    Process and Service in Civil Actions

    • Summons, subpoenas, and other process in civil actions run throughout the state, and all process except subpoenas shall be directed to all and singular the sheriffs of the state.

    Service of Process

    • A notice of lis pendens must be recorded in the official records of the county where the property is located to operate as a lis pendens.
    • The notice must contain the names of the parties, date of institution of the action, name of the court, description of the property, and a statement of the relief sought.
    • A valid recorded notice of lis pendens remains in effect through the recording of any instrument transferring title to the property unless it expires, is withdrawn, or is otherwise discharged.

    • The chief judge of each judicial circuit may establish an approved list of certified process servers.
