and works/volunteers at places where children congregate: felony of the third degree
    • Mandatory minimum terms of community control for felony violations (first offense: 6 months with electronic monitoring, second offense: 1 year, third or subsequent offense: 2 years)

    Misuse of Public Records Information

    • Misusing public records information to secure payment from a sexual predator/offender: misdemeanor of the first degree
    • Knowingly distributing/publishing false information or materially altering public records information: misdemeanor of the first degree

    Prosecution and Jurisdiction

    • Can be prosecuted in the county where the act/omission occurred, last registered address, conviction occurred, or intended address
    • Can also be prosecuted in the county where designated as a sexual predator

    Notice of Duty to Register

    • Arrest, service of an information or complaint, or arraignment constitutes actual notice of the duty to register
    • Failure to immediately register following such notice constitutes grounds for a subsequent charge of failure to register
