    • The clerk of the court and appropriate staff in each county shall receive training in the effective assistance of petitioners as provided or approved by the Florida Association of Court Clerks and Comptrollers.
    • The clerk of the court in each county shall make available informational brochures on stalking when such a brochure is provided by the local certified domestic violence center or certified rape crisis center.

    Sworn Petition

    • The sworn petition shall allege the existence of stalking and shall include the specific facts and circumstances for which relief is sought.

    • Upon the filing of the petition, the court shall set a hearing to be held at the earliest possible time.

    • Within 24 hours after the court issues an injunction for protection against stalking, the clerk must electronically transmit a copy of the petition, notice of hearing, and temporary injunction to the sheriff or law enforcement agency of the county where the respondent resides.

      • Assault: from a misdemeanor of the second degree to a misdemeanor of the first degree.
      • Aggravated assault: from a felony of the third degree to a felony of the second degree.
      • Battery: from a misdemeanor of the first degree to a felony of the third degree.
